AN ORDINANCE AMENDING CHAPTER 22 OF THE MUNICIPAL
CODE OF THE VILLAGE OF ELK GROVE VILLAGE BY ADDING
THERETO A NEW ARTICLE, ARTICLE -CIX, LIVERIES
NOW, THEREFORE, BE IT ORDAINED, by the President and the
Board of Trustees of the Village of Elk Grove Village, counties
of Cook and DuPage, as follows:
Section 1: That Chapter 22 of the Municipal Code of the
Village of Elk Grove Village be and is hereby amended by adding
thereto a new article, Article -CIX, Liveries, which reads as
follows:
" Article ]CIX Liveries.
A. Business License
22..1901 License Required. It shall be.unlawful to engage in
the business of operating a livery in the municipality without first
having secured a license therefor. Applications for such licenses
shall be made in writing to the Clerk, and shall state thereon the
name of the applicant, the intended place of business, and the num-
ber of liveries to be operated. If the applicant is a corporation,
the names and addresses of the president and secretary thereof shall
be given.
22.1902 Definition. The term "livery" as used in this Article,
shall mean and include any vehicle used to carry passengers for hire,
providing no passenger shall be transported unless the passenger has
previously arranged for the transportation in advance by telephone or
written order.
22.1.903. Character of Applicant. No such license shall be
issued to or held by any person who is not a person of good character
or who has been convicted of a felony; nor shall such license be
issued to or held by any corporation if any officer thereof would
be ineligible for a license under the foregoing conditions.
22.1904. Fee. The annual fee, payable in advance, for such
licenses shall be twenty-five dollars plus fifteen dollars for each
livery operated. Whenever the number of liveries so operated shall
be increased during the license year, the licensee shall notify the
Clerk of such change and shall pay the additional fee.
Such fee shall be in lieu of any other vehicle fee required
by ordinance and the Clerk shall issue in numerical order suitable
tags or stickers for each luxury vehicle. Such tag or sticker shall
be attached to the front right windshield on each livery while it is
in use, and may be transferred to any livery put into service to
replace one withdrawn from service.
The licensee shall notify the Clerk of the motor number and
state license number of each livery operated and of the corresponding
municipal tag or sticker number.
22..1905 Vehicles_ No livery shall be operated unless it bears
a state license duly issued; and no such livery shall be operated
unless it is equipped with proper brakes, lights, tires, horn, muf-
fler, rear vision mirror, and windshield wiper in good condition.
It shall be the duty of the chief of police to inspect every livery
annually, or so often as may be necessary to see to the enforcement
of the provisions of this section.
All livery vehicles operated by one licensee shall have identical,
uniform exterior color or colors, providing any firm operating a livery
service at the time of adoption of this ordinance shall have two years

from the date of a•i;ption to comply with this requirement. No two licensees
shall have the same exterior color or colors for their livery vehicle or
vehicles.
22.1906. Drivers. No person shall drive a livery, or be hired or
permitted to do so, unless he is duly licensed by the Secretary of State
of Illinois to operate a vehicle transporting fare paying passengers.
It shall be unlawful for any driver of a livery, while on duty, to
drink any intoxicating liquor, or to use any profane or obscene language,
to shout or call to prospective passengers, to disturb the peace in any
way, or to transport a passenger in violation of the terms of this ordinance.
22.1907. Insurance
No livery shall be operated unless it is covered
by a bond or public liability policy, as required by statute, and in addi-
tion, an excess liability policy which provides company limits of $50,000/
100,000 for each person and occurrence, underlying limits of $50,000/100,000
for each person and occurrence, and total limits of $100,000/300,000 for
each person and occurrence and Property Liability Damage of $25,000 for each accident.
22.4908. Traffic Rules. It shall be the duty of every driver of
a livery to obey all traffic rules established by statute or ordinance.
22.1909. Unlawful Use. It shall be unlawful to knowingly permit
any livery to be used in the perpetration of a crime or misdemeanor.
22.1910. Passengers. It shall be the duty of the driver of any
livery to accept as passenger any person who seeks to so use the livery
provided such person is not intoxicated and conducts himself in an
orderly manner, and has previously contacted the livery operator in ac-
cordance with the terms of this ordinance. No person shall be admitted
to a livery occupied by a passenger without the consent of the passenger.
The driver shall take his passenger to his destination by the
most direct available route from the place where the passenger enters
the livery.

