AN ORDINANCE AMENDING CHAPTER 24, MISDEMEANORS AND OTHER OFFENSES, OF
THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE, BY ADDING
THERETO AN OFFENSE ENTITLED DAMAGE TO PROPERTY
BE IT ORDAINEDby the President and Board of Trustees of the Village of
Elk Grove Village, Cook and DuPage Counties, Illinois, as follows:
Section 1. That Chapter 24, Misdemeanors and Other Offenses, of the
Municipal Code of the Village of Elk Grove Village be and the same is hereby
amended by adding thereto a new section which shall read as follows:
Section 24.044. Damage to Property.
Whoever commits any of the following acts shall be guilty of an
offense of damaging property:
A. Knowingly or recklessly damages any property of another
without his consent.
B. Knowingly or recklessly by means of fire or explosives
damages the property of another.
C. Knowingly injures a domestic animal of another without
the owners consent.
D. Knowingly deposits on the land or in the building of
another, without his consent, any stink bomb or any
offensive smelling compound.
Section 2. That any person, firm or corporation violating any of the
provisions of this ordinance shall be subject to a fine of not less that Ten
Dollars ($10.00) nor more than Five Hundred Dollars ($500.00) for each offense
and each separate violation hereof shall be deemed a separate offense. In
addition to or in lieu of any penalty above provided, the Circuit Court may
order that restitution be made by the offending party or, if a minor, that
restitution be made by a parent or legal guardian of said minor to the party
whose property was damaged.
Section 3. That this ordinance shall be in full force and effect from and
after its passage, approval and publication according to law.
