AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR
A PLANNED DEVELOPMENT ON PROPERTY WEST OF
ARLINGTON HEIGHTS ROADS NORTH OF BIESTERFIELD
ROAD, SOUTH OF COSMAN ROAD AND EAST OF BISNER
ROAD IN ELK GROVE VILLAGE (AMENDING LAND USE
& ZONING PLAT - PARCEL D)
WHEREAS, the Planning Commission of the Village of Elk Grove
Village, sitting as a Zoning Commission, duly called and held
according to law, considered the question of amending a special
use permit heretofore granted so as to permit a planned develop-
ment on property, the legal description of which is set forth on
Exhibit A attached, so as to permit the development of the property
as set forth in said Exhibit A attached; and
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village have found that:
1. Said real estate is under single ownersh:.p and control
and consists of in excess of 100 acres.
2. That the owners have submitted an amended preliminary
use and zoning plat, Exhibit A, in preliminary form,
and conforming with the purpose of the planned
development.
3. That the owners have submitted legal assurances to
assure common.open space.
4. That the planned development is in conformity with
the Village plan.
5. That the planned development, as amended, is permitted
in the zoning district in which the land has heretofore
been zoned.
6. All provisions of the law have been satisfied.
NOW, THEREFORE, be it ordained by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois:
Section 1: That the Zoning Ordinances of the Village of
Elk Grove Village be further amended so as to permit the use of
the property legally described in Exhibit A, attached, in accordance
with the plan set forth in said amended preliminary land use and
zoning plat (Exhibit A, attached), which Exhibit A and all language
thereon is incorporated by reference, and in accordance with the
provisions of the Zoning Ordinances of Elk Grove Village, including
but not limited to the R-4 District regulations thereof.
Section 2: That the Village Clerk is directed to publish
this ordinance and its Exhibits in pamphlet form and to record
same with the Recorder of Deeds of Cook County, Illinois, as pro-
vided by the Elk Grove Village Zoning Ordinances.
Section 3: That the Village President and Clerk are
authorized and directed to approve Exhibit A, preliminary zoning
and land use plat, on behalf of the Village.
Section 4: That any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with or
resists the enforcement of any provision of this ordinance, the
Elk Grove Village Zoning, Ordinance to which it refers or any
other restrictions which it adopts or incorporates shall be fined
not more than One Hundred ($100.00) Dollars for each offense and
each day that a violation is permitted to exist shall constitute
a separate offense.

Section 5: This ordinance --hall be in full force and
effect from and after its passage, approval, publication and re-
cording as provided by law and ordinances of the Village.
