HomeMy WebLinkAboutORDINANCE - 435 - 7/12/1966 - STREET PERMITS/ADD AND AMENDORDINANCE N0, 43L, AN ORDINANCE PROVIDING FOR A STREET PERMIT AS A CONDITION TO THE ISSUANCE OF A BUILDING PERMIT VHEREAS, it has become evident to the Village that owners, contractors and building permittees operating in the Village are not properly cleaning public streets of mud and debris caused by their construction activities, and I WHEREAS, the deposit of mud and debris upon the public streets cause same to be slippery and unsafe, and WHEREAS, it is necessary and desirable that the foregoing be controlled by proper ordinances, W1, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES, VILLAGE OF ELK GROVE VILLAGE, COUNTIES OF COOK AND DU PAGE: SECTION 1: That there be added to Chapter 13 of the Municipal Code of the Village of Elk Grove Village the following: ''Article IX. Street permits as a condition to issuance of Building Permit 13.901 Street permit required. It shall be unlawful to construct any building or structure other than a fence in the Village where the cost of construction exceeds $200.00 dollars or to alter or remodel any structure so as to change any bearing walls, beams, supports or the roof thereof without having first secured a street permit for he vehicles which will be used in the construction activity made necessary thereby, said street permit to be issued in the same name and to the same person as is issued the building permit. The Building Department shall not issue a building permit to any person who has not first obtained a street permit as provided by this section. 13.902: No person, firm or corporation shall be issued a street permit by the Street Department of this Village unless he shall have first deposited a sum of money as determined below with the Village Treasurer of the Village so as to assure proper and prompt street cleaning made necessary Ly construction activity. The amount of the deposit shall be determined as follows: Amount of De osis Per single family residence $ 50.00 or addition :hereto Residential construction where permittee is constructing 5 or more residences, maximum deposit. for all residences under con- struction $20.00 Commercial and industrial con- struction per industrial site $500.00 Contractor constructing two or more industrial buildings, maximum deposit to be paid . $11 000.00 and such amount as may be necessary to restore said deposit when same is depleted. 13.903 The Street Department shall inspect public streets adjoining premises wherein construction activity is taking place, and upon finding said public streets to be unclean as a result of construction activity, shall notify permittee to clean '-he streets, and if said streets remain unclean 24 hcurs, shall have strrefs cleaned. Bills for said street cleaning shall be paid by the Village Treasurer from deposit made. Charges for the foregoing shall be determined from time to time by resolution adopted by the President and Board of Trustees. The permittee shall be entitled to a rebate after first deducting charges for said street cleaning; acceptance of the proceeds of the deposit or portion thereof shall constitute an admission by depositor that the street cleaning performed was made necessary by his construction activities. 1.3.904 Penalty All persons, firms or corporations violating any portion of this article shall be fined not less that $10.00 or more that ;200.00 for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues Section 2: This ordinance shall be in full force and effect from and after its passage, approval and publi- cation according to law.
