L� AN ORDINANCE AMENDING CHAPTER 18, LICENSES AND PERMITS, OF THE MUNICIPAL CODE, BY ADDING THERETO A NEW ARTICLE ENTITLED GENERAL RETAIL BUSINESS NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That Chapter 18, Licenses and Permits, of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended by renumbering the present Article XLIX, Enforcement Provisions, to Article L and establishing a new Article XLIX, entitled General Retail Business, which shall read as follows: Article XLIX. General Retail Business. 18.4901. Definition. The term "general retail business" as herein used is hereby defined to be those professions, occupations, businesses and/or commercial establishments engaged in general retail business within the Village and not specifically designated and licensed elsewhere in this Chapter 18 nor excluded by Section 18.4906 hereof. 18.4902. License Required. It shall be unlawful to operate or conduct a general retail business as herein defined without first having obtained a license therefor. 18.4903. Application. An application for a general business license shall be made in conformity with the general requirements of this chapter relating to applications for licenses. 18.4904. Regulations. (A) The area used by the public must be adequately lighted during business hours and shall be kept in a clean and sanitary condition. (B) No licensee shall use any.tradename unless registered with the proper authorities, nor any name which is likely to be confused with or mistaken for the tradename of any other licensee. (C) No licensee under this Article, nor anyone in his behalf, shall shout, make any outcry, blow a horn, or use any loud speaking sound device which is capable of being plainly heard upon the streets, avenues or other public places for the purpose of attracting attention to any goods, wares or merchandise which such licensee proposes to sell. (D) No business, occupation or activity licensed under this Article shall be conducted or operated so as to constitute a nuisance or as to amount to a nuisance in fact. (E) No licensee shall change, alter or disguise any label or tab identifying the manufacturer of any items sold by such licensee in order to,deceive the public as to the quality of the goods to be purchased. (F) It shall be the duty of every person licensed hereunder to comply with the Building, Fire and Health Regulations of this Code applicable thereto. 18.4905. Inspections. The Police Chief, Fire Chief, Building Commissioner and Health Officer of the Village or such persons designated by them shall periodically inspect the premises of each general business licensee to see that all provisions of this Article and all building, fire and health regulations of this Municipal Code are adhered to and complied with. 18.4906. Exclusions. The terms and provisions of this Article shall not be made applicable to a building or premises or portion thereof, the principal use of which is for the practice of medicine or dentistry or similar type of medical professional personal services, the practice of law, financial institution, the operation of general office activities not involving retail sales or services upon or to the persons visiting the premises, or any other business, the regulation of which is conducted exclusively by the State of Illinois and where specific preemption of Home Rule units of government from such regulation has been duly enacted by statute. The terms and provisions of this chapter shall not be made applicable to any activity carried on or operated by a government institution. Section 2: That Section 18.301, of Article III, License Fees, of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended by adding thereto the following: General Retail Business. $ 25.00 Section 3: Any person firm or corporation violating any of the provisions of this ordinance shall be subject to a fine of not less than $25.00 nor more than $500.00 for each offense, and a separate offense shall be committed on each day a violation continues or is permitted to exist. Section 4: That this ordinance shall be in full force and effect 2 from and after its passage, approval and publication according to law.
