AN ORDINANCE AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF ELK GROVE VILLAGE
RELATING TO THE POSITION OF VILLAGE MANAGER
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and Du Page, Illinois:
Section 1. That Sections 4.1001 through Section 4.1005 of Chapter 4 of the
Municipal Code of Elk Grove Village are hereby repealed.
Section 2. That Chapter 4 of the Municipal Code of Elk Grove Village is hereby
amended by adding the following:
ARTICLE X VILLAGE MANAGER
Section 4.1001. Creation of Office. The office of Village Manager is
hereby created.
Section 4.1002. Appointment of Village Manager. The Village Manager shall
be appointed by majority vote of the President and Board of Trustees acting
jointly for an indefinite term. He shall be chosen solely on the basis of
his executive and administrative qualifications with special reference to
his actual experience in or his knowledge of accepted practice in respect
to the duties of his office hereinafter set forth. At the time of his
appointment he need not be a resident of the Village or the state, but dur-
ing his tenure of office he shall reside within the Village. No Village
elected official shall receive such appointment during the term for which he
shall have been elected nor within one year after the expiration of his term.
Section 4.1003. Removal of Village Manager. The Board of Trustees may
remove the Village Manager at any time by a majority vote of its members.
At least thirty days before such removal becomes effective, the Board of
Trustees shall furnish the Manager with a written statement setting forth
its intention to remove him and the reasons therefor. If requested by the
Manager the Board of Trustees shall grant him a public hearing during this
thirty day period.
Section 4.1004. Powers and Duties of Village Manager. The Village Manager
shall be the chief administrative officerof the Village. All departments
shall report to the Village Manager including the Fire and Police Depart-
ments. He may head one or more departments and shall be responsible to the
President and Board of Trustees for the proper administration of all affairs
of the Village. To that end, he shall have power and shall be required to:
A. Hire and, when necessary for the good of the service, suspend or
remove all employees of the Village except as otherwise provided by
the Municipal Code or Illinois Revised Statutes.
B. Prepare the budget annually and submit it to the Board of Trustees to-
gether with a message describing the important features and be responsible
for its administration after adoption.
C. Prepare and submit to the Board of Trustees as of the end of the fiscal
year a complete report on the finances and administrative activities of the
Village for the preceding year.
D. Keep the Board of Trustees advised of the financial condition and future
needs of the Village, and make such recommendations as he may deem desirable.
E. Recommend to the Board of Trustees a standard schedule of pay for each
officer and employee in the Village government, including minimum, inter-
mediate, and maximum rates.
F. Recommend to the Board of Trustees (from time to time) adoption of such
measures as he may deem necessary or expedient for the health, safety, or
welfare of the community or for the improvement of administrative service;.
G. Consolidate or combine offices, positions, departments, or units Ander
his jurisdiction, with the approval of the Board of Trustees.
H. Attend all meetings of the President and Board of Trustees unless excused
therefrom and take part in the discussion of all matters coming before the
Board. He shall be entitled to notice of all regular and special meetings
of the President and Board of Trustees.
I. Purchase all materials, supplies, and equipment for which funds are pro-
vided in the budget for amounts up to and including $1,500.00 For expendi-
tures in excess of $500.00 and up to $1,500.00 secure at least two quotations
before making purchases and if called upon by the Board of Trustees be
prepared to present the quotations. Receive sealed bids for purchases or
contracts in excess of $1,500.00 and present them to the Board of Trustees
for approval, and advise the Board on the advantages or disadvantages of
contract and bid proposals. No purchase shall be made, contract let or
obligation incurred for any item or service which exceeds the current
working budget without prior approval by the Board of Trustees. No con-
tract in excess of $1,500.00 and no contract for new construction shall
be let except by the Board of Trustees. The Village Manager may
issue such rules governing purchasing procedures within the administra-
tive organization as the Board of Trustees shall approve.
J. See that all laws and ordinances are duly enforced.
K. Investigate the affairs of the Village or any department or division there-
of. Investigate all complaints in relation to matters concerning the admini=
stration of the government of the Village, and in regard to service maintained
by the public utilities in the Village, and see that all franchises, permits,
and privileges granted by the Village are faithfully observed.
L. Devote his entire time to the discharge of his official duties.
M. Perform such other duties as may be required by the President and Board
of Trustees, not inconsistent with the Municipal Code, Illinois Revised
Statutes, law or Village ordinances.
Section 4.1005. Board Not to Interfere with Hiring or Removing. Neither
the President nor the Board of Trustees nor any of its members shall direct
the hiring of any person to, or his removal from, office by the Village
Manager or any of his subordinates, or in any manner take part in the hirinC
or removal of employees in the administrative services of the Village.
Except for the purpose of inquiry, the President and Board of Trustees and
its members shall deal with the administrative service when practical
through the Village Manager and neither the President nor the Board of
Trustees nor any member thereof shall give orders to any employees of
the Village.
Section 4.1006. Emergencies. In case of accident, disaster, or other cir-
cumstance creating a public emergency, the Village Manager may award contracts
and make purchases for the purpose of meeting said emergency; but, he shall
file promptly with the Board of Trustees a certificate showing such emergency
and the necessity for such action, together with an itemized account of all
expenditures.
Section 4.1007. Bond. The Village Manager shall furnish a surety bond in the
amount of $5,000.00 to be approved by the Board of Trustees, said bond to be
conditioned on the faithful performance of his duties. The premium of the
bond shall be paid by the Village.
Section 4.1008. Compensation. The Village Manager shall receive such compen-
sation as the Board of Trustees shall fix.
Section 4.1009• Vacancy. Any vacancy in the office of Village Manager shall
be filled within 90 days after the effective date of such vacancy.
Section 4.1010. Powers and Duties to Revert. In the case of a vacancy in
the office of Manager or of the absence or disability of the Manager all
powers and duties granted by this Article to the Village Manager shall re-
vert back to the President and Board of Trustees.
Section 4.1011. Saving Clause. If any section, subsection, or sentence,
clause, or phrase of this Article is for any reason held invalid, such deci-
sion or decisions shall not affect the validity of the remaining portions
of the Article. All ordinances of the Village shall remain in full force
and effect insofar as they conflict with the provisions of this Article in
which case the provisions of this Article shall govern.
Section 3. This ordinance shall be in full force and effect from and after its
passage, approval and publication according to law.
