A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A
LETTER OF UNDERSTANDING BETWEEN COOK COUNTY HIGHWAY DEPARTMENT AND
ELK GROVE VILLAGE FOR THE NERGE ROAD PROJECT
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, State of Illinois as follows:
Section 1: That the Mayor be and is hereby authorized to sign
the attached documents marked:
Letter of Understanding
Devon Avenue at Nerge Road
And
Nerge Road at Rohlwing Road
Section: 02 -B1113 -07 -CH
a copy of which is attached hereto and made a part hereof as if fully
set forth and the Village Clerk is authorized to attest said
documents upon the signature of the Mayor.
Section 2: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.

Dear President Johnson:
In response to your letter of July 8, 2002, the Highway Department concurs with your proposal for
our participation in construction and construction engineering costs for your Nerge Road project. We
have prepared this Letter of Understanding, in duplicate, regarding our level of participation in the
improvements to the intersections of Devon Avenue at Nerge Road and Nerge Road at Rohlwing
Road. The VILLAGE will be responsible for Phase II engineering and pay for one hundred (100%)
percent of the Phase II engineering costs. The COUNTY will have the opportunity to review and
approve the Phase II engineering plans and Phase III construction engineering proposal, if a consultant
is used.
Following County and Federal approval of Phase II construction plans, the VILLAGE will enter into
a Local Agency Agreement for Federal Participation as the Lead Agency with the COUNTY
participating as a partial Local Match sponsor. The Village will construct the improvements and be
responsible for coordinating the addition of the following terms and conditions into the Local Agency
Agreement.
The COUNTY will pay thirty (30%) percent of the construction and construction
engineering costs for pavement, drainage and necessary highway appurtenances for the
COUNTY road sections along Devon Avenue and the west leg of Nerge Road at Rohlwing
Road.
2. The COUNTY will pay thirty (30%) percent of the cost for any traffic signal interconnection
constructed along Devon Avenue between Rohlwing Road and Nerge Road and maintain said
interconnection following final inspection at its expense.

3. The COUNTY will pay a proportional share of the Local Match (30%) for the costs of traffic
signals based upon Its jurisdictional legs of the Intersections: at Devon Avenue and Nerge
Road, two-thirds (66.6%); and at Nerge Road and Rohlwing Road, twenty-five (25%)
percent.
4. The VILLAGE shall have COUNTY's Section Number: 02 -81113.07 -CH referenced in the
Local Agency Agreement as Its identification for processing reimbursement.
The VILLAGE will be responsible for paying one hundred (100%) percent (regardless of
funding source) of the costs for any VILLAGE Infrastructure, Le., new sidewalk, street lights,
etc., if included in the improvement.
6. The VILLAGE will acquire all right-of-way necessary for the project and the COUNTY will pay
for one third of the aggregate costs of right-of-way acquisition at the intersections of Nerge
Road at Rohlwing Road and Devon Avenue at Nerge Road.
7. The VILLAGE will own and maintain the retaining wall constructed along the south side of
Nerge Road west of Rohlwing Road.
IDOT will continue to have Jurisdiction and maintenance of the traffic signals at Rohlwing Road
and Devon Avenue and at Rohlwing Road and Nerge Road following final Inspection. Cook
County will continue to have jurisdiction and maintenance of the traffic signal at Devon
Avenue and Nerge Road following final Inspection. Jurisdiction over roadways will remain
unchanged.
If you concur with this Letter of Understanding, please sign both copies, keep one and return
the remaining copy to this office.
