AN ORDINANCE LICENSING AUTOMATIC SOOD VENDING
AND ESTABLISHING STANDARDS IN REFERENCE THERETO
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and Du Page:
Section 1. That Chapter 21 of the Municipal Code of the
Village of Elk Grove Village be and is hereby emended by adding
thereto the following:
ARTICLE VI, Automatic Food Beverage Vending
21.601 Definition. The term "automatic food vending
machine" when used in this article shall mean any mechanical
container or device used for the sale of any beverage or
article of food, the operation of which is governed or con-
trolled by the deposit of a coin or token.
21.602 License required. No person shall install, keep,
maintain or use an automatic food vending machine in the
Village, or permit the installation, keeping, maintenance or
use upon his premises of an automatic food vending machine,
without first having obtained a license therefor; provided,
however, that when the owner or operator of an automatic
food vending machine has obtained such a license, the owner
or lessee of the premises on which said machine is to be
located need not obtain a further license for the machine.
21.603 All applications for a license hereunder shall
be on forms prescribed by the Village Clerk; the Village
President shall issue licenses hereunder upon the satisfactory
report of the Village Health Inspector and the payment of
required fees.
21.604 The Village of Elk Grove Village does hereby
adopt by reference "the vending of food and beverages
sanitation ordinance and code" 1965 edition as recommended
by the Public Health Service of the United States Government
as its ordinance and code governing the regulation of auto-
matic food vending machines except in so far as specific ^
provisions of this code contradict same. The Village Clerk
shall retain three copies of same at the Village Hall in
accordance with legal requirements.
21.605 Investigation. The Health Inspector shall make
or cause to be made such investigation as he deems necessary
to determine whether the applicant's automatic food vending
machine and automatic food vending operations comply with
all the provisions of this Code relating to health, sani-
tation and food and with all other applicable provisions of
this code. No license shall be issued to any applicant
whose automatic food vending machine and automatic food
vending machine operations do not comply with the applicable
provisions of this Code. The Health Inspector shall indicate
on the application for a license the results of his investi-
gation and his approval or disapproval or said application.
21.606 Fee. The annual fee for a license to install,
keep, maintain or use an automatic food vending machine
hereunder shall be:

21.607 Operator's place of business.
(a) The licensee shall notify the Village Clerk as
to the address of his place of business and the
location of all vending machines; the current
address along with the operator's name shall be
indicated in a conspicuous place on each machine
together with the license for the applicable
license period.

(b) In addition, there shall be posed in a
conspicuous place on each machine the
name, address and telephone number of
the person responsible for the mainten-4
ance of such machine.
21.608 Premises. No automatic food vending machine shall
be located in any premises that expose the food to danger from
improper handling, dust, dirt, flies, vermin or other contamin-
ation. No automatic food vending machine shall be installed or
kept in any toilet or washroom.
21.609 Inspection. The Health Inspector shall inspect
or cause to be inspected, as often as he deems necessary, every
automatic food vending machine located and conducted in the Village
to determine whether all applicable provisions hereof are being
complied with.
21.610 Penalty. Any person, firm or corporation violating
any provision of this Article shall be fined not less than $25.00
nor more than $200,00 for each offense and a separate offense
shall be deemed committed on each day during and on which a
violation occurs or continues.
Section 2. This ordinance shall be in full force and
effect from and after its passage and approval and publication
according to law.
