HomeMy WebLinkAboutORDINANCE - 561 - 9/17/1968 - SPECIAL USE/DEVON YORKORDINANCE NO. 561 AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE BY AUTHORIZING A SPECIAL USE PERMIT WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, did conduct a public hearing for the purpose of determining whether or not a special use for a retail food stand with attendant parking should be granted to Sam J. Horner, at the southwest corner of Devon Avenue and York Road, Elk Grove Village, for the purpose of furnishing food to persons observing air traffic in the vicinity, and WHEREAS. it was represented that the premises would be supervised by adults and would be managed in an orderly and clean fashion: NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the Zoning Ordinance of the Village of Elk Grove Vi1Tage, ppassed and approved July 8, 1957, known as a special use permit for a retail food stand, and for an addition to be constructed according to plan submitted Building Department in accordance with Village Code, for the sale and distribution of foods and non-alcoholic beverages and for attendant parking in conjunction therewith on property described as follows: a rectangular parcel of property having a frontage of 250 feet on Devon Avenue and 250 feet on York Road and located at the south- west corner of the intersection of same. Said special use permit shall be conditional upon the owners providing continuous adult supervision during business hours, except between 2:00 P.M. and 5:00 P.M., between June 15th and September 15th and between 5:00 P.M. and 6:00 P.M. during other times. In any event said special use permit shall have no further force and effect one year from the date of the passage of this ordinance. Section 2: That any person, firm or corporation who violates, dis—o-Seys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100.00) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 3: This ordinance shall be in full force and effect from and a tomer ts'passage, approval and publication according to law.
