HomeMy WebLinkAboutORDINANCE - 575 - 11/12/1968 - SPECIAL USE/AERONAUTICAL RADIO INCORDINANCE NO, AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE BY AUTEORIZING A SPECIAL USE PER!= FOR Eh1PLOYEE AND CUSTOMER PARKING WHEREAS, HAROLD W. KLINGER, Trustee under Trust Agreement dated April 16, 1968 and known as Trust No. 103, is the owner of the premises legally described as follows: The West 49.1 feet of Lot 92 and Lot 93 (except the West 49.1 feet thereof) in Higgins Road Commercial Subdivision Unit 3 more fully described above. hereinafter referred to as Parcel 1, and WHEREAS, Aeronautical Radio, Inc., a Delaware corporation, is the owner of -property legally described as follows: Lot 55, Lot 56 and the West 1.75 feet of Lot 57 in Higgins Road Commercial Subdivision Unit No. 3 being a Subdivision in the West 1/2 0£ Section 22, Township 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois hereinafter referred to as Parcel 2, and WHEREAS, the owner of Parcel 2. has an option to purchase Parcel l,and, WHEREAS, the owner of Parcel 2 is desirious of further improving said parcel with buildings and expects there to be a need for additional parking which can best be satisfied by its acquisition of Parcel. 1, and WHEREAS, the asident and Board of TrustEeS did conduct a public hearing to determine the best interests of the Village of Elk Grove Village in this regard. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the Zoning ordinance of the Village of Elk Grove Village as amended to date hereof, be further amended to permit Parcel 1 to be used for employee and customer parking for the premises located on Parcel 2. The contivance of special use authorization to be subject to compliance with each and all of the following conditions by tha owner and user: A. That the right and authorization to use Parcel 1 for parking as above described terminate in the event it is not used for customer and employee parking in conjunction with the use of Parcel 2. B. That the parking area on Parcel 1 be paved with asphalt or concrete within /0 months of date hereof or that such privilege terminate upon failure to so do. C. That the sale of Parcel 1 to a person other than the owner of Parcel 2 shall terminate the right to use said parcel for parking. Section 2: That all public officials are authorized and directed to issue such necessary permits to execute the purpose of this ordinance. - 2 Section 3: That any person, firm or corporation, who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two hundred ($200.00) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4: This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
