HomeMy WebLinkAboutORDINANCE - 1146 - 6/14/1977 - BUILDING ACTIVITIES CODE AMENDEDC (ORDINANCE No. 1146 An Ordinance Regulating Building Activities, Amending Chapter 13 of the Municipal Code of Elk Grove Village Now, therefore, be it ordained by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, SECTION ONE: Chapter 13 of the Municipal Code of Elk Grove Village is hereby repealed. SECTION TWO: That Chapter 13 of the Municipal Code of Elk Grove Village is hereby amended by adding the following Articles and by incorporating the provisions, requirements, and procedures established within and by each Article: ARTICLE I DIVISION OF DEVELOPMENT & BUILDING ARTICLE II BUILDING CODE ARTICLE III FIRE PROTECTION SYSTEMS ARTICLE IV ELECTRICAL CODE ARTICLE V PLUMBING CODE ARTICLE VI MECHANICAL CODE ARTICLE VII PENALTIES ARTICLE I: DEVELOPMENT AND BUILDING DEPARTMENT 13.101 CREATION There is hereby created a Department of Development and Building which shall consist of a Building Commissioner and such other employees as may be authorized by the President and Board of Trustees. 13.102 BUILDING COMMISSIONER There is hereby established the position of Building Commissioner. The Building Commissioner shall be appointed by the Village Manager and shall serve at his discretion. The Building Commissioner shall have control and supervision over all offices and employees assigned to the Department of Development and Building, subject to the general direction of the Village Manager. Wherever the term Building Official is used in any portion of the herein adopted codes, it shall mean the Building Commissioner of the Village of Elk Grove Village. - 2 - 13.103 DUTIES OF THE BUILDING COMMISSIONER The Building Commissioner shall be responsible for: A. The enforcement of all ordinances and codes of the Village relating to the construction, repair, or alteration of the buildings and structures and the use of streets or parkways in connection therewith. B. All inspections to insure compliance with building construction regulations. C. The enforcement of all zoning and land use ordinances of the Village. D. The maintenance of current accurate land use and zoning maps of the Village. E. Performing such other duties as may be required by the Village Manager including providing assistance and advice as may be required by the Plan Commission, or other agencies of the Village. - 3 - 13.104 BUILDING INSPECTOR There is hereby created the position of Building Inspector. The Building Inspector shall be appointed by the Village Manager and serve at his discretion. 13.105 DUTIES It shall be the duty of the Building Inspector to inspect all buildings and structures being erected or altered, as frequently as may be necessary to insure compliance with the Village Ordinance. The Building Inspector shall be under the direction of the Building Commissioner. 13.106 EX -OFFICIO ELECTRICAL INSPECTOR The Building Commissioner shall also be the chief electrical inspector and ex -officio electrical inspector and shall have the power to inspect any electrical installations and no electrical wiring shall be covered until after such inspection. He shall also have the power to cause the current in any wiring or circuit or conduit to be turned off whenever this is necessary in an emergency to protect life or property. 13.107 EX -OFFICIO PLUMBING INSPECTOR The Building Commissioner shall also be the chief plumbing inspector and ex -officio plumbing inspector and - 4 - C is hereby empowered to enforce all ordinances relating to the installation, care and standards of plumbing and shall make such inspections as may be necessary to insure compliance with such provisions. 13.108 COPIES OF PERMIT TO ASSESSORS In addition to all other duties, the Building Commissioner shall forward to the Township Assessors and County Assessors a copy of each building permit issued, at the end of each current month. 13.109 RECORDS - REPORTS The Building Commissioner shall keep records of all applications and shall show the disposal thereof. He shall make monthly reports to the Village Manager of his activities and of the services of the Department. He shall file such other reports as may be required by the Village Manager. �. 5 ARTICLE II: BUILDING CODE 13.201 ADOPTION OF REGULATIONS: ONE AND TWO FAMILY DWELLING UNITS: The provisions of the One and Two Family Dwelling Code, 1975 Edition as prepared by the Nationally Recognized Model Codes, is hereby adopted as the regulations governing the construction of detached one and two family units, their appurtenances and accessory structures except as noted herein: a) The provisions of the BOCA Basic Code 1975 Edition shall apply to items not specifically covered by the One & Two Family Dwelling Code, 1975 Edition. b) "Part VI ELECTRICAL" of said Code is hereby deleted and replaced by Article IV of this Chapter c) Chapter 2, Building and Planning, One and Two Family Dwelling Code, 1975 Edition, is revised by adding to section R-216 INTERIOR FIRE ALARM SYSTEMS, the following sentence at the end of the paragraph: The quantity, location and operation of these detectors shall meet the requirements of NFPA Std. #74 1974 Edition level #4 protection. Three copies of said One and Two Family Dwelling Unit Code, 1975 Edition, are available for inspection and on file in the Offfice of the Village Clerk. 13.202 ALL OTHER STRUCTURES The 1975 Edition of the Basic Building Code as prepared by the Building Officials and Code Administrators International, Inc. is hereby adopted as the regulations governing the construction of all other buildings and structures in the Village of Elk Grove Village. Detached one and two family dwelling unit provisions of the 1975 B.O.C.A. Basic Building Code shall not prevail, when specifically covered in the One and Two Family Dwelling Code, 1975 Edition - see 13.301 The 1975 B.O.C.A. Basic Building Code is hereby modified and amended in such manner as is set forth in the remaining Article of this Chapter. Three copies of said 1975 B.O.C.A. Basic Building Code are available for inspection and on file in the office of the Village Clerk. - 7 - 13.203 Insert the following into their respective positions in the 1975 BOCA Basic Building Code herein adopted (See Article 1 through 7 for amendments) BBC Sec. 1. 100.1 Elk Grove Village 2. 100.2 Elk Grove Village 3. 105.1 when adopted by the President and Board of Trustees 4. 107.0 Section deleted in its entirety 5. 