A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF
COMMISSIONERS, COOK COUNTY BOARD OF APPEALS, AND THE
COUNTY CLERK FOR TRANSMITTAL TO COOK COUNTY BOARD OF
COMMISSIONERS IN RESPONSE TO THE PUBLIC HEARING HELD BY THE
COOK COUNTY BOARD OF APPEALS ON AUGUST 4, 2004 REGARDING
SIGN VARIATIONS ON THE PROPERTYLOCATED ON THE SOUTH SIDE OF
1-90, APPROXIMATELY 610 FEET SOUTHEAST OF OAKTON STREET IN
ELK GROVE TOWNSHIP (2010 HIGGINS ROAD)
WHEREAS, the applicant and owner, McDonald's Corporation, of the
property legally described as follows:
That part of East 1/2 of the Northwest 1/4 of Section 26, Township 41
North, Range 11, East of the Third Principal Meridian, described as follows:
Commencing at the Southwest comer of said tract in the center of Higgins Road;
thence North along the West line of the East 1/2 of the Northwest 1/4 of said
Section 26, 377.60 feet to the Point of Beginning, thence East normal to the last
described line 281.11 feet to the Southerly line of the lands of the Northern
Illinois Gas Company; thence Northwesterly along the Southerly line of the lands
of the Northem Illinois Gas Company, said line being an arc convex to the
Southwest and having a radius of 3072.29 feet to the West line of the East 1/2 of
the Northwest 1/4 of said Section 26; thence South along the West line of the
East 1/2 of the Northwest 1/4 of said Section 26, 180.87 feet to the Point of
Beginning, all in Cook County, Illinois, Permanent Index Number
08-26-102-036-0000,
has petitioned for zoning variations to reduce the minimum required setback for
free standing, illuminated signs from 15' to 10; to increase the maximum
allowable height from 20' to 58, and, to increase the maximum allowable face
area from 200 square feet to 442 square feet per side, and
WHEREAS, said case has been docketed as Docket Number 7689 by the
Cook County Zoning Board of Appeals; and
WHEREAS, the Village of Elk Grove Village is directly contiguous to this
property on the north side, and contiguous to the adjacent corporate office
building on the south side.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois as follows:
Section 1: That the Village of Elk Grove Village does hereby register
objection to the petitioner's request for variations at the subject property
described above for the following reasons:
a. The parcel of property is directly adjacent to, and the area totally
surrounded by corporate limits of Elk Grove Village and,
eventually, will be annexed into the Village. When incorporated,
the proposed sign will exceed the Village limitations for sign
height by 30 feet, and face area by 397 square feet per side.
b. Notwithstanding testimony claiming that studies show that
illuminated signs do not pose hazards for distracting motorists,
the applicant's utilization of these studies does not lend itself to
accurate comparisons. The proposed sign incorporates new,
state of the art technology that did not exist at the time the
studies were conducted, and includes full motion video imaging
which is significantly different from the type of sign that was
considered in those studies.
c. With full motion video technology being utilized in the new sign
and the resulting unlimited array of possible displays, it is likely
that the displays and images to be utilized will cause dangerous
distractions to motorists traveling on 1-90. No evidence was
given by the petitioner to describe the types of images that will
be displayed.
d. No evidence was given to indicate whether or not the proposed
video display was, in fact, any more or less disruptive or
distracting than conventional illuminated signs that do not
incorporate moving, video quality images.

e. No evidence or testimony was provided that would suggest that
the new, full motion, color video display would not be mon;
distracting and dangerous to motorists due to the intensity of the
illumination produced from the sign, especially during night time
hours. The intensity of the level of illumination was not
discussed.
Section 2: That this Resolution shall be in full force and effect from and
after its passage and approval according to law.
Section 3: That the Village Clerk's Office is hereby directed to submit the
foregoing Resolution to all governmental bodies that have jurisdiction and/or
interest in the development of the premises as set forth above and set forth in the
caption thereto.
