AN ORDINANCE ANNEXING CERTAIN TERRITURY LYING WEST
OF ELMHURST ROAD, NORTH OF HIGGINS ROAD, AND SOUTH
OF THE NORTHWEST TULLWAY TO THE VILLAGE OF ELK GROVE
VILLAGE CUOK CUUNTY ILLINUIS
WHEREAS, a majority of the property owners of record, owners
of record of more than fifty percent of the land in the territory
described, and there being no electors residing on said territory
hereinafter described and commonly known as having as its western
boundary Elmhurst Road, being north of Higgins Road, and south of
the Northwest Tollway, have sought to annex said area, hereinafter
more fully described, to the Village of Elk Grove Village, and
WHEREAS, said property owners, to accomplish said purpose,
have filed a petition to annex with the County Court of Cook County,
Case No. 63 Cc 3577, in accordance with the Statutes of the State
of Illinois made and provided, and
WHEREAS, Judge Frank B. Machala, Acting Judge of the County
Court of Cook County, did on July 30, 1963 enter an order, a certi-
fied copy of which is marked Exhibit 1, attached hereto and made a
part of this ordinance by reference as if fully set forth, which
order did find that the petition to annex the hereinafter described
property was signed by a majority of the property owners of record,
owners of record of more than fifty percent of the land in the
territory herein described, and that no electors or any other per-
sons reside on territory herein described and that said petition
did comply in all respects with the laws of the State of Illinois,
that the territory described in said petition and referred to below
was in fact contiguous to the Village of Elk Grove Village and did
duly certify the area to be annexed, and
WHEREAS, a copy of said order was duly transmitted to the
Village Clerk of the Village of Elk Grove Village in accordance with
the statutes made and provided; she having received same, and
WHEREAS, it is deemed to the best interests of the Village of
Elk Grove Village that the property hereinafter described and common-
ly known as being West of Elmhurst Road, North of Higgins Road, and
South of the Northwest Tollway in Cook County, Illinois be annexed
to the Village of Elk Grove Village.
NOW, THEREFORE, BE IT URDAINED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois:
Section 1. That land and territory described in the above
mentioned petition and the above mentioned order, legal description
of said territory being attached hereto and made a part of this
ordinance, which territory is contiguous to the Village of Elk Grove
Village, is not within the limits of any municipality, and which has
sought annexation through petition to the County Court of Cook
County, Case No. 63 Cc 3577, and which petition has lead to the
entry of an order by Judge Frank R. Machala, Acting Judge of the
County Court of Cook County on July 30, 1963, which order did duly
find that the territory described in said petition and described in
the legal description attached was in fact contiguous to the Village
of Elk Grove Village, and that said petition was signed by a majority
of the property owners of record, owners of record of more than fifty
percent of land of the territory therein described, and that no
electors or any other persons reside on territory therein described,
and that the precedings and petition filed were in all respects in
full compliance with the Statutes applicable theretof particularly
Illinois Revised Statutes; Chapter 24, Sections 7�1-2 through 7-1-5,
and which order certified the area to be annexed as above set forth,
is herebp annexed to the Village of Elk Grove Village so that here&
after said territory shall be included within the boundary lines and
limits of said Village of Elk Grove Village] as is by law in such
case made and provided,
Section 24 That the Village Clerk of the Village of Elk Grove
Village is hereby directed to record a certified copy of this
ordinance together with an accurate plat of survey of said territory,
to be provided by the Village Engineer, with the Recorder of Deeds
of Cook County, Illinois.
Section 3. That this ordinance shall be in full force and
effect from and after its passage, approval and the expiration' of
thirty days from date thereof, in accordance with Section 7-1-5 of
Chapter 24 of the Illinois Revised Statutes (Municipal Code 1961).