118.4 as established by the President and Board of Trustees 6. 118.5 as established by the President and Board of Trustees 7. 122.3 as established by the President and Board of Trustees 8. 122.3 delete 9. 126.3 as established by the President and Board of Trustees 10. 200.1 Elk Grove Village 11. 200.3 Elk Grove Village 12. 300.1 Elk Grove Village 13. 301.2 Section deleted in its entirety and amended to read - (see 13.215) 14. 1307.2.1 four feet 15. 1307.2.2 four feet 16. 1407.1 as established by the President and Board of Trustees 17. 1407.2 Elk Grove Village 18. 1703.1 Elk Grove Village 19. 1900.5 Elk Grove Village OEM 13.204 DELETE THE FOLLOWING SECTIONS IN THEIR ENTIRETY Section 107.0 thru 107.9 inclusive Section 108.0 thru 108.8 inclusive 13.205 RIGHT OF ENTRY Section 112, Right of Entry, is hereby deleted and amended to read: A. 112.0 Right of Entry In the discharge of his duties, the Building Commissioner or his authorized representative shall have the authority to enter for the purpose of enforcing this code at any reasonable hour any building, structure or premises in the Village of Elk Grove Village where construction, alteration, repair, plumbing, electrical, mechanical work has been or is being performed with or without an approved Permit. B. 112.1 Official Badge The Building Commissioner and such personnel as may be serving as his authorized representative and/or authorized inspectors shall carry for purpose of identification such identification as is provided by the Village of Elk Grove Village. C. 112.2 Municipal Cooperation The assistance and cooperation of all municipal officials and employees shall be available to the Building Commissioner as may be necessary to enforce the provisions of this Code. 13.206 REQUIRED PERMIT Section 113.1, When Permit is Required, is amended to read as follows: When Permit Is Required: When the cost of construction is three hundred dollars ($300.00) or more it shall be unlawful to construct, enlarge, alter or demolish a structure; or change the occupancy of a building or structure requiring greater strength, exitway or sanitary provisions; or to change to a prohibited use; or to install or alter any equipment for which provision is made or the installation of which is regulated by this code, without first filing an application with the building official in writing and obtaining the required permit therefore; except that ordinary repairs, as defined in Section 102.0, which do not involve any violation of this code shall be exempt from this provision. Fences and/or dense plantings shall not be installed without first securing a permit pursuant to the Fence Ordinance of the Village of Elk Grove. - in . 13.207 PLANS AND SPECIFICATIONS Section 113.5, Plans and Specifications, is deleted and amended to read: 113.5 Plans and Specifications The application for a permit shall be accompanied by not less than three complete copies of plans and specifications bearing the sea! and signature of a registered architect, structural or professional engineer pursuant to the Statutes of the State of Illinois. Said plans and specifications shall be drawn to a scale to show with clarity the details and dimensions of the work to be performed and the material to be used. The Building Commissioner is authorized to modify and/or waive the requirement for plans and/or specifications when the proposed work is of a minor nature. Preliminary Plan Review services may be performed by the Building Commissioner or his authorized representative upon receipt of sufficient information of partially completed plans for the purpose of providing advice and assistance about Village requirements and standards. Said service shall be performed for a fee not to be in excess of one-half of the established fee normally charged for full and final plan review and approval. Any fees paid for said preliminary review shall not be credited toward the cost for final plan review work. 13.208 PLOT DIAGRAM Section 113.6, Plot Diagram, is amended as follows, and is to include the following as the beginning of the section: 113.6 Plot Plan and Survey In addition to the requirements below, evidence shall be furnished to the Building Commissioner, such as a plat of survey of said lot prepared by a licensed Illinois Land Surveyor, that the intended building site is a lot of record. Except for an addition to a single family residence, and their accessory structure, the Building Commissioner shall be provided with a plat of survey showing the location of said subsurface improvements in reference to property lines and other structures located on the same property under development and the elevation of subservice improvements per USGS datum, prior to proceeding with above -ground improvements, prepared by a licensed Illinois Land Surveyor. - 12 - 13.209 SUSPENSION OF PERMIT Section 114.2, Suspension of Permit, is hereby deleted and amended to read: 114.2 Suspension of Permit Any permit issued shall cease to be valid when approved work at the site has not started within sixty (60) days of the date issued, or been completed within twelve (12) months of the date issued, or been diligently pursued for a period of thirty (30) days following commencement of any work at the site unless otherwise extended by the Building Commissioner. 13.210 REMOVAL OF BUILDINGS Section 117, Removal of Buildings, is hereby deleted in its entirety and amended to read: 117.0 Moving of Buildings A. No person, firm or corporation shall move any building on, through, or over any street, alley, sidewalk or other public place in the Village without having obtained a permit therefore from the Building Commissioner. Applications for such permits shall be made in writing to the Building Commissioner and shall state thereon the proposed route and number of days it is intended that the building shall occupy any portion of any public street. - 13 - B. No permit shall be issued to move a building to a location within the Village of Elk Grove Village to a location when the use of said building at said location would cause a violation of applicable regulations. C. Any person, firm, or corporation applying for a permit under this Article shall prior to receiving a permit, submit a bond with a lawful corporate surety to be approved by the Village attorney, conditioned on compliance with all the provisions of this Article and agreeing to pay and holding the Village harmless from