HomeMy WebLinkAboutORDINANCE - 1131 - 4/12/1977 - SPRINKLING RESTRICTIONS AMENDEDORDINANCE NO. 1131 AN ORDINANCE AMENDING SECTION 22A.801 AND 22A.802 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE THEREBY AMENDING THE RESTRICTIONS ON THE USE OF WATER FOR OUTDOOR PURPOSES NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and Du Page Counties, Illinois, as follows: Section 1: That Section 22A.801 of the Municipal Code of the Village of Elk Grove Village be and the same is hereby amended to read as follows: 22A.801. Restrictions On The Use Of Water For Outdoor Purposes. All persons who reside or occupy premises in the Village or purchase water from the Village shall not use the water for sprinkling lawns, shrubs, trees and gardens; filling private swimming pools or washing vehicles (except in commercial establishments having approved and functioning water recycling facilities) with water distributed by the Village except as follows: A. Residential properties may use water for any outdoor purpose as follows: Saturdaysfrom 9:00 a.m, to 1:00 p.m. at locations having odd numbered addresses. Sundays from 9:00 a.m. to 1:00 p.m. at locations having even numbered addresses. B. Industrial and commercial properties may use water for any outdoor purposes as follows: Tuesdays from 9:00 a.m. to 1:00'p.m. at locations having odd numbered addresses. Thursdays from 9:00 a.m. to 1:00 p.m. at locations hav—ing even numbered addresses. C. Water may be used to establish newly installed or newly planted lawns having an area greater than 1,000 square feet upon issuance of a written permit by the Superintendent of Water and Sewer; said permit will be valid for fourteen (14) days and allow four (4) hours of water usage for the new lawn on each day the permit is valid. Permits may be renewed for a ten-day period. Applications may be secured from the Superintendent's Office at 666 Landmeier Road between 8:30 a.m. and 4:00 p.m. on Mondays through Fridays.. Persons seeking permits'for watering new lawns shall indicate the hours they prefer. The Superintendent is authorized to issue; to modify; to reject; or to revoke said permits. D. Periods of Emergency. If 9.n the opinion of the Superintendent of Water and Sewer an emergency exists to the extent that the Village's water production, storage or distribution system is unable to meet the need for water for indoor consumption or usage, public health and/or public safety purposes, the Superintendent is authorized to temporarily suspend or modify the foregoing sprinkling and outdoor usage of water regulations by giving notice in a newspaper having general circulation with the Village of such state of emergency and the conditions of temporary suspension or modifiction to be imposed. No individual state of emergency shall be declared for a period longer then seven (7) days, but a separate and subsequent state of emergency can be declared if emergency conditions are still in existence at the termination of any seven (7) day period. Section 2: That Section 22A.802 of the Municipal Code of Elk Grove Village be and the same is hereby amended to read as follows: 22A. 802. Penalty Any person, firm or corporation who uses water or consents to the use of water other than as provided for above shall be fined not less than $25.00 nor more than $200.00'. A separate offense shall be deemed committed on each day during, or on which a violation occurs or continues. Any person, firm or corporation who shall persist in violating the provisions of this Ordinance after a warning shall be subject to having his or its water service terminated for a period not to exceed forty-eight (48) hours, and payment of $10.00 to the Village for re-establishing water service. Section 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication to law as above provided.
