HomeMy WebLinkAboutORDINANCE - 328 - 4/2/1964 - VILLAGE ADMINISTRATOR/CREATINGORDINANCE NO. 3 y AN ORDINANCE CREATING THE OFFICE OF "VILLAGE ADMINISTRATOR" AND AMENDING CHAPTER 4 OF THE MUNICIPAL CODE OF THE VILLAGE OF ELK GROVE VILLAGE..BY ADDING ARTICLE X "VILLAGE AEMINIMR.ATOR^. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grave Village, counties of Cook and DuPage. Section 1. That the Municipal Code of the Village of Elk Grove Village be and is hereby amended by adding thereto the following: By adding the following to Chapter 4 of the Municipal Code of Elk Greve Village "Article X Village Administrator". "Section 4.1201 creation of office, the position of Village Adminis- trator is hereby created. "Section 4.1002 Appointment. The Village Administrator shall be appointed by the President by and with the consent of the Board of Trustees for an indefinite term. During his tenure of office he shall reside within the Village. Any Vacancies in the office of Village_ Administrator_ shall be filled within ninety (90) days after the effective date of said vacancy. "Section 4.1003 Powers and duties of Village AdministratAr. The Village Administratir shall be an executive officer of the village. He shall be responsible to the President and the Board of Trustees for the proper administration of village affairs and shall be the administrative head of all departments. He shall have the following powers: "A. Recommend to the Village President officers of the Village who are required to be appointed. He shall further remove or suspend dP any such officer consistent with the best interest of the Village. All appointments or removals shall be based upon merit and upon qualifications or dis- qualifications of such officer without regard to political belief or affiliations. Notice of said actions either for.appointment'or removal shall be delivered to the President and the Board of Trustees. "B. Submit recommendations <o the President and the Board of Trustees as to expenditures to be considered in the annual budget, including salary and wage adjustments, capital expenditures, purchase and contract services to be made in any fiscal year. "C". Prepare and submit to the Village Board as of the end of the fiscal year a complete report on the administrative activities of the Village for the preceding year. "D'. Recommend to the governing body the salary to be paid each appointive officer and subordinate employee of the Village. "E". Recommend to the governing body, in writing, from time to time, for adoption, such measures as he may deem necessary and expedient. 'F'. Attend all meetings of the Village Board unless excused therefrom by the Board, except when his removal is under consideration. The Village Administrator shall have the privilege of taking part in the discussion of matters coming before the Board but shall have no vote therein. He shall be entitled to notice of all meetings, regular and special of the Board. "G". Purchase of all materials, supplies and equipment for which funds are provided in the budget and provided same has been authorized by the President and the Board of Trustees, or providing said expenditure does not exceed $100.00. For all purchases of more than 4500.00 he shall receive bids and shall present such bids to the President and Board of Trustees. The Village Administrator shall advise the Village Board as to whether or not any con- tract offered is desirable, or which of several contracts offered is most - 1 - desirable for the Village. In case of accidents or other circumstances creating an emergency, the Village Administrator may, with the consent of the Village Board, award contract and make purchases for the purposes of repairing damages caused by the said accident or meeting said public emergency; but he shall file promptly with the Village Board a certificate showing such emergency and the necessity of such action, together with an itemized account of all expenditures. "H". See that all laws and ordinances are duly enforced. "I". Make investigations into the affairs of the Village or any department or division thereof. Investigate all complaints in relation to all matters concerning the administration of the government of the Village and in regard to service maintained by the public utilities in the Village, and see that all franchises, permits and privileges granted by the Village are faith- fully observed. " J". Devote full time to the discharge of his official duties. "K". Perform such other duties as may be required of him by the Village Board or the President, not inconsistent with the Village Ordinances or the law. "L". Make semi-monthly reports to the Board of Trustees of activities of all departments under his jurisdiction. "M". An elected official of the Village is not eligible for appointment as Village Administrator until one year after he leaves his office. "Section 4.1004. Bonds and compensation. The Village Administrator shall furnish a surety bond in the amount of $25,000, to be approved by the Village Board, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the Village. "The Village Administrator shall receive such compensation as the Village Board shall fix from time to time by resolution. "Section 4.1005. Saving clause. If any section, subsection cr sentence clause or phrase of this article is for any reason held invalid, such decision or decisions shall not effect the validity of the remaining portions of this article. All ordinances of the Village prescribing the duties of heads of departments shall remain. in full force and effect except insofar as they conflict with the provisions of this article in which case the provisions of this article shall govern."
