AN ORDINANCE ESTABLISHING FIRE PREVENTION CODE, AMENDING CHAPTER 6
OF THE MUNICIPAL CODE OF ELK GROVE VILLAGE
NOW, THEREFORE , BE IT ORDAINED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois:
Section One: That Article III of Chapter 6 of the Municipal Code of the
Village of Elk Grove Village is hereby repealed.
Section Two: That Chapter 6 of the Municipal Code of the Village of Elk
Grove Village is hereby amended by adding the following Article and by
incorporating the provisions, requirements and procedures established with-
in said Article:
Article III=Fire Prevention Code
6.301 ADOPTI
There is hereby adopted by the Village of Elk Grove Village for
the purpose of prescribing regulations governing conditions hazardous
to life and property from fire or explosion the 1970 Fire Prevention Code,
prepared by the American Insurance Association, save and except such
portions as are hereinafter deleted, modified or amended.
6.302 COPIES OF CODE:
Three (3) copies of the 1970 Fire Prevention Code, American
Insurance Association, are on file in the Office of the Village
Clerk.
JURISDICTION:
The jurisdiction of the Fire Prevention Code shall include
property and structures within the Village of Elk Grove Village.
6.304 CREATION OF THE FIRE PREVENTION BUREAU:
A Fire Prevention Bureau is hereby created in the Fire Depart-
ment of the Village of Elk Grove Village. Said Bureau shall be
under the direction of the Chief of the Fire Department subject
to the general direction of the Village Manager.
6.305 MEMBERS:
A, The Chief of the Fire Department shall select a person to
be, in addition to any other responsibilities he may have,
the Officer in Charge of the Fire Prevention Bureau who
shall serve in such capacity at the discretion of the Chief
of the Fire Department.
B. The Chief of the Fire Department may also select additional
persons as Inspectors to be assigned to the Fire Prevention

6.306 DUTIES:
Bureau under the supervision of the Officer in Charge of
the Bureau.
It shall be the duty of the Officer in Charge of the Fire Pre-
vention Bureau to:
A. Enforce all laws and ordinances of the State, County and
Village, covering the following:
1. The prevention of fires;
2. The storage and use of explosives and flammables;
3. The maintenance of automatic and other fire alarm
systems, and fire extinguishing equipment;
4. The maintenance, regulation and adequacy of means
of egress;
5. The investigation of the cause and origin of
fires.
6. The Officer in Charge of the Fire Prevention
Bureau shall perform such other duties as may
be required from time to time, including making
recommendations to improve this Code.
B. Provide technical staff assistance and support to the Building
Commissioner of the Village of Elk Grove Village in the follow-
ing areas:
I. Examination of plans for new construction, reconst-
ruction or alteration of structures and to advise
the Building Commissioner thereon of the extent of
non-compliance with established Village requirements
and codes relating to life, safety and fire prevention,
alerting and supression systems.

Inspection of construction in _:ogress to advise the
Building Commissioner thereon of non-compliance with
life, safety and fire prevention, alerting and supp-
ression systems previously approved for said construction.
3. Review of existing and new standards, codes and
requirements to advise the Building Commissioner
thereon of changes considered necessary for improved
life safety and fire prevention, alerting and supp-
ression systems.
C. A report of the Fire Prevention Bureau shall be made annually
to the Fire Chief and transmitted to the Village Manager of
the Village of Elk Grove Village. The report shall contain
all proceedings under this code, with such data as the Chief
of the Fire Department may require, including recommendations
to improve the Fire Prevention Code.
6.307 DEFINITIONS:
A. Whenever the word "Municipality" is used in the Fire Prevention
Code, it shall be held to mean the Village of Elk Grove Village.
B. Whenever the term "Corporation Counsel" is used in the Fire
Prevention Code, it shall mean the Village Attorney for the
Village of Elk Grove Village.
C. Whenever the term, Village Manager is used in this Fire Prevention
Code, it shall mean the Village Manager of Elk Grove Village.
D. Whenever the term, Fire Chief or Chief of the Fire Prevention
Bureau is used in this Fire Prevention Code, it shall mean the
Fire Chief of the Fire Department of the Village of Elk Grove Village.
E. Whenever the term Building Commissioner is used in this Fire Prevention
Code, it shall mean the Building Commissioner of the Village of
Elk Grove Village.

