HORNER FOR RETAIL FOOD STAND WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village did conduct a public hearing for the purpose of determining whether or not a special use for a retail food stand with attendant parking should be granted to Sam J. Horner, at the southwest corner of Devon and Elmhurst Roads, Elk Grove Village, for the purpose of furnishing food to persons observing air traffic in the vicinity; and WHEREAS, it was represented that the premises would be super- vised by adults and would be managed in an orderly and clean fashion; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, counties of Cook and DuPage, Illinois: Section I: That the Zoning Ordinance of the Village of Elk Grove Village, passed and approved July 8, 1957, and known as Ordinance a No. 20, as amended, be amended further so as -to permit a special use permit for a retail food stand, and for the sale and distribution of foods and non-alcoholic beverages and for attendant parking in con- junction therewith on property described as follows: a rectangle parcel of property having a frontage of 250 feet on Devon Avenue and 250 feet on Elmhurst Road, and located at the southwest corner of the intersection of same. Said special use permit shall be condition- al upon the owners providing continuous adult supervision during business hours, except between 2:00 P.M. and 5:00 P.M., between June 15th and September 15th, and between 5:00 P.M. and 6:00 P.M. during other times. In any event, said special use permit shall have no f urther force and effect one year from date of the passage of this ordinance. Section 2: That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five Dollars $(5.00) nor more than Two Hundred Dollars ($200.00) for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 3: This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED AND APPROVED this 14th day of September 1971.
