HomeMy WebLinkAboutORDINANCE - 376 - 1/14/1965 - REZONE/HIGGINS SCHOOL SITEORDINANCE NO. 2-76, AN ORDINANCE AMENDING THE VILLAGE OF ELK GRO7E VILLAGEIS ZONING ORDINANCE RELATING TO PROPERTY OWNED BY SCHOOL DISTRICT NO. 59 WHEREAS, the Board of Appeals of the Village of Elk Grove Village, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal No, 64-26 considered the question of reclassifying the real estate here- inafter described from R-1 to M-2 Heavy Industrial District AND, WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village, having considered the recommendation of said Zoning Board of Appeals, find and believe that the highest and best use of said real estate is that of M-2 NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois: Section 1. That an ordinance entitled "An Ordinance to Regulate an Limit the Height and Bulk of Buildings; to Regulate and Limit the Intensity of the Use of Lot Areas, and to Regulate and Determine the Areas of Open Space Within and Surrounding Such Buildings; to Classify, Regulate and Restrict the Location of Trades and Irdustries and the Location of Buildings Designed for Specified Industrial Business, Residen- tial and other uses; to Divide the Entire Village of Elk Grove Village into Districts for the Purpose of this Ordinance; to Fix Standards to W hick Buildings or Str,ctures shall Conform; to Prohibit Uses, buildings or structures Lncompatible with the Character of Such Districts Respectively; and to Prevent Additions to and Alterations or Remodeling of Existing Buildings or Structures in Such a 'Jay as to Avoid the Restrictions and Limitations Lawfully Imposed Hereunder, and to Provide Penalties for Violation hereof," passed and approved July 8, 1957, known as Ordinance No. 20, as amended, be amended by reclassifying the following described real estate from R-1 to M-2 (The legal description of said real estate is attached hereto and incorporated herein by reference as if here fully set out.) Section 2. That said real estate as reclassified shall be subject to all the limitations and conditions placed upon prop- erties in the M-2 District , as defined in the ordinances aforementioned. Section 3. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this or- dinance shall be fined not more than one Hundred ($100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. PASSED this ` � da of l.9 f y n nary. Bresident ATTEST: Village Cle✓ PUBL the RIDER ATTACHED TO ORDINANCE NO. 5 76 LEGAL DESCRIPTION: Lots 1 to 11 inclusive, and Lots 16 to 34 inclusive in Steelefs Higgins and Touhy Highlands, a Subdivision in the East Half of the South East Quarter of Section 26, Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois; ALSO Vacated School Street and vacated alleys abutting and adjacent to Lots 1 to 12 both inclusive and Lots 16 to 34 both inclusive in Steelets Higgins 4nd Touhy Highlands Subdivision aforesaid (except the East Half of that part of the vacated 20 foot alley lying West of Lot 12 in said Subdivision, and also excepting therefrom the Northerly Half of that part of the vacated 20 foot alley lying Southerly of said Lot 12 and Southerly of the Southerly line of said Lot 12 extended Westerly to the West line of the East Half of the vacated 20 foot alley lying West of said Lot 12); EXCEPTING From the above described real est4te the following des- cribed tract of land: Beginning at the Southeasterly corner of said Lot 16 in Steele's Higgins and Touhy Highlands as aforesaid, thence Northwesterly along the Southwesterly line of said Lots 16 to 21 inclusive, and the Southwesterly line of vacated School Street and the Southwesterly line of Lots 31 to 34 inclusive to the South- westerly corner of said Lot 34 in Steelets Higgins and Touhy Highlands, thence Northeasterly along the North- westerly line of said Lot 34 a distance of 5.0 feet to a point, thence Southeasterly along a curved line concave to the Northeast and having a radius of 1708.35 feet to a point in the Easterly line of said Lot 16 in Steelets Higgins and Touhy Highlands which point is 8.0 feet North- easterly of the Southeasterly corner of said Lot 16 as measured along the Southeasterly line of said Lot 16, thence Southwesterly along the Southeasterly line of said Lot 16 a distance of 8.0 feet to the point of beginning; EXCEPTING ALSO From the above described real estate those parts previously dedicated or now being used for Higgins Road and Touhy Avenue.
