AN ORDINANCE AMENDING THE MUNICIPAL CODE
OF THE VILLAGE OI' ELK GROVE VILLAGE BY
ADDING THERETO A NEW CHAPTER, CHAPTER
24 D WHICH CHAPTER SHALL BE ENTITLED
"AN ORDINANCE DEFINING PARENTAL NEGLECT
OF MINORS AND IMPOSING A PENALTYTHEREFOR"
NOW, THEREFORE, BE IT ORDAINED by the President and Board
of Trustees of the Village of Elk Grove Village, Counties of
Cook and Du Page, State of Illinois, as follows:
Section 1: That there shall be added to the Municipal
Code of the Village of Elk Grove Village a new chapter to be
known as Chapter 24 D, which chapter shall read as follows:
An Ordinance Defining Parental Neglect of Minors
and Imposing a Penalty Therefor.
Section 24 D.101 Definitions.)
(a) Parental neglect. It shall be unlawful for a resident
of the Village of Elk Grove Village as a parent of a minor residing
with said parent to fail to exercise reasonable parental control which
results in the minor being convicted of the commission of criminal
acts, as herein defined, or allow the minor to become delinquent
in accordance with the Juvenile Court Act, as defined by the
statutes of the State of Illinois.
(b) Parent - The mother, father, legal guardian, or any
adult authorized and assuming the exercise of the care or custody
of a minor.

(c) Minor - Any male juvenile under the age of seventeen
(17) or any female juvenile under the age of eighteen (18).
(d) Criminal Acts - The intentional commission of an act
or acts which violate the statutes of the State of Illinois or
the ordinances of the Village of Elk Grove Village.
(e) Habitual Offender - One, who within a one (1) year
period, is convicted of the intentional commission of three or
more acts which violate the statutes of the State of Illinois or
the ordinances of the Village of Elk Grove Village.
Section 24 D.102 Notification and Responsibility)
(a) Whenever a minor shall be arrested or detained for the
commission of any criminal act within the Village of Elk Grove
Village, the Police Department of Elk Grove Village shall immediately
notify the parent of such minor and advise the parent of such
arrest or detention, the reason therefor, and their responsibility
under this ordinance.
(b) A record of such notification shall be kept by the
Elk Grove Village Police Department.
Section 24 D.103 Penalty.) Any person found guilty of
parental neglect, as defined herein, shall be subject to a fine
of not more than five hundred dollars ($500.00) or sentenced to
a penal institution other than the penitentiary for a term of
not more than ninety (90) days.
Section 24 D.104. All ordinances, and parts of ordinances
in conflict with this ordinance are hereby repealed.

Section 24 D.105.) If any section, sentence, clause
or phrase of this ordinance is held invalid, such decision shall
not affect the validity of the remaining sections, sentences,
clauses and phrases of this ordinance.
Section 2: This ordianance shall be in full force and
effect from and after its passage, approval and publication
according to law.
