AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF ELK GROVE VILLAGE (ORDINANCE
NO. 842) BY ADDING THERETO A NEW PARAGRAPH
RELATING TO MAXIMUM HEIGHT OF BUILDINGS AND
STRUCTURES IN A-2 RESIDENTUAL DISTRICT.
WHEREAS, the Plan Commission of the Village of Elk Grove Village,
acting as a zoning commission, at a public hearing duly called and
held according to law, considered the question of amending the
Zoning Ordinance of the Village of Elk Grove Village by permitting
an increase in the maximum height of buildings and structures in the
A-2 district provided that there is a correlating increase in the
front, side and rear yard requirements and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village, having considered the recommendation of the said
Zoning Commission, find and believe that such an amendment as stated
above is in the best interests of the Village;
NOW , THEREFORE, BE IT ORDAINED, by the President and Board of
Trustees of the Village of Elk Grove Village, Cook and DuPage
Counties, Illinois, as follows:
Section 1: That Section 5:33, REGULATIONS IN THE A-2 DISTRICT
OF THE ZONING ORDINANCE, of the Village of Elk Grove Village
(Ordinance No. 842) be and the same is hereby amended by adding
thereto the following paragraph:
(d) The maximum height of buildings and structures in the A-2
District shall be as provided in Section 5-1 provided that,
whEie at least fifty (501/10) percent of the off street
parking spaces required under the terms of this ordinance
are provided in an underground garage, then said maximum
height limitation may be exceeded by one foot for each
additional one and one-half feet by which each minimum
yard requirement of Section 5-1 are exceeded, provided
that the maximum height permitted shall not exceed sixty
(60) feet.
Section 2: Any person, firm or corporation who violates,
disobeys, omits, neglects or refuses to comply with, or resists
the enforcement of any of the provisions of this ordinance shall,
upon conviction thereof be fined not less than Five Dollars ($5.00)
nor more than $500.00 for each and every offense. A separate
offense shall be deemed committed on each day a violation occurs
or continues.
Section 3: That this ordinance shall be in full force and
effect from and after its passage, approval and publication, ac-
cording to law.