22.1911. Rates of Fare.

a. For fares originating within Elk Grove Village and
terminating at a location other than O'Hare Airport, or for fares
originating at a point other than O'Hare Airport and terminating
in Elk Grove Village, the fare will be fifty-five (554) cents per
mile.
b. For fares originating in that part of the Village lying
east of Route 53 and terminating at O'Hare Field, or vice versa,
the fare will be six dollars ($6.00) and for every subsequent
adult, one dollar ($1.00).
C. For fares originating in that part of the Village lying
West of Route 53 and terminating at O'Hare Field, or vice versa, the
fare will be seven dollars ($7:00), and for every subsequent adult,
one dollar ($1.00).
d. With respect to items a, b and c, all minors who are a
child of an adult passenger shall be transported at no extra cost.
e. With respect to items b and c, a passenger may, by prior
arrangement, obtain a discount by means of pre -purchasing a ticket
for a minimum of four (4) rides, which said rate to be established
between the licensee and the passenger.
A copy of the fare schedule set out herein shall be posted in a
place visible to passengers in all liveries licensed by the Village
of Elk Grove Village.
B. CHAUFFEUR'S LICENSE
22.1,912. License Required. No person shall drive a livery
unless he shall have secured a license therefor as herein provided.

22.1913. Fee. The annual fee for a livery driver's license
shall be one dollar.
22.1914. Qualifications. No such license shall be issued to
any person who is not competent to operate a motor vehicle or who is
not familiar with the traffic laws and ordinances. The chief of
police shall examine each applicant for a livery driver's license to
determine the competency of the applicant, and no such license shall
be issued excepting on certificate of the chief that the applicant
has demonstrated his ability to operate a motor vehicle as required
herein.
22..1915. Revocation. The Village President may revoke any
livery driver's license for .repeated violations of traffic laws or
ordinances, or of any ordinance provision regulating the conduct of
such driver.
Ca CERTIFICATE
22.1916. Certificate Required. No license to operate a livery
in the municipality shall be issued unless and until the Public
Vehicle Commission of the Village of Elk Grove Village shall certify
that the public need for livery service requires the additional
service to be rendered by the applicant. In deciding this question,
the Commission shall consider the need of the public for livery ser-
vice, the number of liveries in operation, and the anticipated future
demands.
22.1917. Existing Service. No such certificate shall be re-
quired for the renewal of any operator's license.
22.11918. Abandonment. If any licensee on whose behalf such
certificate has been issued shall fail to operate all or any of the
liveries covered by such certificate for a period of fourteen

consecutive days, the certificate may be revoked or modified by the
Commission so as to cover and authorize only the number of liveries
actually operated.
22.1919. Subject to the conditions and limitations of this
Article, exclusive permission and authority are hereby granted to
the licensees hereunder to operate the liveries licensed hereunder
upon the public streets and other public ways within the Village
limits unless terminated or revoked as herein provided.
It shall be unlawful and the Village will not permit any public
passenger vehicle not licensed hereto as a livery business within
the Village of Elk Grove Village to accept for transportation any
passenger within the Village except when such transportation has
been arranged for in advance by telephone or by written order.
22.1920. Nothing in this Article shall be_construed to prohibit
any public passenger vehicle from coming into the Village to discharge
passengers accepted for transportation outside the Village. While
said vehicle is in the Village, no roof light or other special light
shall be used to indicate that the vehicle is vacant or subject to
hire, and a white card bearing the words"Not for Hire" printed in
black letters not less than two inches in height shall be displayed
at the windshield of the vehicle. No person shall be solicited or
accepted in said vehicle for transportation from any place within the
Village.
22,1921. Any person, firm or corporation violating any
provision of this Article shall be fined not less than One Dollar
($1.00) nor more than One Hundred Dollars ($100) for each offense;
and a separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.
Section 2: Any ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 3: This ordinance shall be in full force and
effect from and after its passage, approval and publication,
according to law.