any claim which may be made against it by reason of the occupation of any public street by the building or structure moved. D. Whenever a public street is used safety warning devices shall be provided by a permittee as required by the Police Department. E. Whenever it shall be necessary to interfere with wires or cables of public utility in moving a building, the applicant for a permit shall furnish evidence that appropriate arrangements have been made with the affected public utility. - 14 - F. Whenever it shall be necessary in moving a building to traverse non -Village public streets, it shall be the responsibility of the applicant for a permit hereunder, to furnish evidence that appropriate permission has been secured from the agency or party who maintains and/or owns the non -Village public street to be used. G. Whenever a building or structure is moved or demolished, the sites shall be maintained in a safe condition and restored to grade in accordance with the provisions of Article 13 of the B.O.C.A. Basic Building Code, 1975 Edition. 13.211 SECTION 118.0 FEES Shall be amended as follows: Section 118.3 New Construction and Alteration, is hereby deleted and amended to read: 118.3 Plan Review and Building Permit Fees The fees for plan reviews and building permits shall be as established by the President and Board of Trustees. -ls- Section 118.4 Moving of Buildings, is hereby deleted and amended to read: 118.4 Moving of Buildings The fee for a permit to move a building or structure shall be as established by the President and Board of Trustees. Section 118.5 Demolition, is hereby deleted and amended to read: 118.5 Demolition The fee for a permit for the demolition of a building shall be as established by the President and Board of Trustees. Section 118.6, Signs, is hereby deleted and amended to read: 118.6 Sions The fee for a permit for signs and similar structures shall be as established by the President and Board of Trustees. Section 118.7, Accounting, is hereby deleted and amended to read: 118.7 Accounting All accounting and fiscal responsibilities shall be performed as required by Illinois Statutes and the Municipal Code of the Village of Elk Grove Village. - 16 - Section 118.8 Refunds, is hereby deleted and amended to read: 118.8 Refunds Refunds of fees paid shall not be authorized nor made. 13.212 UNLAWFUL CONTINUANCE Section 123.2 is hereby amended to read: 123.2 Unlawful Continuance It shall be unlawful for any person to continue any work in or about any building after having been served with a Stop Work order, except as may be authorized by the Building Commissioner to eliminate violations and/or unsafe conditions. 13.213 COMPENSATION OF BOARD SURVEY Section 126.3 Compensation of Board Survey, is hereby deleted in its entirety and amended to read: 126.3 Compensation Compensation of any person serving on the Board of Survey shall be as determined by the President and Board of Trustees. _ 17 _ 13.214 BOARD OF APPEALS Section 127.3 Compensation of Board of Appeals, is hereby deleted in its entirety and amended to read: 127.3 Compensation Compensation of any person serving on the Board of Appeals shall be determined by the President and Board of Trustees. - 18 - 13.215 FIRE LIMITS Delete Section 301.2 in its entirety and amend to read: The Fire Limits shall comprise all property now or hereafter zoned as office, business, or commercial property (Bi, B2, B3, and OT). Any property rezoned or reclassified as office, business, or commercial property shall be within the Fire Limits by virtue of zoning or said reclassification. 13.216 TABLE OF THE 1975 B.O.C.A. BASIC BUILDING CODE: Amend the following Table of the 1975 B.O.C.A. Basic Building Code. Table 305, Line R-2 under Columns 4A and 4B shall be limited to eight dwelling units or less, over eight (8) units not permitted. 13.217 PHYSICALLY HANDICAPPED & AGED Section 316, is hereby deleted in its entirety. 13.218 PARKING LOTS Section 423 Parking Lots, is hereby deleted in its entirety and add new Section 423. All parking and off-street loading areas, shall be installed in accordance with the requirements of the Elk Grove Village Zoning Ordinance. 424.6.2 - to read same as revised Section 423. 425.4 - to read same as revised Section 423. - 19 - 13.219 SWIMMING POOLS A. Section 428.4 is deleted in its entirety. For location see Ordinance 842, Section 3.54 D B. Section 428.6.3 is hereby deleted and amended to read: 423.6.3 Drainage Systems Water demand from a pool shall not be discharged to the storm sewer during periods of rain or storms. At no time shall the rate of drain water exceed a flow of 200 gallons per minute. 428.8.3 Safety Devices Change depth of pool from 24" to 30". 13.220 EXIT SIGNS AND LIGHTS Section 623.1, add as last sentence: Exit signs shall be equipped with phosphorescent glass reading EXIT in Red Letters. Section 623.1, delete "or in other approved distinguished colors". Section 623.2- Revise last sentence to read after word occupied insert (to be installed per NEC 75 (700) - 20 - 13.221 MEANS OF EGRESS LIGHTING Section 624.4 - Independent Power Source, is hereby deleted and amended to read: Section 624.4 An independent power source in accordance with NEC 75 (700-6a, b, or e) shall by provided for every building in excess of 5,000 square feet, or any other exitway area subject to total darkness regardless of area. 13.222 CONTINUITY OF FIREWALLS Section 907.7 is hereby deleted in its entirety and amended to read: 907.7 Continuity of Firewalls In all buildings and structures, firewalls shall be continuous from foundation to two (2) feet eight (8) inches above the roof surface. - 21 - C 13.223 PRECAUTIONS DURING BUILDING OPERATIONS Section 1301.1 Temporary Construction, is hereby deleted in its entirety and amended to read: 13.01.1 Temporary Construction (Operational Plan Requirement) A. A Building Permit shall not be issued until an operational plan has been submitted to and approved by the Building Commissioner. The operational plan shall indicate emergency fire apparatus vehicle access, as determined by the Fire Chief, capable of supporting an emergency fire apparatus vehicle weighing 42,000 lbs., truck runways, employee parking areas, and material storage yards. _22_ B. A $1,500.00 cash deposit or irrevocable letter of credit, payable to and on demand by the Village of Elk Grove Village shall be deposited with the Village Treasurer. C. The cash deposit