HomeMy WebLinkAboutORDINANCE - 831 - 11/6/1972 - REZONE/BUSSE AND HOWARDOrdinance No. p 3 1 AN ORDINANCE REZONING THE PROPERTY AT THE NORTHWEST CORNER OF BUSSE ROAD AND IIOWARD STREET, FROM M-1 to B-1 FOR THE PURPOSE OF AN INDOOR RECREATIONAL FACILITY WHEREAS, the Plans Commission of the Village of Elk Grove Village, sitting as a Zoning Commission, at a public meeting duly called and held according to law, considered the question of re- classifying certain real estate which is described on Exhibit A, attached hereto and made a part hereof, from M 1 to B-1; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, having considered the recommendation of said Zoning Commission, find and believe that the highest and best use of said real estate is that of B-1; NOW,, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, as follows: Section 1: That an Ordinance, entitled, AN ORDINANCE TO REGULATE AND LIMIT THE HEIGHT AND BULK OF BUILDINGS, TO REGULATE AND LIMIT THE INTENSITY AND USE OF LOT AREAS, AND REGULATE AND DETERMINE AREAS OF OPEN SPACE WITHIN AND SURROUNDING SUCH BUILD- INGS; TO CLASSIFY, REGULATE AND RESTRICT THE LOCATION OF TRADES AND INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED INDUSTRIAL BUSINESS, RESIDENTIAL, AND OTHER USES; TO DIVIDE THE ENTIRE VILLAGE OF ELK GROVE VILLAGE INTO DISTRICTS FOR THE PURPOSE OF THIS ORDINANCE; TO FIX STANDARDS TO WHICI3 I3UILDINGS OR STRUCTURES SHALL CONFORM; TO PROHIBIT USES, BUILDINGS OR STRUCTURES INCOMPATIBLE WITH THE CHARACTER OF SUCH DISTRICTS, RESPECTIVELY; AND TO PREVE14T ADDITIONS TO, AND ALTERATIONS OR REMODELING OF EXISTING BUILDINGS OR STRUCTURES IN SUCH A WAY AS TO AVOID THE RESTRICTIONS AND LIMITATIONS LAWFULLY IMPOSED HEREUNDER, AND TO PROVIDE PENALTIES FOR VIOLATIONS HEREOF, passed and approved July 8, 1957, known as Ordinance No. 20, as Amended, be amended by reclassifying the following real estate described on Exhibit A, attached hereto and made a part hereof, from M-1. to D-1. Section 2: That said real estate, as reclassified, shall be subject to all limitations and conditions placed upon properties in the A-2 classification, as defined in the ordinance afore- mentioned. Section 3: That any arson, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of any provision of this Ordinance shall be fined not more than One Hundred ($100.00) Dollars for each offense, and each day a violation is permitted to exist shall constitute a separate offense.
