AN ORDINANCE AMENDING SECTION 3-7.D.3 OF THE ZONING
ORDINANCE TO PERMIT THE REPLACEMENT OF A LEGAL NON-
CONFORMING FENCE ON PROPERTY LOCATED AT 1899 LIBERTY
COURT. ELK GROVE VILLAGE (GLICK)
WHEREAS, the Zoning Board of Appeals, at a public hearing duly called
and held according to law considered the question of granting a variation of
Section 3-7:D.3 of the Zoning Ordinance pertaining to the location of fences
beyond the line extended from the nearest front comer of the principle building
located on an adjacent single-family residential lot to permit the replacement of a
legal non -conforming privacy fence with a five (5) foot privacy fence that would
extend approximately eleven (11) feet beyond the extended line on property
located at 1899 Liberty Court, Elk Grove Village; and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village, after having reviewed the recommendation and finding of said Zoning
Board of Appeals, rind and believe that sufficient hardship exists so as to justify
the granting of said variation.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage,
Illinois as follows:
Section 1: That there be granted a variation of Section 3-7:D.3 of the
Zoning Ordinance to permit the replacement of a legal non -conforming six (6)
foot privacy fence with a rive (5) privacy fence that would extend approximately
eleven (11) feet beyond the line extended from the nearest front comer of the
principle structure on an adjacent single-family residential lot on property located
at 1899 Liberty Court, Elk Grove Village and identified by the following property
identification number
07-26-409-035-0000
Section 2: That this Ordinance shall be in full force and effect from and
after its passage and approval according to law.
VOTE: AYES: 6 NAYS: 0 ABSENT. 0
PASSED this 17" day of August 2004.
