AN ORDINANCE GRANTING A VARIATION OF THE
VILLAGE OF ELK GROVE VILLAGE ZONING
ORDINANCE TO PERMIT THE CONSTRUCTION OF
AN ENCLOSED TUNiEL ON PROPERTY LOCATED AT
THE SOUTHWEST CORNER OF OAKTON ST & BUSSE RD
WHEREAS, the Zoning Board of Appeals, at a public meeting
duly called and held according to law, considered the question of
granting a variation of the zoning ordinance, thereby permitting
the construction of an enclosed tunnel on property legally described
hereinafter.; and
WHEREAS, no objections were raised at said hearing; and
WHEREAS, the President and Board of Trustees of the Village of
Elk Grove Village, after considering the recommendation of said
Zoning Board of Appeals, find and believe it to be in the best
interests of the Village that such a variation be granted;
NOW, THEREFORE, BE IT ORDAINED, by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illincs, as follows:
Section 1: That a variation of Section 3.54, Uses of Yards
for Structures in all Zoning Districts, of the Zoning Ordinance of
the Village of Elk Grove Village, which prohibits the construction
of accessory structures on side yard areas, be granted to the
Chicago title and Trust Co. as Trustee under Trust No. 61-287 so as
to permit the construction of an enclosed tunnel on property legally
described as follows:
The Northeast quarter of the northeast quarter of Section
27, Township 41 North, Range 11, East of the Third Princi-
pal Meridian
ALSO
That part of the North half of the Southeast quarter of the
Northeast quarter of Section 27, Township and Range afore-
said, lying North of the South 14 acres thereof, together
with that part of the Northwest Quarter of Section 26,
Township and Range aforesaid, lying North of the Easterly
extension of the North line of the South 14 acres of the
North half of the Southeast Quarter of tl-e Northeast
Quarter of Said Section 27 aforesaid and West of the East
line of State Route 83
ALSO
That part of the Southeast quarter of Section 22, Township
41 North, Range 11, lying East of the Northerly extension
of the Northeast Quarter of the Northeast Quarter of Section
27 aforesaid and lying South of the North line of Oakton
Street as dedicated per Document No. 9967968 and as widened
per Document No. 20866386 and lying South of a line 85.00
feet North of and parallel with the South line of the South-
east quarter of said Section 22 and East of the West line of
State Route 83
ALSO
The South 85.00 feet of the Southwest Quarter of Section 23,
Township 41 North, Range 11, East of the Third Principal
Meridian, lying West of the East line of State Route 83, in
Cook County, Illinois.
Section 2: That this ordinance shall be in full force and
effect from and after its passage, approval and publication, ac-
cording to law.
