SEWERORDINANCE NO. 920 AN ORDINANCE AUTHORIZING THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO TO CONSTRUCT AND MAINTAIN A 60 INCH SANITARY SEWER INTERCEPTOR ALONG OAKTON STREET FROM WILDWOOD ROAD EAST TO APPROX- IMATELY ELMHURST ROAD Section 1. That subject always to the conditions herein stated, the perpetual easement, right, and authority be and the same is hereby granted and given to the Metropolitan Sanitary District of Greater Chicago (hereinafter referred to as "Sanitary District"), to construct, reconstruct, repair, maintain, and operate an intercepting sewer, together with the appurtenances thereto, hereinafter designated as "Intercept..ing Sewer," (Upper Des Plaines Intercepting Sewer. No. 20C, Contract No. 69-307-2S) upon and under public lands, public rights-of-way, and public easements of the Village of Ell: Grove, (hereinafter referred to as "The Village") within the territorial limits of The Village, described as follows, to wit: That part of Oakton Street bounded on the west by the westerly right-of-way line of SWildwood Road and the easterly right-of-way line of the Northwest Tollway on the east, aforesaid right -of -dray line also being the easterly 'limit of the Village „f Elk Grove; excluding therefrom that portion of Oakton SLrect lying within the unincorpnraied area of Elk Grove Township. All. lying within the southeast 1/4 of Section 21, the northeast 1/4 of Section 28, the south 1/2 of Section 22, the north 1/2 of Section 27, the southwest 1/4 of Section 23 .and, the no.ri:hrr at 1/4 of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian in C00% County, Illinois, as shown on a plat m._irkcd EZhibit A attached hereto and made a part hereof. Section 7.. That the location, size, and mann_r of construc- tion of the Intercopting Sewyr shall be in accordance with plans and specifications prepared by the Sanitary District. Section 3. That the rights heraty granted to the Sanitary District, are so granted upon the following conditions: (a) That the Sanitary District shall, at, its own expense, make such changes in the location of the police and fire alarms, street lighting and electric wires of The Village as may be rendered necessary for the construc- tion of the Intercepting Sewer of the Sanitary District. (b) That the Sanitary District shall, at its cost and expense, install all such safety devices and traffic control signals as may become necessary and required by The Village for the public convenience; health and safety, as a result of any routing or rerouting of traffic caused by the construction contemplated in this ordinance. (c) That the Intercepting Sewer of the Sanitary District shall be constructed, reconstructed, repaired, and efficiently maintained an& operated solely by the Sanitary District at its sole expense and cost; The Village shall not be held responsible in any manner for the location or manner of construction, reconstruction, repair, or operation of the same. (d) That the Sanitary District shall indemnify, .save, and keep harmless The Village from any and all claims for damage to real and personal property and injuries to or death suffered by persons by .reason of the co-gtruction, reconstruction, repair, maintenance, or oprati_on by the Sanitary District of the Intercepting Sewer within the corporate limits of The Village. -2- (e) That the Sanitary District shall, at its sole cost and evgcnoe, icstore to their former condition of usefulness the pavements of all streets, public alleys and highways within the xight-of-way of thc� Intercepting Sewer, which may be distu.rbad or interfered with by the construction, ma.i.ntertaice, repair, or oporation of the intercepting sewer, as well as all walls, cross -walks, curbs, gutters, catch basins, and ditches as soon as practicable, and shall thereafter, maintain such restoration from time to time as may be necessary, but not to exceed two years. All surplus excavation akd other spoil shall. be .removed from the paved streets, public alleys, and highways by the Sanitary District. (f) That The Village does hereby order and direct, insofar as it has authority to so do, all persons, partnerships, or corporations which shall, at the time of the construc- tion of the intercepting Sewer, own, operate, or maintain any conduits, wires, poles, pipes, gas mains, cables, electric, steam and street railway tracks and equipment or other structures within any portion of the streets, public alleys and highways to be excavated in the con- struction of the,inte.rcepting Sewer, at his, its, or their own expense, to make such changes in the location of such conduits, wires, poles, pipes, gas mains and cable, elec- tric steam and street railway tracks, and equipment or other structures as may be randoKod necessary by the con- struction of the Intercepting Sewer. The Metropolitan Sanitary District of Greater Chicago hereby agrees to re- imburse the said Village for any expense it may incur or may be agreed upon to pay as a result of the relocation of any of tho aforesaid utilities or structures. (g) Z`nat the Sanitary District and its contractors are hereby given and granted the right to use in the construction of the Intercapting Sewer such motor 'trucks, excavators, hoist- ing engines, and other plant and equinrlent as may be neces- sary for the complete construction of said work.
