AN ORDINANCE GRANTING A SPECIAL USE
PERMIT TO CITIZENS BANK AND TRUST COMPANY,
AS TRUSTEE UNDER TRUST NO. 457, AND GEORGE
GARUILOS, TO PERMIT A RESTAURANT ON
PROPERTY LOCATED AT THE SOUTHWEST CORNER
OF DEVON AVENUE AND ELMHURST ROAD
WHEREAS, the Plan Commission of the Village of Elk Grove Village,
acting as a Zoning Commission, conducted a public hearing to consider
the question of granting a special use permit to the Citizens Bank and
Trust Company, as Trustee under Trust No. 457, and George Garuilos,
to permit the construction of a restaurant in the I-2 Zoning District
as permitted by Section 5.85 of the Zoning Ordinance; and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village after having considered the recommendation of said
Plan Commission find and believe it to be in the best interests of the
Village that such special use permit be granted;
NOW, THEREFORE, BE IT ORDAINED by the.President and Board of
Trustees of the Village of Elk Grove Village, Cook and Du Page
Counties, Illinois, as follows:
Section 1: That there be granted a special use permit to the
Citizens Bank and Trust Company, as Trustee under Trust No. 457, and
George Garuilos, to construct a restaurant in compliance with the
site plan attached hereto and incorporated herein, said restaurant to
be located at the southwest corner of Devon Avenue and Elmhurst Road,
subject to the following conditions:
(A). The restaurant is to comply with all applicable
provisions of the Building Code, including those provisions
pertaining to fire limits.
(B). Wheel stops are to be located adjacent to the
concrete walk encompassing the restaurant.
(C). An area for garbage storage is to be screened so
as not to be visible from the street.
(D). The driveway ingress/egress and off-street driveway
are to be designated as fire lanes, as indicated in the site
plan attached hereto.
(E). The petitioner is to submit signed proposals to the
F.A.A. for review prior to the issuance of a sign permit by
the Village of Elk Grove Village.
(F). No more than 258 of the restaurant floor area
can be utilized for the consumption of alcohol without the
serving of food as licensed under Chapter 18, Article XVIII
of the Municipal Code.
(G). Sidewalks are to be installed along Devon Avenue
and Elmhurst Road.
(H). The parking lot and exterior illumination of the
building is to conform to the Zoning Ordinance. An approved
lighting plan must be approved prior to the issuance of -a
building permit.
Section 2: That this special use permit shall terminate at such
time as the permitee fails to comply with any of the abcve conditions.
Section 3: That any person, firm or corporation violating any of
the provisions of this Ordinance shall be subject to a fine of not less
than FIVE DOLLARS ($5.00), nor more than TWO HUNDRED DOLLARS ($200.00)
for each offense. Each day a violation is permitted to exist shall be
considered a separate and distinct offense.
Section 4: That this Ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
