AN ORDINANCE AUTHORIZING THE AMERICAN DISTRICT TELEGRAPH COMPANY TO MAKE
CERTAIN FIRE ALA.NM INSTALLATIONS ON VILLAGE OWNED PROPERTY.
Whereas, the A..,w rican District Telegraph Company, a Corporation, provides
fire alarm services to certain manufacturing and business establishments
located within the corporate limits of the Village of Elk Grove Village, and
whereas, it is to the mutual advantage of the Village of Elk Grove Village,
The American District Telegraph Company, and clients of said company that
telephone and other installations be placed upon village owned and or leased
property so as to better affectuate its fire alarm services.

Section 1. That ponniss''Ien and authority is hereby granted to the American
District Telegraph Company, a Corporation hereinafter referred to as the
A.D.T. Company to instal?. upon promises owned or leased by the Village of
Elk Grove Village tclephono and or electronic equipment customarilay used
in its file als._}m scr-, Ines :;aid permission to be for a period of°ane year
from ani, after the date cf p a.ssage and approval. of this
ordinance and .heraaltcr unai.l terminated by six months prior written notice
by either the Villago or th.o A_D.T, Company.
Section 2. That all equipment installations made to and upon village
propert3• by the A,D�T. C,arn My shall be made in accordance with the ordinances
of said Vill.agn and shall be placed in such locations as the Fire Chief shall
direct„ That the Village reserves the right to direct the A.D.T. Company
to change the location of its equipment so as to conform with the Village
operations:. That all cost occasioned by the installation, relocation, or
removal of said equi!)M nt shall be born by the A.D.T. Company.
Section 3. The A.D.Tt Company shall at its own expense indemnify, and save
harmless the Village from any and all damage judgments, costs and expenses
of every kind which may arise or result by reason of or inconsequence of the
actions or neglect of the A.D.T. Company, its agent or servants to fully
comply with the provisions of this ordinance and will save and keep harmless
the Village from any and all damages, juigmonts, costa and expenses caused by
or incidental to cr in any manner resulting from the installation and
maintenance of its equipment upon village property. The A.D.T. Company
waives and releases any and all claims which it new has or may hereafter
acquire agrInst the Village, arising from or growing out of any damage to
the property of the company resulting from an act or an omission of the
Village, its agents and employees.
Section 4. Permission and authority herein granted is upon the express
condition that the A.D.T. Company as consideration therefor and as compensation
for the use of tillage propermy pay to the Village the sum of $10.00 per year
for each company or buan3ss using the fire alarm system and located within
the Village of Elk G_^ave Village. Said payments to be made on July 1, 1961
and the first of July of each year thereafter.
Section 5. Iu the event that the A.D.T. Company shall default in the performance
of any cbligati'on '_-.posed by this ordinance for whatever reason, the Village of
Elk Grove Village shall have the right upon thirty days written notice to
terminate the privileges and rights granted hereunder. Nothing in this
ordinance shall be construed as preventing the Village from granting like
permission and authority to my other person, firm or corporation.
Section 6, T1; Is c- dinan:s:, shall be in f 11 force and effect from and after
its passage and approval, upon the filing with the Village Clerk by the A.D.T.
Company within thirty days after passage and approval of this ordinance, its
written and unconditional acceptance thereof.
