';63 AN ORDINANCE ANNEXING PROPERTY TO THE VILLAGE OF ELK GROVE VILLAGE LOCATED ON HIGGINS ROAD NORTHWESTERLY OF ELMHURST ROAD ON THE NORTH SIDE OF THE STREET. WHEREAS: Written petitions have been filed with the Village of Elk Grove Village by DEMETRY G.ALUK AND ANNA GALUK, his wife, being the sole owners of record of land and territory described as Parcel 2 on Exhibit A attached, for annexation to the Village, and WHEREAS, written petitions have been filed with the Village of Elk Grove Village by COSMOPOLITAN NATIONAL BANK of CHICAGO not individually but solely as Trustee under a certain Trust Agreement dated May 28, 1963 and known as Trust #13153, sole owners of record of land and territory described as Parcel 3 on Exhibit A attached, for annexation to the Village, and WHEREAS, said Parcels 2 and 3 are without the corporate limits of any municipality and contiguous to the Village of Elk Grove Village, and WHEREAS, Parcel 2 has two electors, namely DEMETRY GALUK and ANNA GALUK, his wife, who are also the sole owners thereof and have joined as electors in petitioning for the annexation, and WHEREAS, Parcel 3 has no electors residing thereon, and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage did, on the 28th day of March 1967 pass and approve Resolution No. 12-67 , which resolution did authorize the President and Village Clerk to execute a pre -annexation agreement providing for the annexation of Parcels 2 and 3 to the Village of Elk Grove Village, and WHEREAS, the Presdient and Board of Trustees of the Village of Elk Grove Village have found that said petitions are under oath and in all respects comply with the requirements of the State Statutes and it is to the best interests of the Village that said land and territory described as Parcels 2 and 3 on Exhibit A be annexed thereto; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and Du Page, Illinois: Section 1: That all land and territory described in a petition for annexation and as Parcel 2 on Exhibit A attached, which territory is contiguous to the Village of Elk Grove Village, is not within the limits of any municipality, contains two electors who have joined in said petition, and is not presently in any corporate municipality, be and the EXHIBIT A - PARCELS 2 and 3 Parcel 2: That part of the East Half of the Southeast Quarter of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian described as follows: Begin- ning at a point on the center line of Higgins Road, 151.90 feet Southeasterly of the intersection of the center line of Higgins Road and the West line of the East Half of the South- east Quarter of Section 26; thence Southeasterly along the center line of Higgins Road to the Southwesterly corner of land conveyed to School District by deed recorded in the Recorder's office of Cook County, Illinois as Document Number 9169769; thence Northeasterly along the Northwesterly line of said land conveyed to School District, 441.40 feet to the Northwesterly corner thereof; thence North on a line parallel with the East line of said Section 26 to the inter section of said parallel line with a line drawn 801.55 feet South of and parallel with the North line of said Southeast Quarter; thence West along the last described parallel line to a point on said parallel line, 949.28 feet West of the East line of the Southeast Quarter of Section 26; thence South- westerly to the place of beginning in Cook County, Illinois. Parcel 3: That part of the Southeast Quarter of Section;26, Township 41 North, Range 11, described as follows: Beginning at a point which is 353.34 feet East of the Northwest corner of the East Half of the Southeast Quarter of said Section 26 measured along the North line of said Southeast Quarter; thence Southwesterly along a line drawn South 18030' West from the last mentioned line to the center line of Higgins Road; thence Southeasterly along the center line of Higgins Road 167.26 feet; thence Southeasterly along the center line of Higgins Road from last mentioned point which deflects Southerly 0023'30" Southerly 151.90 feet; thence Northeasterly to a point in the North line of the Southeast Quarter; thence West along the North line of said Southeast Quarter, 290.09 feet to the place of beginning in Cook County, Illinois, (except that part of the Southeast Quarter of Section 26, Township 41 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at a point which is 353.34 feet East of the Northwest corner of the East Half of the Southeast Quarter of said Section measured along the North line of said Southeast Quarter; thence Southwesterly along a line drawn South 18030' West from last mentioned line, a distance of 847.49 feet to its inter- section with a line drawn 801.55 feet South of and parallel with the North line of said Southeast Quarter; thence East along the last described parallel line a distance of 290.09 feet to a point which is 949.28 feet West of the East line of said Southeast Quarter, as measured along aforesaid parallel line; thence Northeasterly along a line to a point in the North line of said Southeast Quarter which is 681.09 feet West of the Northeast corner of said Southeast Quarter, as measured along the North lirethereof; thence West along said North line a distance of 290.09 feet to the place of beginning) in Cook County, Illinois. Ordinance No. 463 same is hereby annexed to the Village of Elk Grove Village so that hereafter said territory shall be included within the boundary lines and limits of said Village, as is by law in such case made and provided. Section 2: That all land and territory described in said petition and as Parcel 3 on Exhibit A " . attached, which territory is contiguous to the Village of Elk Grove Village, is not within the limits of any municipabty and contains no electors, be and the same is hereby annexed to the Village of Elk Grove Village, so that said territory shall be included within its boundaries and limits as is by law in such cases made and provided. Section 3: That the Village Clerk of the Village of Elk Grove Village is hereby directed to record a certified copy of this ordinance together with an accurate plat setting forth Parcels 2 and 3 as described on Exhibit A attached with the Recorder of Deeds of Cook County, Illinois. Section 4: That this ordinance shall be in full force and effect from and after its passage and approval according to law. PASSED this 11th day of April , 1967.
