AN ORDINANCE ANNEXING CERTAIN PORTION OF CERTAIN
STRE'TS TO THE VILLAGE OF ELK GROVE VILLAGE
WHEREAS, the Municipal Code of 1961 (Section 7-1-10,
Chapter 24, Illinois Revised Statutes) provides that territory de-
dicated for street and highway purposes which is under the juris-
diction of the Department of Public Works and Buildings of the
State of Illinois or the Township Highway Department may be an-
nexed to a municipality by ordinance if said street or highway is
contiguous to the Village, provided that the same has not been
annexed to any other muilicipality, and
WHEREAS, certain portions of Touhy Avenue and Higgins
Road presently lie without any municipality but are contiguous to
the corporate limits of the Village of Elk Grove Village, and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, Counties of Cook and DuPage, Illi-
noisk believe it to be to the best interest of the general public
and the residents of the Village of Elk Grove Village that said
portion of said streets to annexed to the corporate limits of the
Village of Elk Grove Village.
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois:
Section 1. That the territory and lands hereinafter
described, towit:
All that protion of Touhy Avenue (formerly known as
Austin Street) running in a northeasterly and southwesterly di-
rection adjoining the present village limits of Elk Grove Vil-
lage, lying between the northeasterly line of Higgins Road ex-
tended and the south line of Section 26, Township 41 North,
Range 11 East of the Third Principal Meridian, Cook County,
Illinois; ALSO
All that portion of Higgins Road adjoining the present
village limits of Elk Grove Village, lying between the south-
easterly line of that part of Touhy Avenue (formerly known as
Austin Street) extended and running in a northeasterly and south -
westerly direction and the south line of Section 26, Township 41
North, Range 11 East of the Third Principal Meridian, Cook County,
Illinois; ALSO
All that portion of Touhy Avenue, lying southwesterly
of and adjoining Lots 31 to 34, both inclusive, in the Steele's Hig-
gins and Touhy Highlands, being a Subdivision in the East half
of the Southeast quarter of Section 26, Township 41 North, Range
11 East of the Third Principal Meridian, and lying northeasterly
of and adjoining the northeasterly line of Higgins Road, ex-
tended, and lying between the southeasterly line of said Lot 31
and the northwesterly line of said Lot 34, extended to their in-
tersections with the northeasterly line of said Higgins Road,
Cook County, Illinois;
being contiguous to the Village of Elk Grove Village and being
dedicated or used for street and highway purposes and not being
within any other municipality, be and are hereby annexed and
made a part of the Village of Elk Grove Village.
Section 2. That the boundary lines of the Village of
Elk Grove Village be hereby enlarged and extended so as to include
within its corporate boundaries the above described territory.
Section 3. That the Village Clerk is hereby directed
to file a certified copy of this ordinance together with an ac-
curate map of the above territory with the Recorder of Deeds of
Cook County, Illinois.
Section 4. That this ordinance shall be in full force
and effect from and after its passage and approval according to
law.
