AN ORDINANCE AMENDING CHAPTER 18 OF THE MUNICIPAL CODE OF THE VILLAGE
OF ELK GROVE VILLAGE RELATING TO LICENSING OF RESTAURANTS, FOOD DELIVERY
VEHICLES, TAXICABS AND SCAVENGERS
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village as follows:
Section 1: That Chapter 18, Article XVIII, Section 18.1801 of the
Municipal Code of the Village of Elk Grove Village be amended to read as
follows:
18.1801 Definition.) Restaurant shall mean and include any place
where food or drink (other than alcoholic liquor) is prepared or
served to the public or to employees for consumption on the premises.
Section 2: That Chapter 18, Article XLII of the Municipal Code of
the Village of Elk Grove Village be amended to read as follows:
18.4205 Public Vehicle Commission.) There is hereby established a
public vehicle commission which shall consist of the President and
Board of Trustees.
The public vehicle commission shall meet on call, at such times
as may be necessary to transact its business.
18.4206 Certificate Required.) No license to operate a taxicab in
the municipality shall be issued unless and until the public vehicles
commission shall certify that the public need for taxicab service
requires the additional service to be rendered by the applicant. In
deciding this question, the commission shall consider the need of the
public for taxicab service, the number of cabs in operation, and the
anticipated future demands.
If any licensee on whose behalf such a certificate has been issued
shall fail to operate all or any of the taxicabs covered by such certif-
icate for a period of fourteen consecutive days, the certificate may be
revoked or modified by the commission so as to cover and authorize only
the number of cabs actually operated.
18.4207 Inspections.) It is the duty of the owner of each public
passenger vehicle to submit to the Police Chief each vehicle for
inspection prior to the issuance of the license and at least once
every six months thereafter, or at any time upon complaint. Also
the Police Department may inspect these vehicles at such other times
as the Police Chief may deem necessary and it is unlawful for the
owner or person in charge of any such vehicle to use or permit its
use, in case it has been condemned by the Police Chief, until the
vehicle has been repaired or replaced to the satisfaction of the
Police Chief.
Section 3. That Chapter 18, Article XLVIII, Enforcement Provisions be

renumbered to Y:YilW , and that Article XLVIII, Food Delivery Vehicles be and
the same is hereby added to the Municipal Code of the Village of Elk Grove
Village.
18.4801 License Required.) It shall be unlawful to use or permit
the use of any vehicle, including wagons and motor vehicles and
vehicles propelled by manpower, for the storage or carrying of any
foodstuffs intended for human consumption, including beverages and
milk,(not to include intoxicating liquor) in the Village for the
purpose of delivering any such foodstuffs to any place in the Village
for such purposes, unless a license for such vehicle is first secured
and the provisions of this article are fully complied with.
18.4802 Application.) Application for a license under this article
shall be made in conformity with the general requirements of the Code
relating to application for licenses.
18_4803 Exemption.) No license fee shall be required for any vehicle
used to deliver foodstuffs from any establishment which is licensed and
inspected as a food dealing establishment in the Village; but all pro-
visions of this article, other than that providing for the fee shall be
complied with in connection with such vehicles.

18.4804 Regulations.)
a. All such vehicles shall be kept in a clean and sanitary
condition and shall be thoroughly cleaned each day they are so used.
b. It shall be unlawful to permit stale food, decaying matter,
or any waste material or product to accumulate in or on any such
vehicle while it is so used.
c. All vehicles shall have the name of the licensed firm written
or printed on the vehicle so that it is clearly visible from a distance
of 50 feet.
d. Food delivery vehicles shall be subject to all applicable pro-
visions of the regulations governing food dealers as described in this
Code.
18.4805 Inspections.) It shall be the responsibility of the Health
Officer and Chief of Police to make or cause to be made such inspections
to insure compliance with the provisions of this article and all other
ordinances relating thereto.
Section 4. That Chapter 18, Article 111, Section 18.301, be amended by
adding thereto the following:

Section 5. That Chapter 18, Article XL - Scavengers, Section 18.4003
be amended to read as follows:
18.4003 Application.) An application for a license under this article
shall be made on forms provided by the Village Clerk and shall be in
conformity with the general requirements of this Code relating to app-
lications for licenses.
One license shall be issued for Scavenger service for the entire
Village, including residential, commercial, and industrial zoned districts;
all other licenses issued shall be for Scavenger service in the industrial
and commercial zoned areas of the Village. The character of the license
shall be designated on the application and on the licensing document itself.
Said license shall create no vested interest in the licensee and may be
issued, or renewed, or revoked at the discretion of the President and
Board of Trustees at the end of any licensing period, with or without
cause.
3.
All applications shall be accompanied by a Surety Bond in the
amount of $1,000 guaranteeing adherence by the applicant to all
Village ordinances and regulations, said bond to be approved by the
Village Attorney.
Section 6. That this ordinance shall be in full force and effect from
and after its passage, approval and publication, according to law.
