HomeMy WebLinkAboutORDINANCE - 151 - 11/28/1960 - HEALTH REGULATIONS, ESTABLISHING CERTAINORDINANCE NO. 151 AN ORDINANCE ESTABLISHING CERTAIN HEALTH REGULATIONS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ELK GROVE VILLAGE, ILLINOIS, THAT: ARTICLE I Contagious Diseases Section 1 (Report Required) Every physician called in to care for or treat a person afflicted with a contagious disease or any epidemic disease shall make a report of the same within twenty -Pour hours after being called in to the Health Officer. In case no physician is in at- tendance, it shall be the duty of the person in charge or having the care of such person to make a report within twenty-four hours from the time the disease is recognized. Section 2 (Quarantine) The Health Officer shall have charge of the enfcreem n- of quarantine rules. He shall have the power and the authority to place aMr premises within which a contagious disease or an epidemic disease occurs under e^.arartine, and he shall determine the time when quarantine ends. Section 3 (Spreading Contagion) It shall be unlawful for any person to spread wilfully or carelessly, any contagious disease or to so cause the spread of the same. Section 4. ('?eliveries to Quaranti.nedPremises) No person en- gaged in the delivery of food or drink intended for human consumption shall enter any premises which are quarantined because of the existence of a contagious or epidomic disease. No containers or bottles shall be removed from any such premises until the termination of the quarantine& - and no such container which has been so removed shall be again placed in use for the carrying of food or drink until the same has been thoroughly sterilised. Section 5 (Penalty) Any person, firm, or corporation violating any of the provisions of this Arti-le shall be fined not less than two dollars nor more than t:,renty-five dollars for each offense. ARTICLE II Garbage and Refuse Section 1 (Receotaole Required) It shall be the duty of every owner or his agent or oc^want of ary house, building, flat, or apart- ment or tenement in the Village where people reside, board or lodge, or where animal or vegetable matter is prepared or served, and at all timesp to maintain in good order and repair, a can for garbage, tin cans, bottles, ashes and similar refuse. Section 2 (Specification=.) The can shall be watertight, end made of metals wi a close -fitting cover; and shall have a capacity of not more than thirty gallons and �.aall be provided with suitable handles. Section 3 (Deposit in Street) No garbage or refuse of any kind shall be epos d in any street, alley or public way, excepting as is provided in this article; and no such refuse shall be so placed that it can be blown about or scattered by the wind. Section 4 (Fees) A fee of $p1.50 per month shall be charged for the dollee on aryl disposal of garbage, rubbish and ashes when placed on the parkway for pickup. A fee of $2.00 per month shall be charged for the disposal of garbage, rubbish and ashes when it is picked up from the side or• rear of ;.r: r.. "s<=s Lire for each house or each apartment. Section ;+ (Disposal) It shall be unlawful for any person, fimp or corporation to burn or bury garbage in the Village or to permit the same to accumulate in any manner so as to create a nuisance or to at- tract flies, vermin or rats, provided however, that approved gas-fired incinerators, or such similar approved equipment, when properly installed amd inspected may be used for the burning of garbage and also, properly installed kitchen gar.3age disposal may be used for the disposal of gar- bage within the Villago. Section 4 (Pehalty) Any persons firm, or corporation violating any provision orthis Article shall be fined not less than one dollar nor more than one hundred dollars for each offense; and a separate of- fense s4ll be deemed committed on each and every day during or on which a violation occurs or is permitted to coritinuei ARTICLE TIl Other Regulations eotiofi i (t holesoms Food) It shall be unlawful to sell or offer for sae arly unwholesome or polluted food or drink of any kind in the #illagel 690tion 2 (Sanitary Regulations) All premises used for the sale or dtorage of -Mod or drink iniended for human consumption shall be kept in a Asan and sanitary condition► It shall be unlawful to permit any person who is afflicted with a contagious disease to handle any food or drink intended for human sale. Premises shall be kept free from flies arra vermin of all kinds. Section 3 (Water Courses) It shall be unlawful and a nuisance for any person, f`irm, or corporation to obstruct or pollute any water course or source of water supply in the Village. Section A (Pools) Any stagnant pool of water in the Village is hereby declared to be a nuisance. It shall be unlawful for any person, firm, or corporation to permit any such nuisance to remain or exist on any property under his or its control. Section 5 (Cemeteries) It shall be unlawful for any person, firm, or corporation to establish a cemetery or to bury any person withk the Village limits or within a mile thereof except in an established cemetery. Section 6 (Premises) It shall be unlawful to permit any building, structure or place, to remain in such a condition as to be dangerous to the public health in any way. Iny such structure, building or place is hereby dc-clared to be a nuisance; Section 7 (Acts) It shall be unlawful to commit or do any act which dndangers the public health or results in annoyance or discomfort to the public. Section 6 (Drinking. Cu.") It shall be unlawful to mainten any common drinking cup, or cups, d1ppor or similar utensil, for the use of more than one person in any public hall, theater, store or other place frequented by the public. Section 9 (Serving Food) Utensils for personal use in all places serving food or drink to the public shall be thoroughly cleaned and sterilized after each such usage, Section 10 (Nuisances - Abatement) It shall be unlawful for any person, firm, or corporation to permit or maintain the existence of any nuisance on any property under his, her, or its control. The Chief of Police and the Health Officer are each hereby authorized to abate any such ntisance existing in the Village$ whether such nuisance is specifically recognized by ordinance or not. Swction 11 (Spitting) It shall be unlawful to spit or expec- torate on any public sidewalk or other public place, or on the floor or walls of any a tore, theater, hall, public vehicle, or other place fre- quented by the public or to which the public is invited. Section 12 (Dense Smoke) It shall be unlawful to cause or per- mit the a a -Mn of dense smoke from any fire, chimney, engine, oil burner or any other agency in the Village so as to cause annoyance or discomfort to the residents thereof. For the purpose of testi and grading the density of smoke, the Ringelmann Smoke Chart as published and used by the United States Geological Survey, shall be and is hereby adopted as a standard for such grading, and smoke shall be, and is hereby defined as and declared to be "dense" when it is a degree of number three of said chart, or greeters for more than six minutes in any one hour; whether such period of time is consecutive or not. Section 13 (Penalty) Any person, firm, or corporation violating any provIs-i-on-7-f-This Article shall be fined not less than one dollar nor more than one hundred dollars for each offense; and a separate of- fense shall be deemed committed- on each and every day during or on whish a violation occurs or is permitted to cit* flue. ARTICLE IV Section 1 This ordinance shall be in full force and effect upon its passage, approval, and publication according to law. Passed this 28th day of November, 1960.
