AMENDING CHAPTER 18, LICENSES AND PERMITS, OF THE I4UNICIPAL CODE AS IT PERTAINS TO LICENSE FEES FOR RESTAURANTS BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, as follows: Section 1: That Article 1, License Fees, of Chapter 18, of the Municipal Code of the Village of Elk Grove Village, be and the same is hereby amended by deleting the present license fee for restaurants contained therein and substituting the following: Restaurants Floor Area in Square Feet—l/ Fee 0 - 2,500 $100.00 2,501 - 5,000 150.00 5,001 - 7,500 200.00 7,501 - 10,000 250.00 10,001 - 12,500 300.00 12,501 - 15,000 350.00 15,001 - 17,500 400.00 17,501 - 20,000 450.00 20,000 - or over 500.00 *1/ The computation and the definitions therefor for total floor area are provided in Article 18. Section 2: That Section 18.801, Definitions, of Article 18, Restaurants, of the Municipal Code, is hereby amended to read as follows: 18.801. Definitions. The following words and terms wherever they occur in this Article shall be construed as herein defined. A. "Accessory Use" is a use customarily incidental and subordinate to the principal use of a building located on the same lot with the principal use of the building. B. "Basement" is the portion of a building located underground, but having less than one-half of its clear floor to ceiling height below the average grade of the adjoining ground. C. "Cellar" is the portion of a building partly or wholly underground, but having one-half or more than one-half of its clear floor to ceiling height below the average grade of the adjoining ground. D. "Floor Area" is the sum total of the gross horizontal areas of all the several floors of a building and its accessory buildings measured in square feet from the exterior faces of the exterior walls or from the center line of party walls separating two buildings or establishements on eacn of the respective floors, and shall include the basement floor, cellar floor, and floor space used for mechanical equipment whether open or enclosed, including such equipment as may be located in a penthouse, attic space, balconies, mezzanines, porches, verandas, stage areas and floor area devoted to and occupied by accessory uses, when used to prepare, store and serve food and drink, and are approved for such service use. E. "Owner" is an individual, firm, association, partnership, corporation, trust or any other legal entity having sufficient proprietary interest in any establishment to maintain and manage its operation. F. "Restaurant" shall mean and include any place where food or drink (other than alcoholic liquor) is prepared or served to the public or to employees for consumption on the premises. Section 3: That Article 18, Restaurants, be further amended by adding thereto the following: 18.1806. Floor Area Computation. Total floor area applicable for the determination of the yearly license fee shall include the sum total of all the floor area in use or served for or retained for the use of the food service establishment, including but not restricted to principal and accessory floor area, cellars, basements, storage or detached accessory buildings, even though any such floor area may be temporarily vacant or not in use. All measured area expressed in square feet shall be to the nearest integral square foot; if a fraction is one-half square foot or more, the integral square foot next above shall be taken. Any owner applying for one of the licenses included in the provisions of this Article shall be responsible for setting forth the computed square footage of its establishment on its license application. Section 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
