AN ORDINANCE AMENDING ORDINANCE NO.
1035, WHICH PREVIOUSLY ADOPTED BY
REFERENCE UNITED STATES PUBLIC HEALTH
SERVICE FOOD SERVICE SANITATION
ORDINANCE AND CODE
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Cook and Du Page Counties,
Illinois, as follows:
Section 1: That Chapter 16, Health Regulations, Offenses Related
to Health Nuisances, be and the same is hereby amended by adding thereto
Article 6, entitled Food Service Sanitation Ordinance, which Article
re -adopts by reference the United States Public Health Service Food
Sanitation Service Ordinance and Code, and which Article 6 shall read
as follows:
Article 6
Food Service Sanitation Ordinance
Section 16.601. The 1962 Edition of the United States
Public Health Service Food Service Sanitation Ordinance and
Code, three copies of which are on file in the Office of
the Village Clerk, is hereby adopted and incorporated by
reference into the Municipal Code of the Village of Elk Grove
Village, subject to the additions, amendments and deletions
hereinafter enumerated.
Section 16.602. That Paragraph 18 of Section A and
Paragraph 2 of Section B wherein they refer to safe
temperature of 451 Fahrenheit and below, be amended by
substituting therefor 40° Fahrenheit and below.
Section 16.603. That Section F -2-A(1), General
Lighting Requirements, be amended to read as follows:
(1). At least 50 -foot candles of light shall
be required on all working surfaces and at least
20 -foot candles on other surfaces and equipment,
in food preparation, utensil washing and hand -
washing areas, and toilet rooms. Sources of
artificial light shall be provided and used to
the extent necessary to provide the required amounts
of light of these surfaces when in use and when
being cleaned. At least five-foot candles of
light at a distance of 30 inches from the floor
shall be required in all other areas, including
dining areas during cleaning operations.
Section 16.604. That the words "municipality
of..." in said Code shall be understood to refer to
the "Village of Elk Grove Village".
Section 16.605. That Section H, Enforcement Provisions,
Permits, Penalty, as adopted by Ordinance No. 1035, shall be
reinserted as Section 16.605 with the exception of Paragraph
3, Examination and Condemnation, which shall be amended to
read as follows:
3. Examination and Condemnation. Samples of food and
other substances may be determined or sampled by the health authority
as often as may be necessary to determine freedom from
adulteration and misbranding and determine bacterialogical
contact. The health authority may request the condemnation
of or request the removal, destruction or denaturing of
any food which is unwholesome, adulterated or misbranded.
The health authority may, upon written notice to the owner
or person in charge, place a tag or hold order on any food
which he determines, or has probable cause to believe to
be unwholesome. Under a hold order, food shall be permitted
to be suitably stored. It shall be unlawful for any person
to remove or alter a hold order, notice or tag placed on
food by the health authority, and neither such food or the
containers thereof shall be relabled, repacked, reprocessed,
altered, disposed of, or destroyed without permission of
the health authority, except on order by a court of
competent jurisdiction. After the owner or person in charge
has had a hearing as provided in Section H -1-E hereof and on
the basis of evidence produced at such hearing, or on the
basis of his examination in the event a written request for
hearing is not received within three (3) days, the health
authority may vacate the hold order, or may by written
order direct the owner or person in charge of the food, which
was placed under the hold order, to denature or destroy such
food or to bring it into compliance with provisions of this
Ordinance, provided that such order shall be stayed if the
order is appealed to a court of competent jurisdiction
within three (3) days.
Section 2: That the Village Clerk is hereby directed to provide
three (3) certified copies of the United States Public Health Service
Food Service Sanitation Ordinance and Code in the Office of the
Village Clerk.
Section 3: That the Village Clerk is hereby directed to publish
this Ordinance in pamphlet form.
Section 4: That any person, firm or corporation who violates any
of the provisions of this Ordinance shall be subject to a fine of not
less than Twenty -Five Dollars ($25.00) nor more than Twenty -Five Hundred
Dollars ($2,500.00) for each offense. In addition to the above penalties,
the Village of Elk Grove Village by its appropriate officer may proceed
by way of injunction in the Third District of the Circuit Court of
Cook County to enforce any of the provisions of this Ordinance.
Section 5: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
