BEING REZONED FROM R-3 SINGLE Fl1NiILY DTdELLING DISTRICT TO A-2 MULTI -FAMILY DWELLING DISTRICT. WHEREAS, the Board of Appeals of the Village of Elk Grove Village, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal Not 64-16 ), considered the question of reclassifying the real estate hereinafter described from R-3 Single Family Dwelling to A-2 Multi -Family Dwelling District ANb, !IkREAS, the bresident and Board of Trustees of the Village of Elk Grove Village, having considered the recommendatlon of said Zoning Board of Appeals find and believe that the highest and best Jse of said real estate is that of A-2 Multi -Family Dwelling District NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois: Section 1. That an ordinance entitled "An ordinance to regulate and limit the height and bulk of buildings; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the areas of open space within and surrounding such buildings; to classify, regulate and restrict the location of trades and industries and the location of buildings designed for specified industrial business, re- sidential and other uses; to divide the entire Village of Elk Grove Village into districts for the purpose of this ordinance; to fix standards to which buildings or structures shall conform; to prohibit uses, buildings or structures incompatible with the character of such districts re- spectively; and to prevent additions to and alterations or remodeling of existing buildings or structures in such a way as to avoid the re- strictions and limitations lawfully imposed hereunder, and to provide penalties for violation hereof,01 passed and approved July 3,1957, known as Ordinance No. 20, as amended, be amended by reclassifying the follow- ing described real estate from R-3 to A-2 That part of Section 28, Township 41 North, Range 11, East of the Third Principal Meridian, lying southerly of the center line of Landmeier Road, lying North of the South line of the North half of the Southeast quarter of said Section 28, and lying East of the East line of Branigar's Forest View homesites, a subdivision of part of said Section 28 (except from said parcel the East 100.0 feet taken for Tonne Road and except the Right of Way of the Chicago District Pipe Line Company and except the South 506.48 feet of the West 230.0 feet of the East 330.0 feet of said parcel, and except that part of said parcel lying North of a line drawn at right angles to the West line of the East 100 feet thereof, from a point in said West line of the East 100 feet 201.78 feet South, as measured along said West line of the East 100 feet, of the center line of Landmeier Road, and excepting also from said parcel that part bounded and described as follows: commencing at the intersection of the center line of Landmeier Road and the East line of Branigar's Forest View homesites aforesaid; thence easterly along said center line 242.42 feet, more or less, to its intersection with the Westerly line produced South of Wildwood Road, as dedicated, in Elk Grove Village Section One South, being a subdivision in the North half of said Section 28; thence Southerly along said Westerly line produced South of Wildwood Road, a distance of 223.89 feet to a point of curve; thence continuing Southerly along said curve, concave Easterly and having a radius of 700 feet, a distance of 184.71 feet, more or less, to its intersection with a line 390 feet West of and parallel to the East line of the Southeast Quarter of said Section 28; thence continuing South along said line 390 feet West of and parallel to the East line of the Southeast Quarter of said Section 28, 83.92 feet, more or less, to the Northerly Right of Way line of Chicago District Pipe Line Company; thence Westerly along said Northerly Right of Way line, 155.93 feet, more or less to the East line of Branigar's Forest View homesites, aforesaid; thence North along said East line of Branigar's Forest View homesites, to the center line of Landmeier Road and the place of beginning) all in Cook County, Illinois. Section 2. That said real estate as reclassified shall be subject to all the limitations and conditions placed upon properties in the A-2 Multi -Family Dwelling District as defined in the ordinances aforementioned. Section 3. That any person, firm or corporation who violates, disobeys, omits, neglects or refuges to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100) Dollars fpr each offense, and each day that a violation is permitted to exist shall constitute a separate offense, Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and pu6lieatioh, according to law. PASSED this 10th day of December 1964.
