HomeMy WebLinkAboutORDINANCE - 979 - 3/4/1975 - ANNEXATION/KUMMERLE PROPERTYORDINANCE NO. 979 AN ORDINANCE ANNEXING APPROXIMATELY 7.23 ACRES (KUMMERLE PROPERTY) PURSUANT TO A PRIOR ANNEXA- TION AGREEMENT AUTHORIZED BY RESOLUTION NO. 22-75 WHEREAS, a written petition requesting annexation has been filed with the Village of Elk Grove Village by the La Salle National Bank as Trustee under Trust dated January 26 ,1973 and known as Trust No. 45667, and WHEREAS, an Annexation Agreement dated March 4, 1975 by and between the Village of Elk Grove Village and said trust was entered into providing for the annexation of the hereinafter described property, in accordance with the terms of said agreement, and WHEREAS, said land and territory is not within the corporate limits of any municipality, but is contiguous to the Village of Elk Grove Village, and has no electors residing thereon, and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois have examined and executed said agreement and believe it to be in the best interests of the Village that said land and territory be annexed thereto. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That the land and territory legally described in the attached Exhibit A, which exhibit is incorporated herein by reference and made a part of this ordinance, which land is contiguous to the Village of Elk Grove Village and not within the limits of any municipality, be and the same is hereby annexed to the Village of Elk Grove Village, in accordance with the Annexation Agreement previously entered into between the La Salle National Bank as Trustee under Trust NO. 45667 and the Village of Elk Grove Village, so that hereinafter said territory shall be included within the boundary lines and limits of said Village. Section 2: That said property as annexed is, pursuant to the terms and provisions of the Elk Grove Village Zoning Ordinance NO. 842 and the Village of Elk Grove Village's Official Map adopted by Ordinance NO. 570 on October 22, 1968, hereby included in the I-1 Zoning District. Section 3 : That the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this Ordinance together with an accurate plat of said territory with the Recorder of Deeds of Cook County, Illinois. Section 4 : That this Ordinance shall be in full force and effect from and after its passage and approval according to law. PARCEL 2: EASEMENT FOR INGRESS AND EGRESS FOR THE BENEFIT OF PARCEL 1 OVER THE FOLLOWING DESCRIBED LAND: That East 28.25 feet of lot 58 and the west 31.75 feet of Lot 59 in Higgins Road Commercial Subdivision Unit 3, being a subdivision in the west z of section 22, township 41 north, rangell east of the third principal meridian by easement agreement dated November 27, 1973 and recorded April 30, 1974 made by Malden Corporation, an Illinois Corporation and La Salle Nati7nal Bank as trustee under Trust Agreement 45667 and Dominion Life Assurance Company, a canadian corporation as Document No. 22701327.
