AN ORDINANCE GRANTING A SPECIAL USE
TO K & K KOFFEE SERVICE COMPANY TO
ERECT A 70 FTo RADIO TOWER AND ANTENNA
AT 1270 JARVIS AVENUE
WHEREAS, S.P.J. BUILDERS, INC., of Franklin Park, Illinois,
are the legal owners of certain property in the Village of Elk Grove
Village, at 1270 Jarvis Avenue, legally described as follows:
Lot ##75 in Higgins Industrial Park Unit #48,
being a subdivision in south east quarter of
section #27,'township #41 north, range #11,
east of the Third Principal Meridian, in
Cook County, Illinois;
and
WHEREAS, K & K KOFFEE SERVICE COMPANY is the lessee of said
property and desires to erect a 70 ft. radio tower and antenna on
the roof of said premises; and
WHEREAS, public hearings were held and certain requirements
were requested as conditions for the issuance of this special use; and
WHEREAS, all said permissions by various persons and governmental
agencies have been submitted and approved;
NOW, THEREFORE, BE IT ORDAINED, by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois, as follows:
Section 1: That a. special.use.permit is granted to the K & ..
K Coffee Service Company and S.P.J. Builders, Inc. of Franklin Park,
Ill. for the erection of a 70 ft. tower on the roof of the premises
described in this ordinance, subject to the following conditions and
limitations:
A. That K & K Koffee Service Co. and S.P.J. Builders, Inc.,
as owners, or their assigns, guarantee removal of said tower
and restoration of premises to their original condition at such
time as K & K Koffee Service Company shall terminate its lease and/or
use of the premises and the operation of said tower.
B. That this special use permit shall be automatically
terminated five years from its issuance, unless otherwise renewed
by action of this Board of Trustees.
Section 3: That this ordinance shall be in full force and
effect from and after its passage, approval and publication, according
to law.
PASSED AND APPROVED this 26th day of October 1971.
