HomeMy WebLinkAboutORDINANCE - 3001 - 7/20/2004 - ZONING VARIATION/570 RUTGERS LNORDINANCE NO. 3001 AN ORDINANCE GRANTING A VARIATION OF SECTION 3-7:D.1 AND SECTION 7-1 OF THE ZONING ORDINANCE TO PERMIT THE CONSTRUCTION OF A THIRD CAR GARAGE ADDITION THAT WOULD ENCROACH APPROXIMATELY4.0 FEET INTO THE REQUIRED 25 FOOT CORNER LOT SIDE YARD SETBACK ON PROPERTY LOCATED AT 570 RUTGERS LANE, ELK GROVE VILLAGE (SULLIVAN) WHEREAS, the Zoning Board of Appeals, at a public hearing duly called and held according to law, considered the question of granting a variation to permit the construction of a garage addition that would encroach into the side yard setback area on property located at 570 Rutgers Lane, Elk Grove Village; and WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove Village, after having reviewed the recommendation and finding of said Zoning Board of Appeals find and believe that sufficient hardship exists so as to justify the granting of said variation. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: That there be granted a variation of Section 3-7:D.1 and Section 7-1 of the Zoning Ordinance pertaining to the location of principal structures in required side yard areas to permit the construction of a garage addition that would encroach approximately 4.0 feet into the required 25 foot comer lot side yard setback on property located at 570 Rutgers Lane, Elk Grove Village and identified by the following property identification number. 07-25-315-001-0000 Section 2: That this variation is granted provided the petitioners adhere to all recommendations established by the Zoning Board of Appeals and specifically the recommendation pertaining to the construction of a wall in such location and size as required by the Zoning Board of Appeals. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE. AYES: 6 NAYS: 0 ABSENT. 0 PASSED this 20" day of July 2004.
