HomeMy WebLinkAboutORDINANCE - 1188 - 10/25/1977 - ANNEXING & REZONING/MARATHON GASORDINANCE NO. 1188 AN ORDINANCE ANNEXING AND REZONING CERTAIN PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE (MARATHON) WHEREAS, a written petition has been filed with the Village Clerk of Elk Grove Village by the Marathon Oil Company, the sole owner of record of the hereinafter described land and territory, for annexation to the Village of Elk Grove Village; and WHEREAS, said land and territory is not within the corporate limits of any municipality, but is contiguous to the Village of Elk Grove Village and has no electors residing thereon; and WHEREAS, all applicable provisions of the Illinois Revised Statutes concerning annexation have been fully complied with; and WHEREAS, the Plan Commission of the Village of Elk Grove Village, acting as a zoning commission, has held pre -annexation hearings duly called and held according to law, and as a result thereof, find and believe it to be in the best interests of the Village that such property be annexed to the Village of Elk Grove Village; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, after having examined said petition to annex and the findings of the Plan Commission, find and believe it to be in the best interests of the Village that said land and territory be annexed thereto. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That the land and territory legally described as follows: The South 225 feet of the West 225 feet of the Southwest 1/4 of Section 31, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois, which territory is contiguous to the Village of Elk Grove Village, and is not within the limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village, and hereby granted B-3 Zoning Classification, so that hereafter said territory shall be included within the boundary lines and limits of said Village, as is by law, in such cases, made and provided. Section 2: That said property is annexed pursuant to the following terms and conditions: (1). That the Marathon Oil Company will install a sidewalk along its Devon Avenue and Rohlwing Road frontage in conformance with applicable Village Codes. (2). That Marathon Oil Company will connect into the existing SBL sanitary sewer and the existing SBL watermain and pay such fees to SBL for said connections to satisfy and meet all obligations that the Village may have to SBL according to the annexation agreement dated October 12, 1975 between the Village of Elk Grove Village and SBL Associates. (3). To subdivide said land into a one lot subdivision according to Village ordinances, including the dedication of a 25 foot easement for underground utilities and drainage along Rohlwing Road and Devon Avenue, and a 10 foot easement for public easement and utilities along the easterly portion of the subject property. Section 3: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this Ordinance together with an accurate plat of annexation of said territory with the Recorder of Deeds of Cook County, Illinois. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. VOTES: AYES: 5 NAYS: 0 ABSENT: 0 ATTEST: Eleanor G.
