HomeMy WebLinkAboutORDINANCE - 535 - 5/14/1968 - SPECIAL USE/PLANNED UNIT DEV.ORDINANCE NO. 535 _,,, AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR A PLANNED DEVELOPMENT ON 287 ACRES LOCATED WEST OF ARLINGTON HEIGHTS ROAD, NORTH OF BIESTERFIELD ROAD, SOUTH OF COSMPN ROAD AND EAST OF BI&MR...; ROAD IN ELK GROVE VILLAGE. WHEREAS, The Plan Commission of the Village of Elk Grove Village, sitting as a Zoning Commission duly called and held according to law (Appeal No. 67-10), considered the r.uestion of granting a Special Use Permit to permit a planned development of property, the legal description of which is set forth on Exhibit A attached in accordance with the plan of development as set forth in said Exhibit A attached, and WHEREAS, The President and Board of Trustees of the Village of Elk Grove Village have found that: 1. The aforementioned real estate is under single ownership and control and consists of approximately 287 acres. 2. That the owners have submitted a preliminary land use and zoning plat (Exhibit A) in preliminary form and in con- formity with the stated purpose of the planned development. 3. That the owners have submitted legal assurances sufficient to insure the preservation of the common open space and maintenance and improvement of same. 4. That the planned development is in conformity with the existing and proposed Village plan. 5. That the planned development is permitted in the R-4 zoning district to which the land has heretofore been zoned by Ordinance No. 534 6. That all provisions of law have been satisfied. NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois: Section 1s That the Zoning Ordinance of the Village of Elk Grove Village as amender to date hereof be further amenred so as to permit the use of property legally described in Exhibit A attached in accordance with the plan set forth in said pre- liminary land use and zoning plat (Exhibit A attache0) which Exhibit A and all language thereon is hereby incorporated by reference and in accordance with the provisions of the Zoning Ordinance of Elk Grove Village including but not limited to the R-4 district regulations thereof. l Section 2: That the Village Clerk is directed to publish this ordinance and its Exhibits in pamphlet form and to record same with the Recorder of Deeds of Cook County, Illinois as provided by the Elk Grove Village Zoning Ordinance. Section 3: That the Village President and Clerk are authorized and directed to approve Exhibit A, preliminary zoning and land use plat, on behalf of the Village. Section 4: That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or resists the enforcement of any provision of this ordinance, the Elk Grove Village Zoning Ordinance to which it refers or any other restrictions which it adopts or incorporates shall be fined not more than One Hundred ($100.00) Dollars for each offense and each day that a violation is permitted to exist shall constitute a separate offense. Section 5: This ordinance shall be in full force and effect from and after its passage, approval, publication anc, re- cording as provided by law and ordinance of the Village.