That part of the Southeast quarter of Section 26,
Township 41 North, Range 11, East of the Third Principal
Meridian, described as follows:
Commencing at a point in the Center Line of Higgins
Road 855.45 feet north 41 degrees West from the South
line of Section 26 aforesaid (said point being the
Southwesterly corner of land conveyed to School District
by deed recorded in the Recorder's Office of Cook County,
Illinois as Document No. 9169769); thence North 49 degrees
East along the Northwesterly line of said land conveyed to
School District and at right angles to the Center Line of
Higgins Road, 50 feet to the Place of Beginning:- Thence
continuing North 49 degrees East along the Northwesterly
line of said land conveyed to said School District
391.40 feet to the Northwesterly corner thereof; thence
North on a line parallel with the East line of said
Section to the intersection of said parallel line with
a line drawn 801.55 feet South of and parallel with the
North line of said Southeast quarter; thence West along
the last described parallel line to a point which is

measured along said parallel line; thence North 180 30
minutes East 847.49 feet to the Northwest corner of the
East half of the Southeast quarter of Section 26 afore-
said; thence East along the North line of the Southeast
quarter of Section 26 aforesaid 1234.53 feet more or
less to a point 90 feet West of the Northeast corner of
the Southeast quarter of said Section 26; thence South-
easterly a distance of 199.55 feet to a point on a line
which is 198 feet South of and parallel with the North
line of said Southeast quarter, which point is 63.42
feet West of the East line of said Section 26 as measured
along said parallel line; thence continuing Southeasterly
to a point on a line which is 298 feet South of and
parallel with the North line of said Southeast quarter,
which point is 50 feet West of the East line of said
section as measured along said parallel line; thence
South along a line 50 feet West of and parallel with
the East line of said Section 26 a distance of 165.88
feet more or less to a point on a line 463.88 feet South
of and parallel with the North line of said Southeast
quarter which point is 50 feet West of the East line of
said Section 26; thence East along said last mentioned
parallel line 17 feet to a line 33 feet West of and
parallel with the East line of said Section 26; thence
South along said parallel line to its intersection with
the extension of the Northwesterly line of Steele's
Higgins and Touhy Highlands, a subdivision in the East
half of the Southeast quarter of Section 26, Township 41
North, Range 11 East of the Third Principal Meridian;
thence Southwesterly along the Northwesterly line extended
and the Northwesterly line of Steele's Higgins and Touhy
Highlands aforesaid to its intersection with a line parallel
to and 50 feet Northeasterly of the Center line of Higgins
Road as measured at right angles to said Center Line;
thence Northwesterly along said parallel line 295 feet to
the place of beginning, situate in the County of Cook and
State of Illinois.

This cause coming on to be heard on the petition of NORTHERN ILLINOIS
GAS COMPANY, CHEMETRON CORPORATION, and TRUSTEES OF SCHOOLS OF TOWNSHIP 41
NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, COOK CCUNTY, ILLINOIS,
to annex certain territory to the Village of Elk Grove Village:
The Court finds:
1. That said petition was duly filed in this court on July 2, 1963.
2. That thereafter an order was entered setting the said petition
for hearing at 10:00 o'clock A.M. Central Daylight Saving Time, July 30,
1963.
3• That due notice of said hearing was given by publishing the same
once in Elk Grove Herald, a newspaper published in the said annexing munic-
ipality of Elk Grove Village, publication.having been made on July 11, 1963,
said publication having been made not more than 30 nor less than 15 days
before the date fixed for the hearing and said notice having been in due
form as provided by Article 7 of the Municipal Code of 1961 (Chapter 24,
Article 7, Ill. Rev. Stat. 1961) and that a copy of said notice has been
filed with the Clerk of said Elk Grove Village, the annexing municipality.
4. That no objections have been filed to said petition.
5• That the said petitioners comprise a majority of the owners
of record of the land sought to be annexed and the owners of record of
more than fifty per cent of the land therein described sought to be
annexed; and that no electors or any other persons reside on said land
sought to be annexed; that said petition is in all respects valid and
in conformity with Article 7 of the Municipal Code of 1961 (Chapter 24)
Article 7, Ill. Rev. Stat. 1961).
IT IS TREREFORE ORDERED, ADJUDGED AND DECREED,
1. That the territory sought to be annexed to the Village of
Elk Grove Village by this proceeding is described as follows, to -wit:

2. That the petition for annexation filed in this proceeding
conforms to Article 7 of the Municipal Code of 1961 (Chapter 24,

3. That the question of annexation of the above described property
be submitted to the corporate authorities of the annexing municipality,
namely, the Village of Elk Grove Village, for final action.