or letter of credit shall be cashed and called to the extent necessary to meet expenses incurred by the Village of Elk Grove Village if any aspect of the operational plan is violated, or if the requirements of Section 13.224 are not observed. Construction work shall cease if the level,of the cash deposit or letter of credit is not restored within four business days and said work shall not be resumed until said deposit requirements are met. D. Upon successful completion of all construction activities authorized by a permit and final inspection approval by the Building Commissioner, the cash deposit or letter of credit then on file with the Village shall be returned unused to the depositor by the Village Treasurer, E. The Building Commissioner may, when the work to be performed under a permit is minor in nature or scope, authorize a cash deposit or letter of credit or other deposit of less than $1,500.00 to fulfill the above requirements. -23- 13.224 MAINTENANCE Section 1304.1 Maintenance, is hereby amended to include the following as the last paragraph in the section: 1304.1 Maintenance A. It shall be unlawful to allow dirt, debris, gravel, stone, concrete or any other material to be deposited, dropped or thrown on a street which has been prepared for construction, repair or reconstruction or which has a bituminous paving course in place. The Building Commissioner and his authorized representatives are authorized to stop all construction activity if upon prior written notice by him to the owner's agent or general contractor, such material are not removed within two (2) hours. B. Failure of the builder and/or developer to maintain the emergency fire apparatus vehicle access routes in a usable fashion, as determined by the Fire Chief or to abide by the approved said operational plan shall constitute sufficient grounds for the Building Commissioner to suspend any building permit issued in the affected area (Ref. 13.222) - 24 - C. The cash deposit or letter of credit, required under Section 13.325, shall be used or cashed to the extent of expenses incurred by the Village if any Village employee, Village equipment, or Village contracted services are used to remove any such material frcm any street as described above. Said expenses shall be determined in accordance with a schedule of charges approved by the President and Board of Trustees and on file in the Office of the Village Clerk. 13.225 SIGNS AND OUTDOOR DISPLAY STRUCTURES Article 14, Signs and Outdoor Display structures, is hereby deleted in its entirety and amended to read: Article 14 Signs and Displays It shall be unlawful to construct, erect, remove, relocate, expand or alter any sign, display or similar item of any size or nature without first securing a permit pursuant to the Sign Regulations of the Village of Elk Grove Village. -25- I ARTICLE III: FIRE PROTECTION SYSTEMS 13.30__ 1_ SCOPE The provisions of this article specify where fire protection and detection systems shall be required in all buildings or structures or parts thereof hereafter erected. The 1975 Edition B.O.C.A. Mechanical Code, Article 10, and 1975 Edition B.O.C.A. Basic Building Code, Article 12 as herein after amended are hereby adopted as the regulations governing the installation Of fire protection and detection systems. ` - 26 - 13.302 AUTOMATIC FIRE ALARM SYSTEMS Section 1216.3 is deleted and amended to read: "A complete heat and smoke detection system shall be installed and maintained in accordance with Appendix B of the 1975 Edition of the BOCA Mechanical Code in all buildings herein des- ignated. A. All hotels, motels, lodging houses, and dormatories having more than fifteen (15) sleeping rooms above the first or grade floor and with an occupancy load of fifty or more persons shall be provided with an approved heat and smoke detection system in all enclosed common hallways, corridors, meeting rooms and exitways. B. Senior Citizen Housing as defined in the Elk Grove Village Zoning Ordinance shall be provided with a complete approved heat and smoke detection system installed in accordance with the provisions of - Appendix B (NFPA 72C) of the 1975 B.O.C.A. Basic Mechanical Code throughout the buildings." C. All Multi -Family dwellings over two stories in height or more then twenty (20) dwelling units above the first floor shall be provided with an approved heat and smoke detection system in all enclosed common hallways, corridors, meeting rooms and exitways. D. All hospitals, nursing homes, asylms and similar type buildings shall have an approved heat and smoke detection system in all enclosed common corridors, hallways and exitways. E. All schools, churches, and governmental buildings over one thousand (1000) square feet in area shall be equipped with an approved heat and smoke detection system. Exception: Building is completely Sprinklered. F. All restaurants with a seating capacity of more than forty (40) persons shall be equipped with an approved heat and smoke detection system. Exception: Building is completely Sprinklered. - 27 - 13.302 AUTOMATIC FIRE ALARM SYSTEMS (continued) G. All bowling alleys and recreational purpose buildings shall be equipped with an approved heat and smoke detection system. Exception: Building is completely sprinklered. H. All the theaters and assembly halls with a seating capacity of more than t,;;o hundred (200) persons shall be equipped with an approved heat and smoke detection system. Exception: Building is completely sprinklered. I. All office buildings over two (2) stories in height shall be equipped with an approved heat and smoke detection system in all enclosed corridors, hallways, meeting rooms and exitways. 13.303 AUTOMATIC FIRE ALARM Section 1216.3.4 Residential (R-2 and R-3) use, is amended to include the following at the end of the sentence: "The quantity, location, and operation of these detectors shall be in conformance with NFPA 74 (1974 Edition) level #4 protection." 13.304 SYSTEM SUPERVISION Section 1218.2 is deleted in its entirety and amend to read as follows: All Fire Protection systems shall have a direct connection to the Elk Grove Village Fire Department Communications Center or an alternate method of connection as approved by the Fire Chief. -28- I 13.305 MANUAL FIRE ALARM SYSTEMS Section 1217.3 Where required is hereby amended to include the following: In buildings of use group S-1, S-2, and I occupancies more than 2 stories in height or more than 150,000 square feet in floor area of the same tenant area, a manual fire alarm system is required. 