AN ORDINANCE AMENDING CHAPTER 22 OF THE
MUNICIPAL CODE OF ELK GROVE VILLAGE PROVIDING
FOR THE LICENSING OF JUNB PEDDLERS
NOW, THEREFORE, BF IT ORDAINED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DiPage, Illinois&
Section 1. That Chapter 22 of the Municipal Code of Elk Grove Village is
hereby amended by adding thereto the following:
"Article XVI. Junk Peddler's.
"22,1601. Definitions.
"Junk. The word "junk" is hereby defined to mean and include old iron,
chain, brass, copper, tin, lead, or other base metals, old rope, old bags, rags,
waste, empty bottles of different kinds and sizes when the number of each kind or
size is less than one gross, and all articles and things discarded or no longer
used as a manufactured article composed of, or consisting of, any one or more of
the materials or articles herein mentioned.
"Junk peddler. The term "junk peddler" is hereby defined to mean
every person who uses a junk wagon as defined herein and travels from place to
place within the Village for the purpose of purchasing junk .ar of collecting
junk for resale or makes a business of purchasing junk from anyone who desires
to sell it and carries it away upon purchasing or collecting it.
"Junk wagon. The term "junk wagon" is hereby defined to mean every
truck, wagon, automobile, push cart or other vehicle used by a junk peddler in the
collection, disposition or transportation of junk from one place to another.
"Fence. The word "fence" is hereby defined to mean and include any
place for the purchase, reception or keeping of stolen goods.
"22.1602. Fees. The annual fee for a junk peddlers license shall
be $50.00. Every junk peddler who shall operate a junk wagon in connection
with his business shall pay the sum of $25.00 annually for a junk wagon license.
This license and fee shall be in addition to the junk peddlers license mentioned
above. The licensing period and the fee applicable thereto shall be for a
period commencing on the first day of May of each year and ending on the 31st
day of April of the following year.
"22.1603, Identification. Every junk peddler, before using a junk
wagon in the Village, shall obtain from the Village Clerk a metal plate or other
suitable emblem on which shall be stamped the words "Elk Grove Village Junk."
Said emblem shall be displayed on said junk wagon in a conspicuous place and as
determined by the Chief of Police of the Village. Such person shall also
at the same time that said emblem for a junk waton is secured obtain from the
Village Clerk a metal badge for the driver of each licensed junk wagon, Such
badge shall be worn in a conspicuous place on the outside of the coat or shirt of
said driver. Each junk wagon shall be: permanently marked with the name of the
licensed peddler together vi3th the correct street address of his or its place
of business and the telephore number of same.
"22.1604. No person shall operate as a junk peddler nor shall use
a junk wagon without being first licensed for such purpose.
"22.1605. Application, An application for any licenses provided for
herein shall be made to the Village Clerk and thereupon transmitted to the
Village President. Said application shall contain the name and business of the
applicant, his place of residence, any junk licenses which he may heretofore
have secured from any other Village or City, a statement as to whether or not
he has ever been convicted of keeping, operating or conducting a fence. Corporate
applicants shall state in its application that none of its officers, stockholders

or employees have kept, operated, conducted or have been convicted of keeping,
operating or conducting a fence.
"22.1606. The President of the Village shall issue a license to
junk peddlers and for junk wagons, provided such persons applying for same shall
produce satisfactory evidence of good character and reputable standing and have
not been guilty of violating any ordinance or laws of the Village and State.
"22.1607. No junk peddler shall receive any article or thing by way
of pledge or pawn nor shall such peddler loan or advance any sum of money on the
security of any article or thing. No person licensed as a junk peddler shall
receive or hold a license to conduct the business of a pawn broker, second hard
dealer or itinerant dealer in second hand clothing. No junk peddler shall
purchase any article whatsoever from any minor without the written consent of
the minor's parent or guardian under .a penalty of not less than k1.00 nor more
than X50.00 for each offense.
"22.1608. No person shall 'keep, maintain or conduct a place for the
purchase, reception or keeping of stolen goods as a fence.
"22.1609. No junk peddler shall conduct his business between the hours
of 7:00 o'clock P.M. and 6:00 o'clock A.M. nor shall he sell, purchase or collcot
any junk on Sundays or holidays.
"22.1610. Every junk peddler who shall receive or be in possession of
any goods, articles, things or junl- which may have been lost or stolen, or are
alleged or supposed to have been lost or stolen, shall forthwith on demand exhibit
same to any member of the Police Department. Junk wagons shall be open to the
inspection of members of the Police Department at any time.
"22.1611. Whenever there shall be filed with the Chief of Police
a sworn statement by an owner of property that he has reason to believe that
certain of his goods, specifically described in the sworn statement, have been atol=
and are in the possession of a junk peddler, any member of the Police D3partmont
shall have the right to inspect the place of business of said junk peddler a"
a reasonable hour, and the refusal of the junk peddler to give such permission
shall constitute sufficient cause for the Village President to revoke said junk
peddler's licenses.
"22.1612. The license of any person licensed as a junk peddler shall
be revoked if such licensee be convicted of keeping, maintaining or conducting
a fence, as shall the license of any corporation having any officers, stockholders
or employees who have been convicted of keeping, maintaining or conducting a
fence, unless such corporation shall produce satisfactory evidence to the
President that such officer, stockholder or employee has disposed of his interest
in said corporation and has completely severed his connection with said corporation.
"22.1613. Penalty. Any person, firm or corporation who shall violate
any of the provisions of this article where no other penalty is provided shall be
fined not less than $10.00 nor more than 1200.00 for each offense and every day
on which such violation continues shall be regarded as constituting a separate
offense."
Section 2. That this ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
