AN ORDINANCE GRANTING A VARIATION OF SECTIONS 3-7:11 AND 3-
7:D.1 AND A VARAITION OF SECTION 7A -1:F.1 TO PERMIT A RETAINING
WALL TO EXTEND APPROXIMATELY 18 FEET BEYOND THE REQUIRED
25 FOOT SETBACK AND TO PERMIT A FENCE WITH A MAXIMUM
HEIGHT OF 9 FEET 8 INCHES ON PROPERTY LOCATED AT 733 ARIZONA
PASS, ELK GROVE VILLAGE (DARGENTO)
WHEREAS, the Zoning Board of Appeals, at a Public Hearing duly called and
held according to law, considered the question of granting a variation of the Zoning
Ordinance to permit a retaining wall in excess of 2 feet to be located 18 feet beyond the
required 25 foot setback and to permit a fence on top of the retaining wall with a
maximum height of 9 feet 8 inches on property located at 733 Arizona Pass, Elk Grove
Village, and
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village, after having reviewed the recommendation and finding of said Zoning Board of
Appeals, find and believe that sufficient hardship exists so as to justify the granting of
said variation.
NOW, THEREFORE BE IT ORDAINED, by the Mayor and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That there be granted a variation of Sections 3-7:13 and 3-7:D.1 of the
Zoning Ordinance pertaining to structures located within the required side yard fronting a
street on a corner lot, to permit a retaining wall which exceeds 2 feet in height to be
located 18 feet beyond the required 25 foot setback line.
Section 2: That there be granted a variation of Section 7A - IT. 1 of the Zoning
Ordinance to permit a fence on top of the retaining wall, which fence will have a
maximum height of 9 feet 8 inches as measured from the lowest adjacent grade.
Section 3: That the above variations are for property located at 733 Arizona Pass,
Elk Grove Village, Illinois and identified by property identification number:
07-25-307-024-0000
Section 4: That this Ordinance shall be in full force and effect from and after its
passage and approval according to law.