13.306 SPRINKLER DRAINAGE SYSTEMS A minimum of one (1) four (4) inch floor drain or other approved means shall be provided, and drains shall be located a minimum distance if eight (8) feet away from any column or wall, for every 10,000 square feet on the grade or subgrade floor, and for every 5,000 square feet on any floor area above grade floor. 13.307 APPEAL Appeals to this Article may be taken pursuant to the provisions and procedures of Section 127.0 of the 1975 B.O.C.A. Basic Building Code. 13.308 FEES The fees for Fire Protection Plan Review shall be as established by the President and Board of Trustees. - 29 - ARTICLE IV ELECTRICAL CODE 13.401 PERIODIC PERMITS A Periodic Permit for the installation, alteration and repair of electrical conductors and equipment may be issued to a person only where such electrical work is to be performed in or on the premises or property owned or controlled by the said person, and used exclusively by him to conduct his business. 13.402 It shall be unlawful to obtain a Periodic Permit under the terms of this article for the installation, alteration, and repair of electrical conductors or apparatus where such work is performed under or by contract. 13.403 No Periodic Permit shall be issued to any person until a qualified electrician is appointed as required by this Code. 13.404 Where an applicant has complied with this Code, the Chief Electrical Inspector or his authorized representative shall certify him as a qualified electrician to said person, firm, or corporation. - 30 - C 13.405 QUALIFIED ELECTRICIAN Before any permit to install, alter, or repair electrical work shall be issued to any person, entitled to secure permits under the electrical regulations of this Code, he shall appoint or employ a person who may himself or some other person who, for the purpose of the electrical regulations of this Code, shall be known as a Qualified Electrician. The person so appointed or employed to act as a Qualified Electrician shall, before starting as such Qualified Electrician, be required to comply with this Code. 13.406 CERTIFICATION OF QUALIFIED ELECTRICIAN To act as Qualified Electrician, the applicant shall be not less than twenty-one (21) years of age, and shall have at least four (4) years of experience in the installation, alteration, repair, and maintenance of electrical wires, equipment, and apparatus, or in experience equivalent thereto. Names and addresses of employers, time employed, and in what capacity, and proof of such service shall be furnished to the Chief Electrical Inspector. The applicant may be required to answer correctly, a reasonable number of questions in writing to show that he has sufficient knowledge and technical training to perform said electrical work. - 31 - 13.407 Whenever a Qualified Electrician shall leave or be discharged from the employ of any person or firm required to employ a Qualified Electrician, within fourteen (14) days written notice shall be given the Building Commissioner by the employer. Permit privileges of such person or firm shall be suspended until a Certified Qualified Electrician is employed or appointed. 13.408 An annual, semi-annual or quarterly permit, (Periodic Permit) for the installation, alteration, and repair of electrical wires and apparatus may be issued, and renewal permits issued at the expiration date of original permit, to persons where, due to their method of operation or the nature of their business, it is necessary to make frequent alterations and change of their electrical equipment. 13.409 Before any annual, semi-annual or quarterly permit (Periodic Permit) shall be issued to any person, he shall appoint or employ a Qualified Electrician in conformity with this code. - 32 - 13.410 PERMIT AND INSPECTION FEES All permit and inspection fees under this Article shall be established by the President and Board of Trustees. 3.411 ADOPTION OF CODE The National Electrical Code, 1975 Edition, is hereby adopted by the Village of Elk Grove Village as its official Electrical Code and shall continue to be and its provisions shall continue to be controlling in the electrical wiring and electrical construction of all buildings and structures within the corporate limits of the Village, except insofar as the provisions contained in this Article may be in conflict therewith, in which event the provisions contained in this Article shall prevail and said provisions of the National Electrical Code in conflict therewith shall be of no force and effect. 13.412 CONSTRUCTION REGULATIONS FOR SINGLE AND MULTI -FAMILY R2, R3, R4, Al, and A2) RESIDENTIAL WIRING A. Each closet, storage area, six (6) square feet or larger shall have a light. - 33 - B. Wires shall not be drawn into conduit until wall finishes are applied and all mechanical work is completed, without written consent of the Chief Electrical Inspector or his duly authorized deputy. C. All fixtures installed over kitchen sinks or in bathrooms to be controlled by a wall switch. All bathrooms shall have at least one unswitched receptacle. D. Drop cards shall not be installed without the written permission of the Chief Electrical Inspector or his duly authorized deputy. E. All detached structures requiring electrical service shall be served underground in an approved manner, and shall be suitably protected against physical damage. F. All applications for permits to install or alter electrical wiring systems other than minor alteration or process wiring shall include plans indicating the following information: Outlets to same circuit, number of outlets on each circuit, number of outlets proposed, number and size of wire to be drawn in conduit and complete service and all feeder riser diagrams and grounding methods and material to be used. - 34 - G. All installations or alterations of electrical equipment shall be inspected before any of the work is concealed. Any person, firm, company, or corporation shall notify the Chief Electrical Inspector or his duly authorized deputy, giving twenty-four (24) hours notice before the required electrical inspection. 1. The Chief Electrical Inspector or his duly authorized deputy is herein empowered to remove or cause to be removed from said building any material which might interfere with a thorough inspection. Said removal shall be at owner's expense. 