6.308 PROHIBITION OF STORAGE AND LOCATION OF CERTAIN MATTER:
A. Storage of flammable liquids in outside aboveground tanks
referred to in Section 16.22a of the 1970 American Insurance
Association Fire Prevention Code is hereby prohibited.
B. New bulk plants for flammable liquids referred to in Section
16.51 of the 1970 American Insurance Association Fire Prevention
Code are hereby prohibited.
C. Bulk storage of liquified petroleum gas referred to in Section 21.6 (a)
of the American Insurance Association Fire Prevention Code is hereby
prohibited, unless:
1. Said storage is in accordance with all requirements of the 1969
edition of Pamphlet 58 of the National Fire Protection Associa-
tion, and provided, however, that an additional 50% in pressure
relief venting capabilities is provided in addition to those
possible by said pamphlet for the tanks used for storing said
liquified petroleum gas.
2. A security fence six feet (6') in height with barbed wire above is
constructed and provided around all such tank installations, said
fence shall be so constructed as to screen from view the lower six
feet (6') of the tank installation.
3. The plans for said bulk storage and construction are approved by
the Fire Chief as being safe from fire hazards and in accordance
with the provisions hereof.
4. That no tanks be installed in the flood plain, except when
provided with devices capable of anchoring the tank to prevent
its going afloat under flood conditions.
5. That no transfilling operations be allowed except that which
is required from the mobile tank, truck or railroad car to the
stationary above ground storage tank.

6.309 MODIFICATIONS:
The Fire Prevention Bureau may modify any provision of the Fire
Prevention Code upon application in writing within thirty days from the date
of an order by the Bureau submitted by the owner of lessee, or his duly
authorized agent, when there are practical difficulties in carrying out the
strict letter of the Code, provided that the spirit of the Code shall be
observed and public safety secured. The particulars of such modification
when granted or allowed and the decision of the Fire Prevention Bureau
shall be entered upon the records of the department and a signed copy
shall be furnished the applicant and to the Village Manager.
6.310 APPEALS:
A. Whenever the Chief of the Fire Department shall disapprove an
application or refuse to grant a license or permit applied for,
or when it is claimed that the provisions of the code have been
misconstrued or wrongly interpreted, the applicant may, upon
payment to the Village Treasurer a sum equal to the estimated costs
for publication and court reporter services, appeal from the
decision of the Chief of the Fire Department to the President
and Board of Trustees within thirty (30) days from the date of
the decision on the modification application.
B. The said President and Board of Trustees shall designate a time
and place for a public hearing thereon and the applicant and Fire
Chief may present pertinent information. The decision of the
President and Trustees shall be final. A refund of money not
used for the foregoing shall be made to the applicant by the
Village Treasurer.

6.311 NEW MATERIALS OR PROCESSES WHICH MAY REQUIRE PERMITS:
The Chief• of the Fire Department, the Officer in Charge of the Fire
Prevention Bureau, and the Building Commissioner shall act as a committee
to determine and specify, after giving affected persons an opportunity to be
heard, any new materials, processes or occupancies, which may require
permits, in addition to those now enumerated in said code. The Chief of
the Fire Deparment shall post such list in conspicuous place in the Fire
Department Headquarters Station, Office of the Building Department, Office
of the Village Clerk, and make copies thereof aaailable to other interested
persons.
Section Three: Savings Clause. If any section, sub -section, or sentence,
clause, or phrase of this Ordinance is for any reason declared or held invalid
by a court of competent jurisdiction, such decision or decisions shall not
affect the validity of the remaining portions of this Ordinance.
Section Four: Ordinances Repealed. All other Ordinances, or parts
of Ordinances heretofore enacted by the Village of Elk Grove Village
in conflict with this Ordinance are hereby repealed.
Section Five: Penalty. Any person, firm or corporation violating
any provision of this Ordinance shall be fined not less than Five
Dollars ($5.00) nor more than Five Hundred Dollars ($500.00) for
each offense, and a separate offense shall be deemed committed
on each day, commencing from date of official notification,
during or on which a violation or failure to comply occurs or
continues.

Section Six: Effective Date. This Ordinance shall be in full
force and effect from and after its passage, approval, and
publication in pamphlet form as provided by law and ordinance
of the Village of Elk Grove Village.
