HomeMy WebLinkAboutORDINANCE - 933 - 6/25/1974 - ANNEX/NAVARONE RESTAURANTORDINANCE N0, %� > AN ORDINANCE ANNEXING FIVE (5) ACRES OF LAND (THE NAVARONE RESTAURANT) AND CERTAIN ROADS PURSUMU TO A PRIOR AGREEMENT AMUORIZED BY RESOLUTION 42-70 WHEREAS, a written petition requesting annexation has been filed with the Village of Elk Grove Village by the National Bank of Austin, Chicago, Illinois, Trustee, under Trust- No, 4743, dated March 6, 1.970; and WHEREAS, an annexation agreement dated April 23, 1970, by and between the Village of Elk Grove Village and said Trust was entered into providing for the annexation of the hereinafter des- cribed property, in accordance with the terms of said Agreements; RMo k WHEREAS, said land and territory is not within the corporate limits of the municipality, but is contiguous to the Village of Elk Grove Village, and has no electors residing thereon; and iviIEREAS, neLiee iias been given to the Elk Grove Rural Fire District Protection/ten (1.0) days in advance of taking action, in accordance with the Statutes made and provided, of the Village=s intent to annex said property; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois, have examined and executed said Agreement and believe it to be in the best interests of the Village that said land and territory be annexed thereto, NOW, TIIEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grovc Village, Counties of Cook and Du Page, as follows: Section 1: 74iat the land and territory shown and legally described in the attached Exhibit A, which Exhibit is incorporated herein by .reference and made a part of this Ordinance, which land is contiguous to the Village and not within the limits of any municipality, be and is hereby annexed to the Village of Elk Grove Village, in accordance with "The Agreement", so that hereafter said territory shall be included within the boundary lines and limits of said Villager Section 2: that the Village Clerk of the Village of Elk Grove Village is directed to record a certified copy of this ordinance, together with an accurate plat of said territory, with the Recorder of Deeds of Cook County, Illinois, Section 3: That this ordinance shall be in full force and effect from and after its passage and approval, according to law. Zettek Village President EXHIBIT "A" to ORDINANCE NO. 933 All that part lying Southwesterly of the Northeasterly line of Higgins Road and East of the East line of a 200 foot strip of land conveyed to County of Cook by Deed recorded January 12, 1939 as Document No.12259408 of the West half of the Northwest quarter of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian, lying North of a line drawn at right angles to the East line of said 200 foot strip of land through a point on said East line 602.31 feet South, as measured along said East line, of the North line of said Section 26 (excepting from said parcel that part thereof lying North of a line drawn from a point on the East line of said 200 foot strip of land which is 210.0 feet South as measured along said East line, of the North line of said Section 26 to a point on the center line of said Higgins Road, said line crossing the Westerly line of said Higgins Road at a point which is 185.0 feet, as measured along a line parallel with the. East line of said 200 foot strip of land South of said North line of Section 26, in Cook County, Illinois.