2. After wires are drawn in the conduits and properly spliced, it shall be the duty of the person, firm, company, or corporation to notify the Chief Electrical Inspector or his duly authorized deputy who shall inspect such work within twenty-four (24) hours of such notice being given. 3. It shall be unlawful to use or turn on power into, or induce any electric current to flow through any wires or equipment hereafter installed until approved by the Chief Electrical Inspector. Commonwealth Edison Company shall not be permitted to install a service meter unless approved by the Chief Electrical Inspector. - 35 - 4. The foregoing does not restrict the issuance of the temporary approval by the Chief Electrical Inspector or his duly authorized deputy for the use of electricity for construction purposes. H. Multi -family construction, except a two-family structure, shall be installed with Exit and Emergency lighting where required by 13.220. 13.413 CONSTRUCTION REGULATIONS FOR COMMERCIAL AND INDUSTRIAL (I1, I2, B1, B2, and B3, & OT) A. Definition: Commercial and Industrial Buildings shall by definition include all buildings or structures not used for residential purposes. B. Provisions for Commercial and Industrial wiring: 1. Service equipment may have multiple disconnects, but they shall be in one common enclosure. (a) Drawings shall be submitted to the Electrical Inspection Department of the Village of Elk Grove Village for approval before any custom built electrical equipment rated 1,000 amperes or larger is installed for use in service or distribution wiring system. - 36 - (b) The switchboard manufacturer who builds or assembles the service equipment shall submit three sets of detail drawings of his proposal, including the current interrupting capacity of all overcurrent devices, to the Utility Inspection Department (or the individual working for the Utility and designated by them as their plan examiner) who upon approval will retain one copy, stamp with their approval the two remaining copies of the drawings and forward them to the Department of Electrical Inspection of Elk Grove Village, who in turn will, upon approval, attach the Village approval stamp and return one copy to the Submitter bearing the approval stamp of both the Village and the Utility and any changes, corrections, additions, or deletions necessary for approval. C. Pendant hung flexible cable and cord will be permitted with the written approval of the Chief Electrical Inspector or his duly authorized deputy under those circumstances where the use of flexible cord as a wiring method is necessary to the method of operation due to frequent alterations and changes of the electrical equipment. All such cables shall contain a GROUND conductor and shall be terminated in approved fittings. - 37 - ! 13.414 ALL INSTALLATIONS OR ALTERATIONS OF ELECTRICAL EQUIPMENT BE INSPECTED BEFORE ANY OF THE WORK IS CONCEALED Any person, firm, company, or corporation shall notify the Chief Electrical Inspector or his duly authorized deputy, giving him twenty-four (24) hours notice before the required electrical inspection. A. The Chief Electrical Inspector or his duly authorized deputy is therein empowered to remove or cause to be removed from said building any material which might interfere with a thorough inspection. Said removal shall be at owner's expense. B. After wires are drawn in the conduits and properly spliced, it shall be the duty of the person, firm, company, or corporation to notify the Chief Electrical Inspector or his duly authorized deputy who shall inspect such work within twenty-four (24) hours of such notice being given. C. The Chief Electrical Inspector or his duly authorized deputy shall certify approval after the completion of installation of all wiring or all apparatus of said work is found to be in full compliance of the terms of this Article and with the rules adopted. - 38 - D. It shall be unlawful to use or turn on power into, or induce any electric current to flow through any wires or equipment hereafter installed until approved by the Chief Electrical Inspector. Commonwealth Edison Company shall not be permitted to install a service meter unless approved by the Chief Electrical Inspector. E. The foregoing does not restrict the issuance of a temporary approval by the Chief Electrical Inspector or his duly authorized deputy for the use of electricity for construction purposes. -39- ARTICLE V: PLUMBING CODE 13.501 FEES The fees for plumbing permits shall be as established by the President and Board of Trustees. 13.502 ADOPTION OF REGULATIONS The provisions of the Building Officials and Code Administrators International, Inc. , B.O.C.A. Basic Plumbing Code 1975 is hereby adopted as the regulations governing the design installation, alteration, repair, Cand maintenance of plumbing systems installed in Elk Grove Village, subject to the following amendments: 13.503 Revise following sections and amend to read: Addition to Section P-1205.0 Urinals P-1205.5 All flushometer and/or tank type urinals shall be of a water conserving nature and operate at a rate not to exceed 3.0 gallons maximum per flush. Wo Addition to Section P-1206. Flushing Devices for Water Closets and Urinals P-1206.2 .... at a rate not to exceed 3.0 gallons maximum per flush. P-1206.3.1 .... to thus act as a water conserving device and prohibit the valve from remaining in the open position. P-1206.3.1 Water closets for flush tanks shall be of a water conserving nature and operate at a rate not to exceed 3.5 gallons maximum per flush. Addition to Section P-1209.0 Showers P-1209.1.1 Every shower shall be equipped with a limited flow shower head of a water conserving nature and operate at a rate not to exceed 3.0 gallons per minute. Addition to Section P-1210.0 Sinks P.1210.2 The water supply to sinks shall be equipped with water saving devices that utilize aerators plus restrictors to operate at a rate not to exceed 3.0 gallons per minute. - 41 - P-1210.3 The water supply to sinks in public facilities shall be equipped with self-closing faucets which will not permit the unattended faucet to be left in the open position. Addition to Section P-1601.0 Water Required P-1601.3 Every building equipped with plumbing fixtures and used for human occupancy or habitation shall be provided with a water savings device on all plumbing fixtures. These fixtures shall not utilize a water flow rate in excess of the maximum rates published by the Illinois Department of Transportation in Rules and Procedures for Lake Michigan Allocation, or as may be forthcoming from the Secretary of Housing and Urban Development pursuant to the Energy Conservation and Production Act (H.R. 12169) in its Energy Conservation Standards for New Buildings (PL94-385). 