PYMTORDINANCE NO. 350 AN ORDINANCE PROVIDING FOR THE VOLUNTARY PAYMENT AND SETTLEMENT OF PENALTIES ARISING OUT OF CERTAIN ORDINANCE VIOLATIONS. WHEREAS, after investigation and due consideration, the President and Board of Trustees of the Village of Elk Grove Village have determined it to be to the best interest of the public to provide a method for the voluntary payment of penalties and the settlement of claims arising out of certain ordinance violations in force in the Village of Elk Grove Village: NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois, as follows: Section 1. That the Municipal Code of the Village of Elk Grove Village be and is hereby amended by adding thereto the following: "Chapter 24A SETTLEMENT OF PENALTIES. ARTICLE I AUTHORIZATION AND PROCEDURE. 24A.101 - Whenever a peace officer is authorized to arrest a person without a warrant because of a violation of the hereinafter designated sections of the Municipal Code of Elk Grove Village, said officer shall issue the accused person (by personal delivery or by attaching same to the motor vehicle) a citation or notice to appear in the following form: Last Name Print First Name Address City Date 19 Phone Sex Age State Business Phone Name Address YOU ARE HEREBY NOTIFIED TO APPEAR AT THE VILLAGE HALL OF ELK GROVE VILLAGE, ILLINOIS - 666 LANDMEIER ROAD, On or Before 19 at M. UNLESS YOU APPEAR A WARRANT FOR YOUR ARREST WILL FOLLOW. You violated Section :Municipal Code: By Location of Violation Time M. City Veh. Lie. No. :Make of car State Lie. No. tate: Dr. Lie. No. O"ICER Star No. DEPARTMENT OF POLICE, ELK GROVE VILLAGE, ILLINOIS 1492 Section 2. Pursuant to said citation and notice the person accused of the following violations of the Municipal Code may settle and compromise the penalty arising from same by paying to the Village Clerk at the Village Hall, the amount set forth opposite the section of the Municipal Code violated and noted below provided: A - The settlement is paid within seventy-two (72) hours of the time the offense was committed. B - In cases of violations relating to the failure to purchase a license,if same is purchased prior to the payment of the settlement amount. Section of the Municipal Code Violated 14.501 thru 14.505 Incl. 14.508, 14.510, 14511, 14.512 16.2o4, 17.2o6, 17.209 15.007 16.201 thru 16.203 Incl. 16.206 (initial violation only) 17.207, 17.210 Settlement Amount $3.00 $15.00 for trucks over 10 tons 10.00 for trucks under 10 tons 5.00 other vehicles 2.00 6.00 24A.102 - In the event that the person to whom such citation or notice to appear is issued fails to settle and compromise said claim within the pres- cribed time, then the peace officer is authorized and directed to file a sworn complaint in the Circuit Court of Cook or DuPage County (as juris- diction directs), charging the violator with the violation set forth on the citation referred to. A copy of such complaint or summons shall be issued and served by the proper court official, upon the defendant violator, setting forth the date, time and place such complaint shall be heard by the Court. 24A.103 - The fact that a automobile which is illegally operated or parked is registered in the name of the person shall be considered prima-facie proof that such person was in control of the automobile at the time of such violation." -2- Section 3.
