HomeMy WebLinkAboutORDINANCE - 517 - 3/12/1968 - THIRD LIFT TO STREETSORDINANCE NO. 517 AN ORDINANCE PROVIDING FOR A TUIRD LIFT TO STREETS DEVELOPED IN INDUSTRIAL AND BUSINESS AREAS WHEREAS, it has been customary for developers within and in the immediate vicinity of the Village of Elk Grove Village to fully improve streets previous to construction of factories, plants and other buildings along those streets so that the industrial and business development could receive initially the best appearance, and WIJEREAS, considerable damage has been done to said streets during the course of building construction requiring the Village to spend considerable monies after the completion of development along industrial and business streets, and WTIEREAS, it is deemed necessary and desirable that a third lift or additional gavcment be added after 75 percent of the development of the street with buildings; NOW, THEREFORE, BE TT ORDAINED by the President and the Board of Trustees of the Village if Elk (:rove Village, Counties of Cook and DuPage, Illinois: Section 1. That there be added to the provisions for street pavement standards, Section 8.00; gage 55d of the Municipal Code of the Village of Elk Grove Village, the followinc: "3. Third lift requirements for flexible street pavement, concrete streets excepted from this requirement: A. All flexible streets to be installed subsequent to April 1, 1968 in areas either zoned M-1 or M-2 Industrial or B-1 or 3-2 Business or adjacent thereto shall make provision for a third lift or addi- tion of pavement to be added to said streets at such time as 75 percent of the frontage bordering said streets have been improved with buildings, or 5 years from date of street construc- tion, whichever event shall first occur. The third lift shall not be added until base failures, if any, in the street are corrected. B. io insure said additional future pavement and base failure correction, the developer and owner of the land benefited by the improvement shall deposit with the Village Treasurer at the time that the street improvement is installed the cost of a third lift in monies or such securities as the Village deems acceptable, the amoun;. to be estimated by the Village Engineer plus 10 percent of the cost of the base to guarantee the necessary base restora- tion prior to installing third lift. Said money shall then be utilizeci Uv the Village within the time period specified for the purpose specified. The Village shall have the right to invest said deposits in U. S. Government bonds or such other legal investment as they may determine proper. All interest earned shall be added to the principal deposited and may be used for any purpose for which the principal amount could have lawfully been used. Any monies not used shall be returned to the developer or his assigns at such time as the third lift is installed. C Prior to installation of the third lift, all areas of existing pavement including base course that in the opinion of the Village Engineer shall require repair, shall be repaired with the construction methods and material requirements of Section 85A of the Standard Specifications for Road and Bridge Construction adopted by the Division of Highways, Department of Public Works and Buildings, State of Illinois, and Supplementa- tion thereto effective January 3, 1966. DI Following the repair of the existing pavement, a third lift shall be added to the existing pave- ment which shall include priming and resurfacing with a bituminous concrete surface course, Sub - Class I-11. All materials, equipment and construction methods shall be in accordance with Section 46 of the Standard Specifications for Road and Bridge Construction adopted by the Division of Highways, Department of Public Works and Buildings, State of Illinois and Supplemental Specifications thereto effective January 3, 1966. I The surface course shall have a compacted thickness of one -inch except in a three-foot wide strip along each side of the pavement in which the thick- ness shall be gradually decreased to 1/4 inch at the edge of the pavement." Section 2J This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED this day of pa iJ , 1968.