13.504 COPIES OF THE CODE Three copies of the plumbing code adopted by the Village shall be on file in the Office of the Village Clerk. - 42 - ARTICLE VI: MECHANICAL CODE 13.601 PERMIT FEES All permit fees under this Article shall be as established by the President and Board of Trustees. 13.602 ADOPTION OF REGULATIONS The provisions of the 1975 Edition of the B.O.C.A. Basic Mechanical Code are hereby adopted as the regu- lations governing the design, installation, alteration, repair and maintenance of mechanical systems installed in the Village of Elk Grove Village, subject to the following amendments: C 13.603 Add the following: M609.1.1 The replacement of an existing appliance, in one and two family dwelling units, with appliance of an equivalent capacity shall not require alterations or changes to the structure or to the venting systems. 13.604 AIR POLLUTION CONTROL Article II - Air Pollution Control is hereby deleted in its entirety. (See Ord. 842, Section 5.9 Performance Standards) 13.605 COPIES OF THE CODE Three (3) copies of the Mechanical Code adopted by the Village shall be on file in the office of the Village Clerk. -43 - M ARTICLE VII: PENALTIES 13.701 Any person, firm or corporation violating any provision of this chapter shall be subject to a fine of not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day, commencing from date of official notification, during or on which a violation or failure to comply occurs or continues. In addition, the Village shall have the right to seek injunctive relief from the Circuit Court of Cook County, including the Third Municipal District thereof to abate or enjoin any violation of this chapter wherein the continuation thereof would cause a serious injury to the public health, safety and welfare. - 44 - SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Section Two: That Chapter 6 of the Municipal Code of the Village of Elk Grove Village is hereby amended by adding the following Article and by incorporating the provisions, requirements and procedures established within said Article: ARTICLE III - FIRE PREVENTION CODE f6.301 Adoption.) There is hereby adopted by the Village of Elk Grove Village for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion the BOCA (Building Officials & Code Administrators International Inc.) Basic Fire Prevention Code 1975 Edition, save and except such portions as are hereinafter deleted, modified or amended: 6.302 Copies of Code.) Article III of Chapter 6 repealed & amended by Ord. No. 837 passed 12-5-72.) Article III of Chapter 6 repealed & amended - 1 - by Ord. No. 1244 passed 9-12-78.) 6.303 Jurisdiction.) The jurisdiction of the Fire Prevention Code shall include property and structures within the Village of Elk Grove Village. 6.304 Creation of the Fire Prevention Bureau.) A Fire Prevention Bureau is hereby created in the Fire Department of the Village of Elk Grove Village. Said Bureau shall be under the direction of the Chief of the Fire Department subject to the general direction of the Village Manager. 6.305 Members.) A. The Chief of the Fire Department shall select a person to be, in k_ addition to any other responsibilities he may have, the Officer in Charge of the Fire Prevention Bureau who shall serve in such capacity at the discretion of the Chief of the Fire Department. B. The Chief of the Fire Department may also select additional persons as Inspectors to be assigned to the Fire Prevention Bureau under the supervision of the Officer in Charge of the Bureau. 6.306 Duties.) It shall be the duty of the Officer in Charge of the Fire Prevention Bureau to: A. Enforce all laws and ordinances of the State, County and Village, covering the following: 1. The prevention of fires; 2. The storage and use of explosives and flammables; 3. The maintenance of automatic and other fire alarm systems, and fire extinguishing equipment; 4. The maintenance, regulation and adequacy of means of egress; 5. The investigation of the cause and origin of fires. 6. The Officer in Charge of the Fire Prevention Bureau shall perform such other duties as may be required from time to time, including making recommendations to improve this Code. B. Provide technical staff assistance and support to the Building Commissioner of the Village of Elk Grove Village in the following areas: 1. Examination of plans for new construction, reconstruction or alteration of structures and to advise the Building Commissioner thereon of the extent of non-compliance with established Village requirements and codes relating to life, safety and fire preven- tion, alerting and suppression systems. 2. Inspection of construction in progress to advise the Building Commissioner thereon of non-compliance with life, safety, and fire prevention, alerting and suppression systems previously approved for said construction. 3• Review of existing and new standards, codes and requirements to advise the Building Commissioner thereon of changes con- sidered necessary for improved life, safety, and fire preven- tion, alerting and suppression systems. - 2 - C. A report of the Fire Prevention Bureau shall be made annually to the Fire Chief and transmitted to the Village Manager of the Village of Elk Grove Village. The report shall contain all proceedings under this Code, with such data as the Chief of the Fire Department may require, including recommendations to improve the Fire Prevention Code. 6.307 Definitions.) A. Whenever the word "Municipality" is used in the Fire Prevention Code, it shall be held to mean the Village of Elk Grove Village. B. Whenever the term "Corporation Counsel" is used in the Fire Prevention Code, it shall mean the Village Attorney for the Village of Elk Grove Village. C. Whenever the term "Village Managee'is used in this Fire Prevention Code, it shall mean the Village Manager of Elk Grove Village. D. Whenever the term "Fire Official" or "Chief of the Fire Prevention Bureau" is used in this Fire Prevention Code, it shall mean the Fire Chief of the Fire Department of the Village of Elk Grove Village. E. Whenever the Term "Building Commissioner" is used in this Fire Prevention Code, it shall mean the Building Commissioner of the Village of Elk Grove Village. 