HomeMy WebLinkAboutORDINANCE - 1137 - 4/26/1977 - PARENTAL RESPONSIBILITYORDINANCE NO. 11-31 AN ORDINANCE AMENDING CHAPTER 24, MISDEMEANORS AND OTHER OFFENSES, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE, BY ADDING THERETO A NEW SECTION ENTITLED PARENTAL RESPONSIBILITY FOR DAMAGE TO PROPERTY WHEREAS, the Corporate Authorities have been aware of increased incidence of acts of vandalism and similar offenses by juveniles; and WHEREAS, the Corporate Authorities recognize the need to provide a means of eliminating this problem in order to ensure the safety of the property and residents of the Village of Elk Grove Village; and WHEREAS, the Corporate Authorities believe that increased parental responsibility for actions of their children is essential for the effective control and elimination of the juvenile offenses referenced above. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and Du Page Counties, Illinois, as follows: Section 1: That Chapter 24, Misdemeanors and Other Offenses, of the Municipal -Code of the Village of E1k.Grove Village, be and the same is hereby amended by adding thereto a new section which shall read as follows: Section 24.045. Parental Responsibility for Damage to Property. 1. Definitions. As used in this section, unless the context otherwise requires, the terms specified have the meanings described to them. A. "Legal Guardian" means a person appointed guardian, or given custoday, of a minor by a Circuit Court of this State, but does not include a person appointed guardian or given custody of a minor under the Juvenile Court Act. B. "Minor" means a person who is not yet 18 years of age. 2. The parent or legal guardian of an unemancipated minor residing with such parent or legal guardian shall be presumed, in the absence of evidence to the contrary, to have failed to exercise proper parental responsibility and said minor shall be deemed to have committed the acts described below with the knowledge and permission of the parent or guardian in violation of this section, upon the occurrence of the events described in A, B, and C below: A. An unemancipated minor residing with said parent or legal guardian shall be adjudicated to be in violation of Section 24.044 of the Municipal Code of the Village of Elk Grove Village; and B. Said parent or legal guardian shall have received a written notice thereof, either by certified or registered mail, return receipt requested, or by personal service, with a certificate of personal service returned, from the Police Department of the Village of Elk Grove Village following said adjudication; and C. If at any time within one (1) year following the receipt of the notice set forth in B above, said minor is adjudicated to be in violation of Section 24.044 of the Municipal Code of the Village of Elk Grove Village. Section 2: Any person convicted of any violation of the provisions of this Ordinance shall be subject to a fine of not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00) for each offense and each separate violation hereof shall be deemed a separate offense. Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
