HomeMy WebLinkAboutORDINANCE - 717 - 10/27/1970 - ANNEXATION/WILDWOOD OAKTONORDINANCE NO. 717 AN ORDINANCE ANNEXING WILD OAKS S PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE, ILLINOIS WHEREAS, a written petition has been filed with the Village Clerk of the Village of Elk Grove Village by the AMERICAN NATIONAL BANK and TRUST COMPANY OF CIIICAGO, as Trustee under Trust No, 28833, the sole owner of record of the following described real estate, by J. Michael Wehlan, Trust Officer; and WHEREAS, said land and territory is not within the corporate limits of any municipality but is contiguous to the Village of Elk Grove Village, there being no electors residing on said real estate; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, on thel,tnday of P:ay 19 70 did authorize the President and Village Clerk to execute a pre- annexation agreement, which agreement did in fact provide for the annexation of the hereinafter described property to the Village of Elk Grove Village; and WHEREAS, said petition is under oath and in all. respects comply with the requirements of the Statutes in such cases made and provided.; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, have examined said petitions and believe it to be to the best interest of said Village that said land and territory be annexed thereto: WHEREAS, it has been determined that by Court Order the fire protection for the subject property has been and is being provided by the Village of Elk Grove Village rather than a fire protection district having heretofore been afforded from a rural fire protection district. NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That all land and territory described in said petition, to -wit: PARCEL 1: The East 230 feet as measured on the South line thereof of the South 950 feet of that part of the South East quarter of Section 21, Township 41 North, Range 11, East of the Third Principal Meridian, excepting therefrom, that part, if any, falling in Elk Grove Village Section 1 North Subdivision recorded as document 16806228 and filed as document LR 1.718827, contained in a tract of land described as follows: /1/ Beginning at a post at the South East Corner of said Section 21, running thence West 22 chains 40 links to a point; thence north 10 degrees cast along land owned by Whiting and others 32 chains and 42 links to a post in the center of road; thence South 81 3/4 degrees East 17.40 chains to a post in the East line of said Section 21; thence South on said East line 29.09 chains to the point of beginning, in Cook County, Illinois. PARCEL 2: The West 230 feet ( as measured on the South Line thereof) of. the South 950 feet of the following described tract of land: That part of the West half of the South West quarter of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, beginning at a post at the South West corner of the said West half thence East 9.76 chains to a post, thence North 27.85 chains to a post in the cen- ter of road, thence North 81 degrees West 9.81 chains to a post at the corner of the land owned by H. Sharinghausen on the West line of said West half thence South 29.31 chains to the place of beginning, in Cook County, Illinois. (containing approximately 10 acres more or less.) which territory is contiguous to the Village of Elk Grove Village, is not within the limits of any municipality, contains no electors and is not presently in any incorporated municipality, be and the same is hereby annexed to the Village of Elk Grove Village, so that hereafter said territory shall be included within the boundary lines and limits of said Village, as is by law in such case made and provided. Section 2: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this ordinance together with an accurate plat of said territory with the Recorder of Deeds of Cook County, Illinois. Section 3: That this ordinance shall be in full force and effect from and after its passage and approval according to law. VOTE AYES 6 NAYS 0 ABSENT ATTEST: PASSED this 27th day of October 1970.