6.308 Prohibition of Storage and Location of Certain Matter.) A. Storage of flammable liquids in outside above ground tanks referred to in section F-2903.0 paragraph F-2903.1 of the BOCA Basic Fire Prevention Code 1975 Edition is hereby prohibited. B. New bulk plants for flammable liquids referred to in sectionF-2902.0 of the BOCA Basic Fire Prevention Code 1975 Edition is hereby pro- hibited. C. Bulk storage of liquified petroleum gas referred to in section F-3100.0 of the BOCA Basic Fire Prevention Code 1975 Edition is hereby prohibited unless: 1. Said storage is in accordance with all requirements of the 1976 Edition of Phamplet 58 of the National Fire Protection Association. 2. A security fence six feet (6') in height with barbed wire above is constructed and provided around all such tank installations, said fence shall be so constructed as to screen from view the lower six feet (6') of the tank installation. 3• The plans for said bulk storage and construction are approved by the Fire Chief as being safe from fire hazards and in accordance with the provisions hereof. - 3 - 4. That no tanks be installed in the flood plain, except when provided with devices capable of anchoring the tank to prevent its going afloat under flood conditions. 5. That no transfilling operations be allowed except that which is required from the mobile tank, truck or railroad car to the stationary above ground storage tank. 6.309 Amendments of the Fire Prevention Code.) Appendix B of the BOCA (Building Officials E Code Administrator International Inc.) Basic Fire Prevention Code is thereby deleted and amended to read: A. Accepted Enaineering Practice, Standards and Codes: 1. Basic Building Code, BOCA 1975, one and two family dwelling } Code 1975 Edition. i 2. Basic Mechanical Code, BOCA 1975 Edition. 3. Basic Plumbing Code, BOCA 1975 Edition. 4. National Fire Codes, NFiPA 1978 Edition. B. Wherever the Fire Prevention Code makes reference to permit being required those sections are hereby deleated. 6.310 Modifications.) -The Fire Prevention Bureau may modify any provision of the Fire Prevention Code upon application in writing thirty (30) days from the date of an order by Bureau submitted by the owner or lessee, or his duly authorized agent, when there are practical difficulties in carrying out the strict letter of the Code, provided that the spirit of the Code shall be observed and public safety secured. The particulars of such modification when granted or allowed and the decision of the Fire Prevention Bureau shall be entered upon the records of the department and a signed copy shall be furnished the applicant and to the Village Manager. 6.311 Appeals.) A. Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a license or permit applied for, or when it is claimed that the provisions of the code have been misconstrued or wrongly interpreted, the applicant may, upon payment to the Village Treasurer a sum equal to the estimated cost for publication and court reporter services, appeal from the decision of the Chief of the Fire Department to the President and Board of Trustees within thirty (30) days from the date of the decision on the modification application. B. The said President and Board of Trustees shall designate a time and place for a public hearing thereon and the applicant and Fire Chief may present pertinent information. The decision of the President and Trustees shall be final. A refund of money not used for the foregoing shall be made to the applicant by the Village Treasurer. - 4 - 6.312 New Materials or Processes Which May Require Permits.) The Chief of the Fire Department, the Officer in Charge of the Fire Prevention Bureau, and the Building Commissioner shall act as a Committee to determine and specify, after giving affected persons an opportunity to be heard, in addition to those now enumerated in said Code. The Chief of the Fire Department shall post such list in a conspicuous place in the Fire Department Headquarters Station, Office of the Building Departmnet, Office of the Village Clerk, and make copies thereof available to other interested persons. Section Three: Saving Clause. If any section, sub -section, or sentence, clause, or phrase of this Ordinance is for any reason declared or held invalid by a court of competent jurisduction, such decision or decisions shall not affect the validaity of the remaining portions of this Ordinance. Section Four: Ordinances Repealed. All other Ordinances, or parts of Ordinances heretofore enacted by the Village of Elk Grove Village in conflict with this Ordinance are hereby repealed. Section Five: Penalty. Any person, firm or corporation violating any provision of this Ordinance shall be fined not less than Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day, commencing from date of official notification, during or on which a violation or failure to comply occurs or continues. Partial Fire Protection Equipment Installation $25.00 for each system 7 Elevator Inspections The fees for the inspection of mechanical and electrical safety devices for passenger and freight elevators, man - lifts, moving stairs and dumbwaiters shall be $30.00 per inspection. The required number of inspections shall be as indicated in the B.O.C.A. Basic Building Code 1975 Edition, Section 1602. Re -inspection Fee. Wherever in this Article inspections are required and due to incorrect or inaccurate information given by the owner or agent of the premises, a re -inspection or additional inspection is required, an additional fee of $10.00 per inspection shall be charged. K RESOLUTION NO. 1-73 A RESOLUTION ESTABLISHING A FEE SCHEDULE FOR CLEANING DIRTY STREETS WHEREAS, Ordinance No. 833,* The Building Activities Code, Chapter 111, Section 330, establishes a requirement relating to damage to public facilities and dirt on streets by contractors constructing buildings within the Village, and WHEREAS, the attached fee schedule sets the fees for the express purpose of guaranteeing that the builder will be responsible for any damage to public facilities and cleaning of streets. NOW, THEREFORE, BE IT RESOLVED by The President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois, that the attached fee schedule for clean- ing dirty streets will be in full force and effect from and after its passage and approval according to law.
