AN ORDINANCE REGULATING BUILDINGS AND STRUCTURES WITHIN THE FLOOD PLAIN WHEREAS, there are area; of the Village subject to periodic flooding with resulting hazard to persons and property from run-off storn and flood waters; and WHEREAS, it is deemed necessary to avoid or lessen the damage thereby resulting by prescribing reasonable rules and regulations for said purpose. NOW, THEREFORE, BE IT ORDAINED by the Village of Elk Grove Village, Counties of Cook and'DuPage, Illinois: Section 1: That every tract of land within the corporate limits of Elk Grove Village shall be subject to the flood plain regulations set forth herein. Section 2: Definitions. "Flood Plain Areas" are those ares delineated upon maps entitled Floods in the Palatine, Arlington Heights, Lombard, and Elmhurst Quadrangles prepared by the Department of the Interior, United States Geological Survey in cooperation with the Northeastern Illinois Planning Commission as having been covered with water from a stream or water course at the time of the highest flood of record shown thereon. -1" "Flood Base Elevation" is the elevation of the highest flood of record, as indicated on the Hydrologic Investigation Atlas as prepared by the United States Geological Survey in cooperation with the Northeastern Illinois Area Planning Commission. Flood base elevations at intermediate locations shall be interpolated along the water course between the two nearest flood base elevations, one each upstream and downstream. The controlling flood base elevation for any building site shall be the same as the flood base elevation at the nearest point of the water course as measured on a line perpendicular to the direction of the water course. Section 3: Minimum Building Elevation Above Recorded Flood Level. No new building or structure shall be erected upon or existing building or structure moved within an area which has been designated as a flood plain area unless the elevation of the top of the foundation of said structure is not less than two and one-half feet (2�') above the highest recorded flood level as shown on the aforementioned map. Basements, cellars, or crawl spaces shall be of structurally adequate poured in place concrete with no openings below the highest recorded flood level plus six inches, all in accordance with the existing building code of Elk Grove Village. -2- S Section 4: Drainage Easements. Where the drainage plan for a site within an area designated as a flood plain area requires rear or side lot drainage easements, such easements shall be centered on lot lines and shall be a minimum of ten feet (10') in width and, with the exception of utility facilities, no structures shall be placed in these drainage easements. The elevation of the ground for a minimum distance of five feet (51) immediately surrounding any building or structure erected or moved within a flood plain shall be at an elevation which is not less than one foot (1') above the Flood Base Elevation for the site and shall be sloped to drain away from the walls for a distance of at least five feet (5'). Section 5: Elevation of Streets Above Recorded Flood Level. The elevation of the finished surface at the center line of any new or resurfaced street, access drives and driveways, lying within an area designated as a flood \: plain area, shall not be less than one foot (1') above the highest recorded flood level as shown on the aforementioned maps. Section 6. Existing Streams and Channels; Easements. Existing streams and floodwater run-off channels are to be retained either in their present location or in -3- locations approved by the Village Engineer. Floodway easements of at least twenty feet (20') wide shall be provided and shown on the plat of subdivision or survey at time of application for building permit. The easement shall permit necessary public channel maintenance and improvement work and access of equipment therefor but shall prohibit buildings, fences and other obstructing structures thereon by the owner. Section 7: Sanitary Sewer Construction. All sanitary sewer manholes constructed within an area designated as a flood plain area must have rim elevations two and one-half feet (21-2') above the highest recorded flood level as shown on the aforementioned maps or they must be provided with water -tight covers. Ground water or surface water connections are prohibited from being connected into the sanitary sewer system. i Section 8: When the building wall encloses open space that is below the flood plain elevation, low level gravity building drain connections are prohibited and overhead sewers are required. Section 9: No building permit shall be issued by the Village of Elk Grove Village except when the buildings or structures comply with provisions hereof. Section 10: The foregoing regulations may be superceded by ordinances of amendment provided, however, that the President and Board of Trustees shall not consider same unless: �� 1, The applicant submits a plan for an alternative solution which will remove all buildings from the threat of damage from floods shown on the maps referred to herein and also which will not restrict the run-off of the flood. 2. Submits performance bonds and monetary escrows sufficient in amount and nature so as to guarantee the instrumentation of said plan. The village Manager, upon the advise of the Village Engineer and Attorney, shall determine the amount and form of same. Section 11: Any person, firm or corporation constructing a building in violation of provisions hereof shall be fined not less than $25.00 nor more than $500.00 and each day that said structure or building is continued in violation shall be deemed a separate and distinct offense. Section 12: That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
