HomeMy WebLinkAboutORDINANCE - 796 - 4/11/1972 - SOLICITORS AND SOLICITINGORDINANCE NO, AN ORDINANCE MENDING SECTION 22.10(a) 05- VILLAGE POLICY ON SOLICITING; 2210(a) 07- DUTY OF SOLICITOR, and 22.10(a) 08 - Un- LIMITED SOLICITING PROHIBITED, OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE NOWO THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, as follows: Section 1: That Section 22.10A-05 of the Municipal Code of the Village of Elk Grove Village, relating to the Village policy on soliciting, be amended to read as follows: "Every person or firm desiring to secure the protection intended to be provided by the regulations pertaining to soliciting contained in this ordinance, shall com- ply with the following directions, to wit: Notice of the determination by the occupant or owner to refuse invitation to solicitors to any residence shall be exhibited upon or near the main entrance door to the residence containing applicable wording, such as "NO SOLICITORS INVITED," Such notice shall be of a weatherproof construction with letters at least one-third inch in height on sharply contracted background and provided at the occupant's or owner's expense. Such notice so exhibited shall constitute sufficient warning to any solicitor that further invasion of the property will constitute a trespass in accordance with Section 22.1002 of this Article X." Section 2: That Section 22.10(a) 07 of the Municipal Code of the Village of Elk Grove Village, relating to the Duty of Solicitors be amended to read as follows: 1122..10(a) o7 - Duty of Solicitors It shall be the duty of every solicitor, upon going onto any premises in the municipality upon which a residence as herein defined is located, to first examine if Notice provided for in Section 5 of this Ordinance is attached, and to be governed by the statement contained on such notice. If the notice states "NO SOLICITORS INVITIED," or words to that effect, then the solicitor, whether registered or not, shall immediately and peacefully depart from the premises. Any solicitor who has gained entrance to any residence, whether invited or not, shall immediately and peace- fully depart from the premises when requested to do so by the occupant." Section 3: That Section 2210(a) 08 of the Municipal Code of the Village of Elk Grove Village, relating to prohibition of unlimited soliciting, be amended to read as follows: "22.10 (a) 08 - Unlimited Soliciting Prohibited: It is hereby declared to be unlawful and shall constitute a nuisance for any person to go upon any premises and ring the doorbell upon or near any door, or create any sound in any other manner cal- culated to attract the attention of the occupant of such residence, for the purpose of securing an audience with the occupant thereof and engage in soliciting as herein defined, in defiance of the notice exhibited at the residence in accordance with the provisions of Section 5 of this Ordinance." Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
