RD /DEVONORDINANCE NO. 366 AN ORDINANCE AMENDING THE VILLAGE OF ELK GROVE VILLAGE ZONING ORDINANCE RELATING TO PROPERTY CONSISTING OF 6.98 ACRES NEAR ARLINGTON HEIGHTS ROAD AND DEVON AVENUE FROM B-1 BUSINESS TO R-3 RESIDENTIAL WHEREAS, the Board of Appeals of the Village of Elk Grove Village, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal No.64-24 ), considered the question of re- classifying the real estate hereinafter described from B-1 Business District to R-3 Residential District AND, WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, having consideact.the recommendation of said Zoning Board of Appeals, find and believe that the highest and best use of said real estate is that of R-3 NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois: Section 1. That an ordinance entitled "An ordinance to regulate and limit the height and bulk of buildings; to regulate and limit the in- tensity of the use of lot areas, and to regulate and determine the areas of open space within and surrounding such buildings; to classify, regulate and restrict the location of trades and industries and the location of buildings designed for specified industrial business, residential and other uses; to divide the entire Village,of Elk Grove Village into districts for the purpose of this ordinance; to fix standards to which buildings or structures shall conform; to prohibit uses, buildings or structures in- compatible with the character of such districts respectively; and to prevent additions to and alterations or remodeling of existing buildings or struc- tures in such a way as to avoid the restrictions and limitations lawfully imposed hereunder, and to provide penalties for violation hereof," passed and approved July 8, 1957, known as Ordinance No. 20, as amended, be amended by reclassifying the following described real estate from B-1 to R-3 The South 900.0 feet as measured along the West line of the West 870.0 feet as measured along the South line of the East 112 of the Southeast 1/4 of Section 32, Township 41 North, Range 11, East of the Third Principal Meridian ( excepting therefrom that part bounded and described as follows: Commencing at the Southwest corner of said East 1/2 of the Southeast 1/4 of. Section 32; thence East along the South line of Section 32, 767.94 feet; thence North along a line that turns an angle of 880 25' 55" from West to North with said South line of Section 32, a distance of 507.48 feet; thence West along a line parallel to the South line of said Section 32, a distance of 20.50 feet to a point of curve; thence Northwesterly along a curve concave Northeasterly and having a radius of 720 feet a distance of 632.75 feet; thence Westerly along a curve concave Northerly and having a radius of 335.83 feet a distance of 141.67 feet (the chord of said arc having an angle of 1410 04' 35" from Southeasterly to Southwesterly with the chord of the last described curve); thence West to a point on the West line of the East 112 of the Southeast 1/4 of Section 32, 732.87 feet north of the place of beginning; thence South along said West line of the East 1/2 of the Southeast 1/4 Section 32, 732.87 feet to the place of beginning) in Cook County, Illinois. Section 2. That said real estate as reclassified shall be subject to all the limitations and conditions place upon properties in the R-3 District tom_, as defined in the ordinances aforementioned. Section 3. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the en- forcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this 25th day of November , 1964.
