IIORNER FOR .RETAIL FOOD STAND WHEREAS, the President and Board of Trustees ofthe Village of Elk Grove Village did conduct a public hearing for the purpose of determining whether_ or not a special use for a retail food stand with attendant parking should be granted to Sam J Horner, at the southwest corner of Devon and Elmhurst Roads, Elk Grove Village, for the purpose of furnishing food to persons observing air_ traffic in the vicinity; and WHEREAS, it was represented that the premises would be super - wised by adults and would be managed in an orderly and clean fashion; NOW, THEREFORE, BE IT ORDAINED by the President and Boa rd of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the Zoning Ordinance of the Village of Elk Grove Village, passed and approved July 8, 1957, and known as Ordinance No. 20, as amended, be amended further so as to permit a special use permit for a retail food stand, and for the sale and distribution of foods and non-alcoholic beverages and for attendant parking in con- junction therewith on property described as follows: a rectangle parcel of property having a frontage of 250 feet on Devon Avenue and 250 feet on Elmhurst Road, located at the southwest corner of the intersection of same. Said specizil use permit shall be conditional upon the owners providing continuous adult supervision during business hours, e,:cept between 2:00 P.M. and 5:00 P.M., between June 15th and September 15th, and between 5:00 P.M. and 6:00 P.M. during other times. In any event, said special use permit shall have no further force and effect one year from date of the passage of this ordinance. Section 2: That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Live ($5.00) Dollars, nor more than Two Hundred Dollars ($200.00) for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 3: That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED and APPROVED this day of 1972.
