HomeMy WebLinkAboutORDINANCE - 557 - 9/3/1968 - ZONING ORDINANCE AMENDEDORDINANCE NO. 557 AN ORDINANC.-L AMENDING THE ZONING ORDINANCE AND THE 1,1J VICIPI.L CODE OF ELK GROVE VILLAGE AS TO Fv, MES NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1. That paragraph (f) , Section 1, Article XV of the Zoning Crdinance of the Village of Elk Grove Village, be amended to read as follows: (f) Fences and Shrubs. 1. Definitions. a. A fence is a structure forming a barrier at grade level between lots, between a lot and a street or any alley, or between portions of a lot or lots. b. A swimming pool is any receptacle for water hold- ing in excess of two hundred (200) gallons and having a depth at any point of more than three (3) feet, intended for the purpose of immersion or partial immersion therein of human beings, and in- cluding all appurtenant equipment constructed, in- stalled and maintained in or above the ground. c. Ground level or grade level is the natural grade of the lot in question. 2. No fences shall be erected in excess of six (6) feet above ground level along the boundary line of a lot or within required open space areas and no fence shall be constructed in any front yard or ahead of the building set -back line of any yard which faces a street. 3. Fences (constructed so as to prevent unauthorized ingress) shall be required around swimming pools and be equipped with self-closing and latching gates in accordance with the following: -1- Required height of fences - 6 feet Distance between fence and pool - Not less than 3 feet Latches shall not be placed lower than six (6) inches from the top of the gate. 4. No shrubbery, hedging or planting which interferes with clear vision shall be permitted at or near a street intersection in an area enclosed by a triangle each leg of which is a distance of twenty-five (25) feet measured along each curb of the intersecting streets and from the point where said curb lines or extensions thereto intersect nor shall shrubbery, hedging or planting be planted or maintained as to obstruct the clear vision of private driveways or pedestrian walks or sidewalks. 5. Prohibited fences: Barbed wire and electrically charged wire except that barbed wire may be used on the top of permitted fences in the manufacturing districts. 6. All fences heretofore lawfully constructed and not in conformity herewith, shall be deemed noncon- forming uses and may exist but may not be re- constructed or altered. All fences heretofore con- structed and in conformity herewith, shall be deem- ed legal fences. All fences illegally constructed heretofore and not in conformity herewith, shall be removed and shall be in violation of this ordinance. Section 2. That Chapter 13 of the Municipal Code of Elk Grove Village be amended by adding thereto Section 12.113-A which Section shall be entitled "Fences and Shrubs" and shall contain all regulations herein- above set forth in Section 1 above of this ordinance. Section 3. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of the foregoing provisions shall be fined not less than Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate and dis- tinct offense. - 2 - Soctioii 4.
